JOINT CIRCULAR

Guidelines for implementing certain benefits and policies for management staff,

lecturers, and teachers of national defense education

Implementing Article 17 of Decree No. 15/2001/NĐ-CP dated May 1, 2001 of the Government on national defense education, and Article 11 of Decree No. 165/2003/NĐ-CP dated December 22, 2003 of the Government on the assignment of officers from the Vietnam People's Army;

After receiving the opinion of the Ministry of Home Affairs in Circular No. 592/BNV-TL dated March 19, 2004, the joint ministries of Education and Training, Finance, National Defense, Labor, War Invalids, and Social Affairs have agreed to provide guidelines for implementing certain benefits and policies for management staff, lecturers, and teachers of national defense education (hereinafter referred to as management and national defense education teachers).

I. SCOPE AND APPLICABLE SUBJECTS

This circular provides guidelines for implementing certain benefits regarding lecture remuneration and teaching uniforms for management staff and national defense education teachers. Full-time or part-time national defense education teachers include teachers within the establishment, officers assigned from the military, and contractual teachers at secondary schools, vocational schools, colleges, universities, and student national defense education centers; management staff includes full-time or part-time personnel within the establishment or officers assigned from the military at Departments of Education and Training, Departments of Labor, War Invalids, and Social Affairs, and student national defense education centers.

II. CERTAIN BENEFITS REGARDING LECTURE REMUNERATION AND TEACHING UNIFORMS FOR MANAGEMENT STAFF AND NATIONAL DEFENSE EDUCATION TEACHERS

In addition to the benefits already provided by the State for general staff and teachers, management staff and national defense education teachers also enjoy preferential benefits based on the specific nature of the subject.

The preferential benefits for management staff and national defense education teachers specified below do not overlap with existing allowances in their salary system.

1. Lecture remuneration:

Full-time or part-time national defense education teachers at secondary schools, vocational schools, colleges, universities, and student national defense education centers shall receive a 1% supplement of the minimum wage per lecture hour.

The lecture hours mentioned above refer to actual teaching hours stipulated in the national defense education curriculum, without requiring conversion when calculating the supplement.

2. Uniforms:

To ensure uniformity in teaching the national defense education subject and meet practical requirements, management staff and national defense education teachers shall be provided with synchronized uniforms in the style of military uniforms.

Full-time national defense education teachers at secondary schools, vocational schools, colleges, and universities shall be provided with two sets of uniforms annually.

Management staff at Departments of Education and Training, Departments of Labor, War Invalids, and Social Affairs, and student national defense education centers; part-time national defense education teachers at secondary schools, vocational schools, colleges, and universities shall be provided with one set of uniforms annually.

A set of uniforms in the style of military uniforms includes: long pants, long-sleeved shirt, belt, soft hat (or hard hat), leather shoes. These can be adapted to spring-summer uniforms, autumn-winter uniforms, or field uniforms according to the value of the benefits received.

The uniforms for officers assigned as teachers shall be provided by the Ministry of National Defense according to the military uniform regulations of the Vietnam People's Army.

3. Invited lecturers and speakers are not included in the scope of the benefits mentioned above.

III. CERTAIN RIGHTS AND PRIVILEGES FOR MANAGEMENT STAFF AND TEACHERS WHO ARE ASSIGNED OFFICERS

1. Overtime pay:

Officers assigned to teach at universities, colleges, and student national defense education centers shall receive overtime pay as other university teachers, as stipulated in Joint Circular No. 17/TT-LB dated July 27, 1995 of the Ministries of Labor, War Invalids, and Social Affairs, Finance, and Education and Training: guiding the payment of overtime pay and class combination allowances in the education and training sector; they shall also receive the lecture remuneration as specified in Section II.1 of this circular.

The salary of assigned officers shall be guaranteed by the unit assigning the officer. The unit assigning the officer has the responsibility to provide the salary table of the assigned officer, including rank salary and leadership position allowance (if applicable), for the unit using the assigned officer to calculate overtime pay.

2. Other rights and privileges:

Educational institutions and units using assigned officers shall ensure working conditions, facilities, housing, travel expenses, welfare benefits for management staff and teachers who are assigned officers, equivalent to those of other staff and teachers at the same level.

Management staff and teachers who are assigned officers shall be selected for study and training, provided with information, and allowed to participate in educational and training activities, and be eligible for commendation and disciplinary actions like civil servants and employees of the school or unit using the assigned officers.

IV. SOURCE OF FUNDS

The funds for paying benefits and policies for management staff and national defense education teachers shall be allocated from the annual budget and revenue of educational and training institutions.

The management and use of these funds shall be carried out according to the current financial management regulations.

V. EFFECTIVE DATE

This circular shall take effect 15 days after its publication in the Official Gazette. Any issues arising during implementation should be promptly reported to the joint ministries of Education and Training, Finance, National Defense, Labor, War Invalids, and Social Affairs for research and resolution./.
