Guidelines for implementing certain policies and regulations for management officials, lecturers, and teachers in national defense education.

Pursuant to Article 17 of Decree No. 15/2001/NĐ-CP dated May 1, 2001 of the Government on national defense education, and Article 11 of Decree No. 165/2003/NĐ-CP dated December 22, 2003 of the Government on the assignment of officers from the Vietnam People's Army; following the opinion of the Ministry of Home Affairs in Circular No. 592/BNV-TL dated March 19, 2004, the Ministries of Education and Training, Finance, Defense, Labor, Invalids, and Social Affairs have agreed to issue guidelines for implementing certain policies and regulations for management officials, lecturers, and teachers in national defense education (hereinafter referred to as management officials and teachers in national defense education) as follows:
I. SCOPE AND APPLICABLE SUBJECTS
This Circular provides guidelines for implementing certain policies regarding lecture remuneration and teaching attire for management officials and teachers in national defense education. Teachers in national defense education include full-time and part-time teachers within the establishment, officers assigned from the military, and contractual teachers at secondary schools, vocational schools, colleges, universities, and student national defense education centers. Management officials in national defense education include full-time and part-time officials within the establishment or officers assigned from the military at Departments of Education and Training, Departments of Labor, Invalids, and Social Affairs, and student national defense education centers.
II. CERTAIN POLICIES ON LECTURE REMUNERATION AND TEACHING ATTIRE FOR MANAGEMENT OFFICIALS AND TEACHERS IN NATIONAL DEFENSE EDUCATION
In addition to the general policies already stipulated by the State for all officials and teachers, management officials and teachers in national defense education also enjoy preferential policies based on the specific nature of the subject.
The preferential policies for management officials and teachers in national defense education specified below do not overlap with existing allowances included in their salary system.
1. Lecture Remuneration Policy:
Full-time and part-time teachers in national defense education at secondary schools, vocational schools, colleges, universities, and student national defense education centers shall be entitled to a remuneration of 1% of the minimum wage per lecture hour.
The lecture hours mentioned above refer to actual teaching hours as prescribed in the national defense education curriculum, without requiring conversion when calculating remuneration.
2. Teaching Attire Policy:
To ensure uniformity in teaching the national defense education subject and meet practical requirements, management officials and teachers in national defense education shall be provided with synchronized attire in the style of military uniforms.
Full-time teachers in national defense education at secondary schools, vocational schools, colleges, and universities shall be issued two sets of attire annually.
Management officials in national defense education at Departments of Education and Training, Departments of Labor, Invalids, and Social Affairs, and student national defense education centers; and part-time teachers in national defense education at secondary schools, vocational schools, colleges, and universities shall be issued one set of attire annually.
A set of attire in the style of military uniforms includes: long pants, long-sleeved shirt, belt, soft cap (or hard cap), leather shoes. It may be adapted to spring/summer, autumn/winter, or field training attire according to the value of the benefits received.
The attire for officials and teachers who are officers assigned from the military shall be provided by the Ministry of National Defense according to the military uniform regulations of the Vietnam People's Army.
3. Invited lecturers and speakers are not eligible for the policies mentioned above.
III. CERTAIN RIGHTS AND BENEFITS FOR OFFICIALS AND TEACHERS WHO ARE OFFICERS ASSIGNED FROM THE MILITARY
1. Overtime Pay:
Officers assigned from the military performing teaching duties at universities, colleges, and student national defense education centers shall be entitled to overtime pay as other university teachers, as stipulated in Joint Circular No. 17/TT-LB dated July 27, 1995 of the Ministries of Labor, Invalids, and Social Affairs, Finance, and Education and Training: guiding the payment of overtime pay and allowances for combined classes in the education sector; they shall also be entitled to the lecture remuneration policy outlined in Section II.1 of this Circular.
The salary of officers assigned from the military shall be guaranteed by the unit assigning them. The unit assigning the officer has the responsibility to provide the officer's salary list, including rank pay and leadership position allowance (if applicable), for the using unit to calculate overtime pay.
2. Other Rights and Benefits:
Educational institutions and units utilizing officers assigned from the military must ensure working conditions, equipment, housing, travel expenses, and welfare benefits for officials and teachers who are officers assigned from the military, equivalent to those of officials and teachers at the same level.
Officials and teachers who are officers assigned from the military shall be selected for study and training, provided with information, and allowed to participate in educational and training activities, and be considered for commendation and disciplinary actions like civil servants and employees of the educational institution or unit utilizing the officer.
IV. SOURCE OF FUNDS
The funds for implementing policies and regulations for management officials and teachers in national defense education shall be allocated from the annual budget and revenue of educational institutions.
The management and utilization of these funds shall be carried out in accordance with current financial management regulations.
V. EFFECTIVE DATE
This Circular shall take effect fifteen days after its publication in the Official Gazette. Any issues encountered during implementation should be promptly reported to the Ministries of Education and Training, Finance, Defense, and Labor, Invalids, and Social Affairs for timely resolution./.
