Considering the proposal of the Minister of Justice,
DECISION:
Clause 4 of Article 6This Decision attaches the Action Program to implement Conclusion No. 04-KL/TW dated April 19, 2011 of the Central Committee's Secretariat (XIIIth tenure) on the results of implementing Directive No. 32-CT/TW dated December 9, 2003 of the Central Committee's Secretariat (IXth tenure) on strengthening the Party’s leadership in legal education and popularization work, raising awareness of law observance among cadres and people from 2012 to 2016.
Article 2. This Decision shall take effect from the date of signing.
Article 3. Ministers, Heads of equivalent Ministries, Heads of Government agencies, Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decision.

On April 19, 2011, the Central Committee's Secretariat issued Conclusion No. 04-KL/TW on the results of implementing Directive No. 32-CT/TW dated December 9, 2003 of the Central Committee's Secretariat (IXth tenure) on strengthening the Party’s leadership in legal education and popularization work, raising awareness of law observance among cadres and people (hereinafter referred to as Conclusion No. 04-KL/TW of the Central Committee's Secretariat). To ensure consistent, synchronized, and effective implementation of Conclusion No. 04-KL/TW of the Central Committee's Secretariat across the country, contributing to improving the quality and effectiveness of legal education and popularization work to meet the requirements of industrialization, modernization, and international integration of the country in the current period and the years ahead, the Prime Minister issues the Action Program with the following main contents:
On April 19, 2011, the Central Committee's Secretariat issued Conclusion No. 04-KL/TW on the results of implementing Directive No. 32-CT/TW dated December 9, 2003 of the Central Committee's Secretariat (IXth tenure) on strengthening the Party’s leadership in legal awareness dissemination and education work to enhance officials' and people's compliance with laws (hereinafter referred to as Conclusion No. 04-KL/TW of the Secretariat). To ensure consistent, synchronized, and effective implementation of Conclusion No. 04-KL/TW of the Secretariat nationwide, contributing to improving the quality and effectiveness of legal awareness dissemination and education work to meet the requirements of industrialization, modernization, and international integration of the country in the current period and the years ahead, the Government Prime Minister issues an Action Program with the main contents as follows:
I. GUIDING PRINCIPLES
1. Ensuring the implementation of the Party’s leadership in legal education and popularization work according to the spirit and content stated in Conclusion No. 04-KL/TW of the Central Committee's Secretariat; focusing on intensifying and directing legal education and popularization work to the grassroots level.
2. The State plays a core role in legal education and popularization work; enhancing the policy of socialization in encouraging, creating conditions, mobilizing the participation and contributions of various economic sectors and social resources in this work.
3. Combining legal education and popularization with moral education, raising legal and professional ethics awareness for the cadre, civil servant, public officer, and military personnel; through the performance of official duties, promoting legal education and popularization to the people; closely linking inspection, supervision, investigation, prosecution, trial, and enforcement activities with the dissemination and popularization of relevant legal provisions.
4. Inheriting and continuing to promote the achievements of legal education and popularization work in recent years; summarizing practical experiences to select and expand effective models and methods in this work.
II. OBJECTIVES
1. Creating a strong shift in the quality and effectiveness of legal education and popularization work, raising self-awareness, respect, and strict compliance with laws among cadres, civil servants, public officers, and all citizens.
2. Extensively and comprehensively deploying various forms of legal education and popularization. Among them, selecting and developing effective models and methods of legal education and popularization that suit the target groups, regions, and the need for legal knowledge of the people at each stage.
III. MAIN TASKS
Ministries, equivalent Ministries, Government agencies, People's Committees of provinces and centrally governed cities shall organize comprehensive, synchronized, and unified implementation of legal education and popularization tasks according to the guidance of the Central Committee's Secretariat in Conclusion No. 04-KL/TW, focusing on the following contents:
1. Continuing to guide and direct the thorough dissemination and implementation of the content of Conclusion No. 04-KL/TW of the Central Committee's Secretariat; linking the implementation of the Conclusion with the implementation of resolutions of Party congresses at all levels and the Eleventh National Congress of the Communist Party of Vietnam; combining comprehensive legal education and popularization activities with the fulfillment of political tasks in ministries, sectors, and localities.
