Pursuant to Decree No. 103/2009/NĐ-CP dated November 6, 2009 of the Government promulgating the Rules on Cultural Activities and Public Cultural Service Business Operations;

Pursuant to Decree No. 79/2012/NĐ-CP dated October 5, 2012 of the Government on artistic performances, fashion shows; beauty and model contests; circulation and business of audio and video recordings of music, dance, and stage arts; and Decree No. 15/2016/NĐ-CP dated March 15, 2016 of the Government amending and supplementing certain articles of Decree No. 79/2012/NĐ-CP dated October 5, 2012 of the Government;

Pursuant to Decree No. 113/2013/NĐ-CP dated October 2, 2013 of the Government on fine art activities;

Pursuant to Decree No. 72/2016/NĐ-CP dated July 1, 2016 of the Government on photography activities;

"a) State agencies, organizations, and individuals owning power plants operating within the territory of the Socialist Republic of Vietnam connected to the national power grid, except strategic multi-purpose hydropower plants, small renewable energy power plants applying the avoided cost tariff, power plants and units providing ancillary services, independently invested energy storage systems, and power plants applying the electricity purchase price mechanism as stipulated in relevant authorized documents;" Party work and political work,

The Minister of Public Security promulgates this Circular on creative, performing, and art exhibition activities within the People's Public Security Forces.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates creative, performing, and art exhibition activities within the People's Public Security Forces.

Article 2. Interpretation of Terms

In this Circular, the following terms shall be understood as follows:

1. Creative activity within the People's Public Security Forces means activities organized in the form of competitions, campaigns, creative camps, commissioned works, or individual self-creations of works in singing, dancing, music, stage play scripts, literature, fine arts, and photography.

2. Performing activity within the People's Public Security Forces means activities presenting programs, items, plays to officers and soldiers, including: performing activities of professional art troupes; mass art festivals, contests, and exchanges; cultural exchanges and other performing activities serving political tasks.

3. Mass performing activity masses is the activity of bringing programs, items, and plays to the public through the performance of non-professional artists.

4. Professional performing activity is the activity of bringing programs, items, and plays to the public through the performance of professional actors and professional performing art units.

5. Art exhibition activity within the People's Public Security Forces is organizing the announcement, display, promotion, and introduction of works in singing, dancing, music, stage play scripts, literature, fine arts, and photography to the public.

6. Mass art troupe, team, club of the People's Public Security Forces is a non-professional art organization established, managed, and directed by authorized authorities.

Article 3. Responsibilities for managing creative, performing, and art exhibition activities within the People's Public Security Forces

1. The Minister of Public Security shall uniformly manage creative, performing, and art exhibition activities within the People's Public Security Forces.

2. The Political and Ideological Work Department shall be responsible for assisting the Minister of Public Security in managing creative, performing, and art exhibition activities within the People's Public Security Forces.

3. Heads of public security units and localities within their scope and authority shall manage creative, performing, and art exhibition activities at their units and localities. Units providing political work advice assist heads of public security units and localities in managing creative, performing, and art exhibition activities at their units and localities.

Article 4. Budget for organizing artistic activities within the People's Public Security Forces

1. The budget for organizing creative, performing, and art exhibition activities within the People's Public Security Forces shall be allocated from the annual state budget for security affairs assigned to public security units and localities; from local state budgets; from fundraising, sponsorship, socialization, and other lawful sources as prescribed by law.

2. The preparation, management, utilization, and settlement of the budget for organizing creative, performing, and art exhibition activities within the People's Public Security Forces shall be carried out in accordance with the State Budget Law and detailed implementing regulations thereof.

3. The budget for training and professional development in cultural and artistic work shall be implemented in accordance with the Ministry of Public Security's regulations on managing and utilizing training and professional development funds in the People's Public Security Forces.

