DECISION
Regarding the functions, tasks, powers, and organizational structure of the Radio Frequency Management Department

THE MINISTER OF POSTS AND TELECOMMUNICATIONS
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;
Based on the proposal of the Organization and Cadres Department Director and the Radio Frequency Management Department Director.
DECISION
Article 1. The Radio Frequency Management Department is an agency under the Ministry of Posts and Telecommunications responsible for managing state affairs in the specialized field of radio frequencies, satellite orbits, and broadcasting transmission nationwide.
Article 2. The Radio Frequency Management Department has the following tasks and powers:
1. Researching and proposing, participating in drafting, revising, supplementing, and implementing regulatory documents concerning radio frequencies, satellite orbits, and broadcasting transmission.
2. Drafting and submitting to the Minister plans and projects for the exploitation and allocation of radio frequencies, regulations for coordination with relevant ministries and sectors in the supervision and control of radio frequency usage and harmful interference resolution.
3. Drafting and submitting to the Minister for issuance planning schemes for frequency bands, channels, and radio frequencies by region; regulations on conditions for allocating, assigning, and using radio frequencies and frequency bands.
4. Cooperating with related agencies and units within the Ministry to draft and submit to the Minister technical conditions and operational regulations for conditional-use radio equipment, frequency and power specifications for radio equipment before production or import for use in Vietnam.
5. Participating with related agencies and units within the Ministry in training and issuing radio operator certificates.
6. Issuing, temporarily suspending, suspending, and revoking various types of licenses for radio frequencies, radio equipment, satellite orbits, and broadcasting transmission; providing guidance on business procedures and coordinating with regional Postal, Telecommunications, and Information Technology Departments in the management of radio frequencies and radio equipment according to the Minister's regulations.
7. Implementing international frequency registration, international cooperation on radio frequencies, handling and resolving complaints about harmful interference in radio frequencies of Vietnam; participating in international monitoring programs and technical activities of international organizations on radio frequencies according to the Minister's classification.
8. Monitoring domestic broadcast stations and foreign stations broadcasting to Vietnam in accordance with Vietnamese laws and international treaties to which Vietnam is a party.
9. Inspecting and supervising radio frequencies and radio equipment, handling harmful interference; inspecting and confirming electromagnetic compatibility for radio-emitting devices according to the law.
10. Inspecting the implementation of legal provisions on radio frequencies, satellite orbits, and broadcasting transmission; resolving complaints and accusations and administratively punishing violations in the management of radio frequencies, satellite orbits, and broadcasting transmission nationwide according to inspection regulations and the Minister's provisions.
11. Serving as the permanent body of the Radio Frequency Committee and participating in its activities. The Director of the Radio Frequency Management Department serves as the Secretary of the Radio Frequency Committee.
12. Collecting, managing, and utilizing fees and charges related to radio frequencies according to the law and the Minister's provisions.
13. Managing organization, cadres, civil servants, staff, assets, files, and documents of the department according to the law and the Minister's classification.
14. Performing other tasks assigned by the Minister.
Article 3. The Radio Frequency Management Department is headed by the Director, assisted by Deputy Directors, administrative machinery, and subordinate units.
The Director of the Radio Frequency Management Department is responsible to the Minister of Posts and Telecommunications for the results of performing the functions, tasks, and powers stipulated in Articles 1 and 2 of this Decision. Deputy Directors assist the Director and are responsible to the Director for the assigned tasks.
Article 4. The organizational structure of the Radio Frequency Management Department includes:

The staffing of the Radio Frequency Management Department is established by the Director and submitted to the Minister of Posts and Telecommunications for decision.
The functions, tasks, and powers of the subordinate Centers of the Radio Frequency Management Department are established by the Director and submitted to the Minister for decision.
The functions, tasks, and powers of the subordinate Departments of the Radio Frequency Management Department are defined by the Director.
The working relationship between the Centers and the Departments of the Radio Frequency Management Department is defined by the Director.
The functions, tasks, and powers of the Radio Frequency Management Inspection Department are implemented according to the regulations of the Ministry of Posts and Telecommunications.
Article 5. The Radio Frequency Management Department has legal personality, its own seal and separate account according to the law, with headquarters in Hanoi and subordinate units located in localities.
Article 6. This Decision takes effect from the date of signature. All previous provisions contrary to this Decision are abolished.
Article 7. The Office Director, Organization and Cadres Department Director, Radio Frequency Management Department Director, and Heads of agencies and units under the Ministry of Posts and Telecommunications are responsible for enforcing this Decision./.
