Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Pursuant to Decree No. 100/2006/NĐ-CP dated September 21, 2006 of the Government detailing and guiding the implementation of certain provisions of the Civil Code and the Law on Intellectual Property regarding copyright and related rights;

Considering the proposal of the Director of the Copyright Office and the Head of the Cadre and Civil Servant Affairs Department,

DECISION:

Article 1. Position and Functions

The Copyright Office is an agency under the Ministry of Culture, Sports and Tourism with the function of advising the Minister to implement state management over the protection of copyright and related rights throughout the country in accordance with the Party's guidelines and State laws. The Copyright Office has its own seal and an account at the National Treasury.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Draft normative legal documents, strategies, mechanisms, policies, and plans for the protection of copyright and related rights; draft international treaties and commitments concerning copyright and related rights and organize their implementation after approval by competent authorities.

2. Draft regulations on the provision, cooperation, commissioning, and guarantee of copyright for works and related rights for performances, sound recordings, audiovisual recordings, and broadcasting programs and organize their implementation after approval.

3. Implement measures to protect the legitimate rights and interests of the State, organizations, and individuals regarding copyright and related rights.

4. Manage copyright for literary, artistic, and scientific works and related rights for performances, sound recordings, audiovisual recordings, and broadcasting programs belonging to the State as prescribed by law.

5. Establish and manage the administrative apparatus for copyright and related rights; organize training for cadres on copyright and related rights.

6. Guide business practices for the protection of copyright and related rights for civil servants and employees of Provincial Departments of Culture, Sports and Tourism, sectors, localities, enterprises, and social organizations.

7. Guide the implementation of remuneration systems for copyright and related rights for authors and owners of literary and artistic works.

8. Manage the specialized activities of collective bodies representing copyright and related rights; manage the appraisal activities of copyright and related rights according to the provisions of law.

9. Issue, reissue, replace, and revoke Certificates of Copyright Registration and Certificates of Related Rights Registration.

10. Organize and coordinate educational, propaganda, and dissemination activities of legal knowledge, mechanisms, and policies on copyright and related rights.

11. Organize information, statistics, national registration books, and publication of bulletins on copyright and related rights.

12. Resolve complaints and denunciations regarding copyright and related rights according to the provisions of law.

13. Propose rewards for organizations and individuals who have made achievements in protecting copyright and related rights.

14. Implement international cooperation on copyright and related rights according to the decision of the Minister.

15. Assist the Minister in coordinating with the Ministry of Science and Technology to develop general policies and laws on the protection of intellectual property rights, compile general information on intellectual property rights, implement joint international cooperation projects on intellectual property rights, and other related common tasks.

16. Implement administrative reform contents according to the program and plan of the Ministry.

17. Manage the organizational structure, staffing, and implement policies and systems for cadres, civil servants, public officials, and workers within the scope of management of the Copyright Office; manage and utilize financial resources, assets, and other assigned resources according to the provisions of law and the delegation of the Minister.

18. Perform other tasks assigned by the Minister.

Article 3. Organizational Structure

1. Director and Deputy Directors.

2. Specialized and professional departments:

a) Office;

b) Department of Copyright;

c) Department of Related Rights;

d) Department of Copyright Information.

3. Affiliated research institutions:

Copyright and Market Magazine. The Director of the Copyright Office shall be responsible for specifying the specific functions, tasks, and powers of the departments and affiliated research institutions; arranging and deploying cadres, civil servants, public officials, and workers according to the correct structure, job standards; establishing and promulgating the Regulations on the organization and operation of the Copyright Office.

Article 4. Effective date

This Decision takes effect 15 days from the date of publication in the Official Gazette and replaces Decision No. 09/2007/QĐ-BVHTT dated May 3, 2007 of the Minister of Culture, Sports and Tourism stipulating the functions, tasks, powers, and organizational structure of the Literary and Artistic Copyright Office.

Article 5. Responsibilities for Implementation

The Director of the Copyright Office, the Director of the General Office, the Heads of the Cadre and Civil Servant Affairs Department, the Planning and Finance Department, and the Heads of agencies and units under the Ministry and relevant organizations and individuals are responsible for implementing this Decision.