Chapter II

CREATIVE ACTIVITY

Article 5. Requirements for Content of Works

1. Ensuring alignment with the Party's guidelines and policies, and state laws on building and developing Vietnamese culture and people to meet the requirements of sustainable national development and international integration; guiding the Party Committee of the Ministry of Public Security and the Ministry of Public Security on cultural and artistic work within the People's Public Security.

2. Promoting education on the traditions of the Party, the nation, and the People's Public Security; educating morals, cultural lifestyles, and values of "truth, goodness, beauty"; meeting the spiritual cultural enjoyment needs of officers and soldiers of the People's Public Security.

3. Reflecting the thoughts, aspirations, emotions, and responsibilities of officers and soldiers of the People's Public Security; praising and highlighting exemplary individuals, good deeds, acts of kindness, advanced models, and positive images of officers and soldiers of the People's Public Security.

4. Struggling against and criticizing negative manifestations that deviate from political ideology, moral character, lifestyle, posture, etiquette, working style, communication culture, and violations of officers and soldiers of the People's Public Security.

5. Not conflicting with social moral values, traditional customs, and cultural norms of the nation; not defaming, tarnishing the image, honor, reputation, or tradition of the People's Public Security.

Article 6. Management of Creative Activities

1. The Department of Party Work and Political Affairs assists the Minister of Public Security

a) Managing and guiding creative activities within the People's Public Security; inspecting and evaluating artistic creative activities of public security units and localities;

b) Managing and guiding the content of activities of organizations and associations with professional artistic functions within the People's Public Security;

c) Managing and guiding creative activities on topics related to the People's Public Security by units and individuals outside the People's Public Security in collaboration with units within the People's Public Security.

2. Heads of public security units and localities manage creative activities of their units and subordinates.

Article 7. Organization of Creative Activities

1. The Department of Party Work and Political Affairs organizes or guides the organization of creative activities on topics related to the People's Public Security to celebrate traditional anniversaries of the People's Public Security and the National Security Day held every five years, or when there is a need to serve political tasks.

2. Heads of public security units and localities organize or coordinate in organizing creative activities on topics related to the People's Public Security within their units and localities; organizing participation of officers and soldiers of the People's Public Security in creative activities organized by the Ministry of Public Security, central ministries, sectors, and professional associations or at the local level.

3. Procedures for Organizing Creative Activities

When organizing creative activities, public security units and localities shall comply with the provisions of Article 11 of Decree No. 113/2013/ND-CP, Article 9 of Decree No. 72/2016/ND-CP, and the following regulations:

a) Before organizing creative activities, public security units and localities must develop a plan and report it to the Ministry of Public Security (through the Department of Party Work and Political Affairs), which must clearly specify the scale; form of organization, genre, theme; time, location, and participants;

b) After completing creative activities, within fifteen working days, public security units and localities must report the results of the creative activities to the Ministry of Public Security (through the Department of Party Work and Political Affairs);

c) Officers and soldiers of the People's Public Security have the freedom to create according to the law. For works on topics related to the People's Public Security, they must ensure the content requirements stipulated in Article 5 of this Circular and report the results of creation to the head of their unit.

Chapter III

PERFORMING ACTIVITIES

Article 8. Requirements for Programs and Content of Performances

1. Not to violate the provisions stipulated in Article 3 of the Regulation on Cultural Activities and Public Cultural Service Business Operations issued together with Decree No. 103/2009/NĐ-CP; Clause 2, Article 6 of Decree No. 79/2012/NĐ-CP.

2. To comply with the authority and procedures for granting performance permits as prescribed in Article 9, Article 13 of Decree No. 79/2012/NĐ-CP and Clause 5, Article 1 of Decree No. 15/2016/NĐ-CP.

3. The form and content of programs and performance items must not contravene values, ethical standards, traditional customs, and cultural traditions of Vietnam and the tradition of the People's Public Security; they must not defame or tarnish the image, honor, and reputation of the People's Public Security.