2. Improving policies and institutional frameworks for legal education and popularization work, providing a stable, unified, and synchronized legal basis for the implementation of legal education and popularization activities; drafting and promulgating promptly detailed regulations to implement the Law on Legal Education and Popularization after its adoption by the National Assembly; organizing the effective implementation of legal documents in this field.
3. Enhancing the quality and effectiveness of coordination in implementing legal education and popularization work among agencies, organizations, and localities; continuing to consolidate and improve the roles and responsibilities of the Steering Committee for Legal Education and Popularization Work and its members at all levels; formulating reasonable policies for members of the Steering Committee for Legal Education and Popularization Work at all levels.
4. On the basis of summarizing the Projects under the National Program on Popularizing, Educating Law, and Enhancing Legal Compliance Awareness for cadres and people at communes, wards, and towns from 2005 to 2010, review and select to inherit and promote achievements, overcome limitations, weaknesses, identify needs, directions, tasks, and methods to implement appropriately with the new situation in the subsequent phase until 2016 or integrate the implementation of these Projects into ongoing practical, suitable, and effective Projects on popularizing and educating law; conduct mid-term and final reviews of the implementation of Projects on popularizing and educating law under the Law Popularization and Education Program for the period of 2008-2012, and develop plans to continue implementing effective contents and models of law popularization and education.
5. Continue building a professional cadre team for law popularization and education work, of high quality, firm in political and ideological stance, knowledgeable about laws, skilled and professionally competent in law popularization and education. Specifically as follows:
a) Build a cadre team specialized in law popularization and education in each field of law and trained in law popularization and education skills. Conduct reviews, categorize, evaluate, and plan regular training and updating of legal knowledge, skills, and law popularization and education techniques for this cadre team.
b) Strengthen and improve the capacity of legal institutions at Ministries, agencies equivalent to Ministries, government agencies, and specialized agencies under provincial People's Committees directly under the Central Government in advising leadership bodies at ministries, sectors, and localities on law popularization and education work.
c) Enhance the capacity and level of judicial cadres, legal lecturers, and legal propagandists participating in law popularization and education at grassroots levels; continue to leverage the effectiveness of activities of organizations participating in law popularization and education at grassroots levels such as core groups mobilizing people to comply with laws, grassroots mediation teams; organize training and education on legal knowledge and law popularization and education skills for this cadre team; adopt reasonable policies to motivate and encourage this cadre team to participate in law popularization and education.
d) Mobilize lawyers, legal experts, and other legal workers to participate in their social responsibility for law popularization and education work. Study and build preferential systems to motivate this cadre team to participate in law popularization and education.
6. Popularize and educate law for cadres at commune level, people in rural areas, mountainous regions, islands, remote areas, and areas with special difficulties in socio-economic conditions; workers in enterprises; persons with disabilities; victims of domestic violence, human trafficking; prisoners; students in correctional schools; and Vietnamese citizens abroad.
7. Innovate the content and forms of law popularization and education to suit different target groups and regions, focusing on important fields of law such as traffic safety, land, complaints, denunciations, natural resources and environment, gender equality, food safety, prevention and control of social evils, anti-corruption...; pay attention to expanding and promoting the effectiveness of exemplary models in reality; be proactive, creative, and flexible in applying new models and methods of law popularization and education; combine law popularization and education with monitoring law enforcement; strengthen the application of information technology in law popularization and education. Specifically as follows:
a) Organize the implementation of some new and effective forms of law popularization and answering questions. Among which, focus on direct law popularization and education at temporary shelters, cultural houses, community activity centers at grassroots levels, Community Learning Centers.
b) Diversify forms of law popularization and education through mass media suitable for different target groups; pay attention to broadcasting programs on law popularization and education in ethnic minority languages and foreign languages; continue to consolidate and expand the grassroots radio network in rural areas, remote areas, and far-flung areas, improving the quality of law popularization and education on the grassroots radio network.
c) Develop and implement programs and projects to develop information technology in law popularization and education work; expand and strengthen the application of the Internet in law popularization and education work, creating conditions for the public to access free legal information via the Internet; mobilize resources to invest in projects to build databases and provide online services in law popularization and education.
