Pursuant to the Quality of Goods Ordinance No. 18/1999/PL-UBTVQH10 dated December 24, 1999 of the Standing Committee of the National Assembly;
Pursuant to the Government Decree No. 179/2004/NĐ-CP dated October 21, 2004 on state management of goods quality;
Pursuant to the Government Decree No. 49/2003/NĐ-CP dated May 15, 2003 on the functions, tasks, powers, and organizational structure of the Ministry of Health;
Considering the proposal of the Director of the Vietnam Drug Administration Bureau,
DECISION:
Article 1. The implementation time for the Cosmetic Management Regulation is adjusted as follows:
1. Cosmetics specified in Appendix 1: List of cosmetic products required to register quality with the Ministry of Health issued together with Decision No. 35/2006/QĐ-BYT dated November 10, 2006 of the Minister of Health on the issuance of the Cosmetic Management Regulation, under Clauses 5, 6, 7 (excluding shampoo products), 8, 9, 10 (excluding hair dye products and hair cleansing products), 11, 14, 15, and 16 produced domestically or imported into Vietnam before April 1, 2007 shall continue to be circulated until the expiration date of the product. As of April 1, 2007, cosmetics listed above when imported into Vietnam (for foreign cosmetics) must have circulation registration numbers, and domestic cosmetics must conduct standard quality announcements.
2. Cosmetics specified in Appendix 1: List of cosmetic products required to register quality with the Ministry of Health issued together with Decision No. 35/2006/QĐ-BYT dated November 10, 2006 of the Minister of Health on the issuance of the Cosmetic Management Regulation, under Clauses 1, 2, 3, 4, 7 (shampoo products), 10 (hair dye products and hair cleansing products), 12, 13, 17, 18, 19, and 20 shall implement circulation registration or standard quality announcements from the effective date of the regulation.
Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 3. The Heads of the Office, Inspector General of the Ministry of Health, Director of the Vietnam Drug Administration Bureau, Heads of units directly under the Ministry, Directors of Provincial Health Departments, and Heads of health sector units under central cities are responsible for implementing this Decision.