4. The use of People's Public Security uniforms in artistic performances must comply with the regulations of the People's Public Security Regulations, except for performance items that require technical elements or artistic requirements.

Article 9. Management of Performance Activities

1. The Department of Party Work and Political Affairs assists the Minister of Public Security

a) Managing performance activities on a scale involving the entire force; external performance activities; performance activities involving collaboration between the Ministry of Public Security and central ministries and sectors; art competitions, festivals, and gatherings within the People's Public Security.

b) Managing the activities and reviewing the artistic content and programs of professional art troupes of the People's Public Security.

c) Reviewing the artistic content and programs of units and individuals representing the Ministry of Public Security performing abroad.

d) Reviewing the artistic content and programs of units and individuals outside the People's Public Security participating in performances organized or co-organized by the Ministry of Public Security to serve officers and soldiers.

2. Heads of public security units and localities shall be responsible for

a) Managing performance activities of their own units and localities; performance activities involving collaboration with provincial departments and sectors.

b) Managing and guiding the content of activities of mass art groups and professional art troupes under their units and localities (if any).

c) Approving the artistic content and programs of subordinate units and individuals before performances; approving the artistic content and programs of units and individuals outside the People's Public Security before performances serving officers and soldiers at their units and localities.

Article 10. Organization of Mass Artistic Performance Activities

1. The Department of Party Work and Political Affairs assists the Minister of Public Security

a) Organizing art competitions, contests, and gatherings (hereinafter referred to collectively as art competitions) for the entire force to celebrate the anniversary of the People's Public Security and the National Day for All-People Security Protection, held every five years.

b) Organizing, co-organizing, or participating in mass art activities organized by central ministries and sectors or performances serving other political needs.

2. Heads of public security units and localities shall be responsible for

a) Organizing mass art competitions to celebrate the anniversary of the People's Public Security and the National Day for All-People Security Protection, held twice every five years.

b) Organizing, co-organizing, or participating in mass art activities organized by local departments and sectors or performances serving other political needs in the locality.

3. When organizing mass artistic performance activities, public security units and localities shall comply with the provisions stipulated in Article 15 of Decree No. 79/2012/NĐ-CP; Clause 9, Article 1 of Decree No. 15/2016/NĐ-CP; Circular No. 09/2016/TT-BVHTTDL dated October 14, 2016 of the Minister of Culture, Sports and Tourism on the organization of mass art competitions and the following provisions:

a) Before organizing an art competition, a plan must be developed and reported to the Ministry of Public Security (through the Political Work Department), which must clearly state the purpose, scope, theme, content, program, time, location, and participants.

b) Within fifteen working days after the conclusion of the art competition, the results of the organization must be reported to the Ministry of Public Security (through the Political Work Department).

4. Public security units and localities establish art groups, teams, and clubs to perform services for political tasks and meet the cultural and spiritual life of officers and soldiers of the People's Public Security. The composition, number of members, and living and training systems of these art groups, teams, and clubs are decided by the head of the public security unit or locality.

Article 11. Organization of Professional Art Performance Activities

1. Professional art units under the People's Public Security organize performance activities in accordance with Decree No. 79/2012/NĐ-CP; Decree No. 15/2016/NĐ-CP; Circular No. 01/2016/TT-BVHTTDL dated March 24, 2016 issued by the Minister of Culture, Sports and Tourism detailing certain provisions of Decree No. 79/2012/NĐ-CP; Circular No. 10/2016/TT-BVHTTDL dated October 19, 2016 issued by the Minister of Culture, Sports and Tourism amending and supplementing certain provisions of Circular No. 01/2016/TT-BVHTTDL, and the following regulations:

a) The establishment of the Art Councils of professional art units under the People's Public Security shall be carried out in accordance with Circular No. 15/2013/TT-BVHTTDL dated December 24, 2013 issued by the Minister of Culture, Sports and Tourism on the organization and operation of the Art Council in the field of artistic performance.

b) Report to the Political and Ideological Work Department for approval of the content and program of the art performance activities of the unit in accordance with Clause 1, Article 9 of this Circular.