8. Continue to enhance the quality of law popularization and education work in schools and other training institutions; training and retraining institutions for state agencies, political organizations, political-social organizations, and the people's armed forces, appropriate to each educational level and training level. Strengthen training and retraining, gradually standardize the teaching staff for civic education and law courses; innovate and improve the quality of law education suitable for each group and educational goals. It is necessary to determine this as an important compulsory subject in the training and teaching program for all educational and training institutions.
Develop and pilot the implementation of the curriculum and subject content for legal pedagogy at higher education institutions specializing in law to train teachers for civic education and law lecturers in schools towards standardization, quality, and meeting the requirements of law teaching and learning.
IV. IMPLEMENTATION
1. On the basis of the main tasks and contents of this Action Program, based on their assigned functions and responsibilities, the Minister, the Heads of Ministries equivalent to Ministries, agencies under the Government, the Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for organizing the implementation, directing the development of Implementation Plans of their ministries, sectors, and localities for the period 2012-2016, and concretizing them into annual plans. The ministries and sectors primarily responsible for the Projects in this Action Program shall base on the content and progress of each Project and the current expenditure system to develop budget estimates, which will be consolidated into the annual state budget estimates of their respective ministries and sectors and submitted to the Ministry of Finance for consolidation. For tasks that do not need to be implemented through the Projects of this Action Program, they should be organized and implemented immediately to meet the timely requirements of the current and future legal awareness and education work.
2. The Ministry of Justice, as the managing agency of this Action Program, shall be responsible for assisting the Prime Minister in guiding, directing, and organizing the implementation of the Action Program; guiding ministries, sectors, and localities to build and implement tasks in accordance with the objectives of the Action Program based on their assigned functions and responsibilities; regularly summarizing, concluding, inspecting, evaluating, drawing lessons, and promptly motivating and rewarding collectives and individuals who have outstanding achievements in implementing the Action Program; submitting to the Prime Minister for decision on adjusting the objectives and tasks when necessary; regularly reporting to the Prime Minister on the results of the Action Program's activities.
3. The ministries assigned to primarily manage the Projects and the agencies cooperating in implementing the Projects in the Legal Awareness and Education Program from 2008 to 2012 issued together with Decision No. 37/2008/QĐ-TTg dated March 12, 2008 of the Prime Minister, based on the summary of the implementation of the Projects and the Program, shall develop plans to continue implementing the Projects until 2016, specifically as follows:
a) The Ministry of Agriculture and Rural Development shall primarily manage and cooperate with the Ministry of Justice, the Committee for Ethnic Minorities Affairs, the Vietnam Farmers' Union, and the Central Committee of the Vietnam Women's Union to develop plans to implement the Project "Promoting and Disseminating Law to Rural Residents and Ethnic Minority Groups from 2009 to 2012" issued pursuant to Decision No. 554/QĐ-TTg dated May 4, 2009 of the Prime Minister until 2016;
b) The Ministry of Justice shall primarily manage and cooperate with the Ministry of Home Affairs, the Ministry of Public Security, the Central Propaganda Department, and the Communist Party of Vietnam to develop plans to implement the Project "Strengthening, Reorganizing, and Improving the Quality of Human Resources in Legal Awareness and Education Work to Meet the Requirements of Reform and Development from 2008 to 2012" issued pursuant to Decision No. 270/QĐ-TTg dated February 27, 2009 of the Prime Minister until 2016;
c) The Ministry of Education and Training shall primarily manage and cooperate with the Ministry of Justice, the Ministry of National Defense, the Ministry of Public Security, the Ministry of Labor, Invalids and Social Affairs, the Central Youth Union, and the National Academy of Political Science and Administration to develop plans to implement the Project "Improving the Quality of Legal Awareness and Education Work in Educational Institutions" issued pursuant to Decision No. 1928/QĐ-TTg dated November 20, 2009 of the Prime Minister until 2016;
d) The Ministry of Labor, Invalids and Social Affairs shall primarily manage and cooperate with the Ministry of Justice, the General Confederation of Trade Unions, and the Vietnam Chamber of Commerce and Industry to develop plans to implement the Project "Promoting and Disseminating Law to Workers and Employers in Various Types of Enterprises from 2009 to 2012" issued pursuant to Decision No. 31/2009/QĐ-TTg dated February 24, 2009 of the Prime Minister until 2016.
