WHEREAS Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulates the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
WHEREAS Decree No. 85/2003/NĐ-CP dated July 18, 2003 of the Government stipulates the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
WHEREAS Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government provides detailed regulations and guidelines for implementing certain provisions of the Education Law;
CONSIDERING THE PROPOSAL OF THE DEPARTMENT HEAD OF THE DEPARTMENT OF GENERAL EDUCATION.

Article 1. THESE REGULATIONS ON STUDENT ASSESSMENT AND CLASSIFICATION IN LOWER SECONDARY SCHOOLS AND UPPER SECONDARY SCHOOLS ARE ATTACHED TO THIS DECISION.
Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF PUBLICATION IN THE OFFICIAL GAZETTE AND SHALL REPLACE Decision No. 04/2005/QĐ-BGD&ĐT dated February 16, 2005 of the Minister of Education and Training on REGULATIONS ON STUDENT ASSESSMENT AND CLASSIFICATION IN LOWER SECONDARY SCHOOLS. ALL PRIOR PROVISIONS CONTRARY TO THIS DECISION ARE ABROGATED.
Article 3. THE DIRECTOR OF THE OFFICE, THE DEPARTMENT HEAD OF THE DEPARTMENT OF GENERAL EDUCATION, THE HEADS OF THE UNITS UNDER THE MINISTRY OF EDUCATION AND TRAINING RELATED TO THIS DECISION, THE CHAIRMEN OF THE PROVINCE PEOPLE'S COMMITTEES AND THE CITY PEOPLE'S COMMITTEES UNDER THE CENTRAL GOVERNMENT, AND THE DIRECTORS OF THE DEPARTMENTS OF EDUCATION AND TRAINING ARE RESPONSIBLE FOR IMPLEMENTING THIS DECISION.