2. Art units outside the People's Public Security entering to perform for officers and soldiers of the People's Public Security must obtain the consent of the head of the unit in accordance with the management authority stipulated in Clause 2, Article 9 of this Circular.

The unit responsible for political work advises the head of the public security unit or locality to review the content, program, participants, and procedures for organizing performances of art units in accordance with Decree No. 79/2012/NĐ-CP, Decree No. 15/2016/NĐ-CP, and the regulations of the Minister of Public Security.

Chapter IV

ART EXHIBITION ACTIVITIES

Article 12. Requirements for Art Exhibition Activities

1. Not to violate the provisions of Article 8 of Decree No. 113/2013/NĐ-CP and Article 5 of Decree No. 72/2016/NĐ-CP.

2. To implement the exhibition permit issuance authority and procedures in accordance with Article 14 and Article 15 of Decree No. 113/2013/NĐ-CP, and Articles 11 and 12 of Decree No. 72/2016/NĐ-CP.

3. The form and content of the exhibition must not contravene the values, moral standards, customs, cultural traditions of Vietnam, and the tradition of the People's Public Security; it must not defame or tarnish the image, honor, and reputation of the People's Public Security.

Article 13. Management of Art Exhibition Activities

1. The Department of Party Work and Political Affairs assists the Minister of Public Security

a) Manage art exhibitions on the theme of the People's Public Security throughout the force; art exhibitions on the theme of the People's Public Security abroad;

b) Approve the content and quality of artistic works on the theme of the People's Public Security by public security units and localities, and by units and individuals outside the People's Public Security participating in joint exhibitions.

2. The head of the public security unit or locality manages art exhibition activities at their own unit or locality.

Article 14. Organization of Art Exhibition Activities

1. The Department of Party Work and Political Affairs assists the Minister of Public Security

a) Organize art exhibitions on the theme of the People's Public Security at a national scale to celebrate the anniversary of the People's Public Security and the National Security Day held every five years, or when there is a need to serve political tasks;

b) Coordinate to organize or participate in art exhibitions on the theme of the People's Public Security organized by central ministries and agencies.

2. Heads of public security units and localities shall be responsible for

a) Organize art exhibitions on the theme of the People's Public Security at their own unit or locality;

b) Coordinate to organize or participate in art exhibitions organized by local departments and agencies.

3. Procedures for organizing art exhibition activities

a) Before organizing an art exhibition, the public security unit or locality must develop a plan and report it to the Ministry of Public Security (through the Political and Ideological Work Department); the plan must clearly state the theme, content, time, and location of the exhibition;

b) After completing the exhibition activity, within fifteen working days, the public security unit or locality must report the results of the exhibition to the Ministry of Public Security (through the Political and Ideological Work Department).

Chapter V

IMPLEMENTATION

Article 15. Effective Date

This Circular takes effect from February 8, 2019, replacing Decision No. 263/2003/QĐ-BCA(X15) dated April 25, 2003 issued by the Minister of Public Security regarding mass art activities of the People's Public Security force and previous decisions and documents of the Ministry of Public Security that conflict with this Circular.

Article 16. Responsibility for Implementation

1. Heads of units under the Ministry; Directors of academies, Principals of public security universities; Directors of provincial public security services directly under the Central Government are responsible for implementing this Circular and reporting annually on its implementation to the Ministry of Public Security (through the Political and Ideological Work Department).

2. The Political and Ideological Work Department is responsible for assisting the Minister of Public Security in organizing training and professional development for cultural and artistic staff; guiding and inspecting public security units and localities in implementing this Circular. In the process of implementing this Circular, if there are difficulties, public security units and localities should report to the Ministry of Public Security (through the Political and Ideological Work Department) for guidance on implementation.