4. The following ministries, agencies equivalent to ministries, and agencies under the Government shall be responsible for primarily managing and cooperating with relevant ministries, sectors, and political-social organizations to develop detailed Projects for approval by the Prime Minister and to organize the implementation of these Projects, specifically as follows:
a) The Government Inspectorate shall primarily manage and cooperate with the Ministry of Justice, the Ministry of Information and Communications, the Central Committee of the Vietnam Fatherland Front, the Vietnam Farmers' Union, Voice of Vietnam Radio, and Vietnam Television to develop and implement the Project "Continuing to Strengthen Legal Awareness and Education Work on Complaints and Petitions at Communes, Wards, and Towns during the Period 2012-2016";
b) The Ministry of National Defense shall primarily manage and cooperate with the Ministry of Justice, the Ministry of Foreign Affairs, and the Ministry of Natural Resources and Environment to develop and implement the Project "Enhancing Legal Awareness and Education Work for Cadres and People in Border Areas and Islands during the Period 2012-2016";
c) The Ministry of Justice shall primarily manage and cooperate with the Ministry of Public Security, the Government Inspectorate, the Vietnam Veterans Association, and the Vietnam Farmers' Union to develop and implement the Project "Enhancing Legal Awareness and Education Work in Some Key Areas of Law Violations during the Period 2012-2016";
d) Vietnam Television shall primarily manage and cooperate with the Ministry of Justice and the Ministry of Information and Communications to develop and implement the Project "Enhancing Legal Awareness and Education Work on Vietnam Television during the Period 2012-2016";
đ) Voice of Vietnam Radio shall primarily manage and cooperate with the Ministry of Justice and the Ministry of Information and Communications to develop and implement the Project "Enhancing Legal Awareness and Education Work on Voice of Vietnam Radio during the Period 2012-2016".
5. It is requested that the Central Committee of the Vietnam Fatherland Front, the Vietnam Bar Federation, the Vietnam Lawyers' Association, and the member organizations of the Fatherland Front participate in organizing the implementation of the contents of this Action Program within their organizations; primarily manage and cooperate with the assigned ministries, sectors, and relevant political-social organizations to develop detailed Projects for approval by the Prime Minister and to organize the implementation of these Projects, specifically as follows:
a) Request the Vietnam Fatherland Front Central Committee to take the lead and coordinate with the Ministry of Justice, the Ministry of Information and Communications, the Vietnam Farmers' Association, the Ho Chi Minh Communist Youth Central Committee, the Vietnam Women's Union, and the Vietnam Veterans Association to develop and implement the Project "Continuing to build and promote legal awareness and compliance campaigns within communities for the period 2012-2016";
b) Request the Vietnam Bar Federation to take the lead and coordinate with the Ministry of Justice and the Ministry of Finance to develop and implement the Project "Socializing legal dissemination and education and legal aid work for the period 2012-2016";
6. Request the Supreme People's Court and the Supreme People's Procuracy to direct all sectors to actively cooperate in disseminating and educating the law, improving the quality of integrating legal dissemination and education through specialized activities;
7. The Ministry of Finance shall be responsible for allocating the annual budget for relevant ministries, sectors, localities, and organizations to implement the Action Program, implement projects under the Legal Dissemination and Education Program for the period 2008-2012 until 2016, and projects under this Action Program in accordance with the State Budget Law; ensure balanced budgets to serve legal dissemination and education work for localities that cannot balance their own budgets; take the lead in reviewing, amending, and supplementing current legal regulations on ensuring funding for legal dissemination and education work to suit practical conditions; coordinate with the Ministry of Justice and related agencies to implement the contents of the Action Program;
8. Provincial People's Committees directly under the central government shall, based on their assigned functions and tasks, be responsible for perfecting the organizational network for legal dissemination and education at the local level; ensure sufficient staffing, funding, and infrastructure for legal dissemination and education work; strengthen state management over legal dissemination and education; study and issue plans, organize the implementation of the Action Program in line with the socio-economic development plan of the locality during each period;
