CIRCULAR
Guidelines for some Articles of Decree No. 10/2005/NĐ-CP dated January 31, 2005 of the Government on Traditional Flags, Service Flags, Symbols, Customs Service Flags, Badges, Rank Insignia, Uniforms, and Customs Officer Identity Cards.
Implementing Decree No. 10/2005/NĐ-CP dated January 31, 2005 of the Government on Traditional Flags, Service Flags, Symbols, Customs Service Flags, Badges, Rank Insignia, Uniforms, and Customs Officer Identity Cards (hereinafter referred to as the Decree on Customs Uniforms), the Ministry of Finance hereby provides guidance as follows:

Implementing Decree No. 10/2005/NĐ-CP dated January 31, 2005 of the Government on Traditional Flag, flag, symbol, customs flag, badge, rank insignia, uniform, customs identification card (hereinafter referred to as the Decree on Customs Uniform), the Ministry of Finance guides implementation as follows:
I. APPLICABLE OBJECTS:
1. Civil Servants, Public Officials, and Employees (hereinafter collectively referred to as civil servants) currently working in the Customs sector.
2. For those working under labor contracts in the Customs sector pursuant to Decree No. 68/2000/NĐ-CP dated November 17, 2000 of the Government, they shall be entitled to the issuance and use of certain types of uniforms as specified in Section 3, Part II of this Circular.
II. PROVISIONS ON CUSTOMS UNIFORM STANDARDS:
1. General uniform standards for Customs civil servants (for each civil servant), include:
a) Spring-Summer Suit: 01 set/year (first year, 02 sets)
- Male: 01 short-sleeved shirt, 01 pair of pants;
- Female: 01 short-sleeved shirt, 01 pair of pants, 01 skirt
b) Autumn-Winter Suit: 2 years/set (first year, 02 sets)
c) Formal Wear: 5 years/set
d) White Shirt for Formal Wear and Autumn-Winter: 1 year/shirt (first year, 02 shirts)
đ) Cap, Soft Hat: 2 years/hat
e) Formal Wear Cap: 5 years/hat
f) Tie: 2 years/tie
g) Leather Shoes, Cloth Shoes: 2 years/pair
h) White Gloves: 03 years/supply (used during solemn ceremonies)
- For units with a staff of 300 or more, 50 pairs will be supplied each time.
- For other units, 30 pairs will be supplied each time.
i) Raincoat: 3 years/coat or 1 set
j) Socks: 1 year/2 pairs
k) Belt: 2 years/belt
l) Badge, Rank Insignia, Customs Flag: Replace when damaged
m) Wool Coat: 4 years/coat
p) Sweater: 3 years/sweater
2. Additional uniform standards for Customs civil servants engaged in special tasks:
2.1. For civil servants regularly working at border crossings, islands, and anti-smuggling control on the sea where cold weather affects them, in addition to the Customs uniform standards stipulated in point 1 above, they will also be provided with:
a) Blanket: 4 years/blanket.
b) Wool Hat: 3 years/hat.
c) Mattress: 4 years/mattress.
d) Snow Boots: 3 years/pair
đ) Wool Gloves: 02 years/pair
2.2. For Customs civil servants regularly performing duties such as inspecting imported and exported goods, checking transportation vehicles entering and exiting the country, guiding service dogs, operating and repairing ships, working in laboratories (belonging to the Center for Export and Import Goods Analysis and Classification)... in addition to the Customs uniform standards stipulated in point 1 above, they will also be provided with:
a) Protective Workwear: 1 year/set.
b) Protective Gloves: 1 year/pair.
c) Protective Helmet: 2 years/helmet.
d) Gilè (a type of jacket specified by the General Department of Customs): 2 years/jacket
đ) Blue White Lab Coat: 2 years/coat.
3. Uniform standards for personnel working under labor contracts as prescribed by Decree No. 68/2000/NĐ-CP: (for each person):
Personnel working in the Customs sector under labor contracts as prescribed by Decree No. 68/2000/NĐ-CP such as security guards, drivers, service staff, IT technicians, technical staff on anti-smuggling patrol boats... will be provided with spring-summer, autumn-winter, and formal wear uniforms (different from Customs uniforms) according to annual standards similar to those for Customs civil servants. The style of uniforms and their management and use shall be specifically regulated by the Director-General of the General Department of Customs.
III. SYSTEM OF MAKING, ISSUING, USING, AND MANAGING CUSTOMS UNIFORMS:
1. Funding for making Customs uniforms:
Fabric and materials used to make Customs uniforms must ensure quality, durability, and aesthetics, with specific standards forecasted by the General Department of Customs and approved annually by the Ministry of Finance. In cases where domestic fabric and materials are not available, reports should be made to the Ministry for procurement from other sources.
Funding for making Customs uniforms shall be guaranteed by the Director-General of the General Department of Customs within the allocated budget of the General Department of Customs.
2. Organization of making and issuing uniforms:
a) The General Department of Customs is responsible for:
- Organizing the making, managing, and issuing: Traditional Customs flags, service flags, symbols, customs service flags, rank insignia, badges, formal wear uniforms, kepi caps, soft hats, wool hats, raincoats, belts, ties, shoes, and other uniforms with a limited lifespan for units within the Customs sector.
- Organizing the making, managing, and issuing of Customs uniforms for civil servants and personnel working under labor contracts as prescribed by Decree No. 68/2000/NĐ-CP who work at units under the General Department of Customs.
b) The Director of Provincial/City Customs Departments and the Principal of the Customs College are responsible for organizing the making of Customs uniforms for civil servants and personnel working under labor contracts as prescribed by Decree No. 68/2000/NĐ-CP within their own units according to the specified model.
c) Time for issuing Customs uniforms annually: One issuance per year, in April.
3. Method of using Customs uniforms:
The Director-General of the General Department of Customs is responsible for providing detailed guidance on the method of using Customs uniforms.
IV. Provisions on Issuing and Using Customs Officer Identity Cards:
1. Issuing and using Customs Officer Identity Cards:
The Director-General of the General Department of Customs shall organize the issuance of Customs Officer Identity Cards to Customs civil servants according to the specified model; provide guidance on the use and management of Customs Officer Identity Cards.
2. Usage of Customs Officer Identity Cards:
a) Customs civil servants may use their Customs Officer Identity Card while performing their duties in accordance with their assigned functions, responsibilities, and authorities as stipulated by law. The Customs Officer Identity Card does not replace a letter of introduction.
b) Strictly prohibit the forgery, alteration, tampering, lending, or borrowing of Customs Officer Identity Cards.
V. IMPLEMENTATION:
1. This Circular shall take effect fifteen days after its publication in the Official Gazette.
Abolish Circular No. 06/2001/TT-TCHQ dated September 18, 2001 of the Director-General of the General Department of Customs guiding some Articles in Decree No. 18/2000/NĐ-CP dated May 29, 2000 of the Government.
2. The Director-General of the General Department of Customs is responsible for directing, guiding, and supervising the implementation of the Government's Decree on Customs Uniforms and this Circular./.
