Amending and supplementing certain provisions of the Examination Regulations for National Excellent Student Selection issued together with

Considering the proposal of the Director of the Department of Testing and Quality Assurance in Education,
The Minister of Education and Training issues this Circular amending and supplementing certain articles of the Regulations on the National Student Excellence Selection Examination issued together with Circular No. 56/2011/TT-BGDĐT dated November 25, 2011 of the Minister of Education and Training.
Article 1. Amending and supplementing certain articles of the Regulations on the National Student Excellence Selection Examination issued together with Circular No. 56/2011/TT-BGDĐT dated November 25, 2011 of the Minister of Education and Training, as follows:
1. Clause 2 of Article 4 shall be amended and supplemented as follows:
"2. The examination for selecting the national team for the International Olympiad: candidates must be high school students and fall under one of the following categories:
a) Selected by the Ministry of Education and Training from among students who won awards in the National Student Excellence Selection Examination in the same year according to the principle of selecting from highest to lowest scores, ensuring that the number of students selected for each subject does not exceed eight times the number required for the national team to participate in the International Olympiad in that subject;
b) Did not participate in the National Student Excellence Selection Examination in the same year but participated in training to prepare for the regional and international Olympiads in the previous year."
a) The record shall be printed on A5 size paper, consisting of 34 pages (including covers);
"2. The examination for selecting the national team for the International Olympiad: The Ministry of Education and Training shall implement the selection and summoning of candidates to participate in the examination, ensuring compliance with all requirements stipulated in Clause 2 of Article 4 and Clause 2 of Article 16 of these Regulations."
3. Clause 2 of Article 16 is amended and supplemented as follows:
"2. The examination for selecting the national team for the International Olympiad: The number of candidates participating in each subject shall be determined annually by the Ministry of Education and Training, ensuring compliance with all requirements stipulated in Clause 2 of Article 4 of these Regulations."
4. Article 26 shall be amended and supplemented as follows:
"Article 26. Provisions regarding materials and items allowed to be brought into the examination room
1. Candidates are permitted to bring into the examination room materials and items related to answering the examination questions:
a) Writing pens, rulers, black pencils, erasers, set squares, graph paper rulers, drawing tools;
b) Handheld calculators without word processing functions and without memory cards; for Mathematics subjects, candidates are not allowed to bring calculators into the examination room;
c) Periodic Table of Elements and Solubility Table for Chemistry subjects, Vietnam Geography Atlas for Geography subjects; no additional markings or writings are allowed in these materials.2. Bringing materials and items into practical examination rooms for Physics, Chemistry, Biology subjects and oral examination rooms for Foreign Language subjects shall be carried out in accordance with the annual examination organization guidelines issued by the Ministry of Education and Training."
5. Point b of Clause 4 of Article 32 is amended and supplemented as follows:
"b) Members of the examination marking committee for the National Student Excellence Selection Examination shall not participate in the appeal review committee."
6. Article 34 is amended and supplemented as follows:
"Article 34. Selecting students for national teams for the Olympics
1. After completing the scoring of the examinations for the National Student Excellence Selection Examination, rank the examination numbers according to the scores from highest to lowest to select candidates for training to prepare for participation in the regional and international Olympiads, ensuring that the number of candidates selected does not exceed 1.5 times the number of candidates in the national team for each subject.
2. The Chairperson of the examination marking committees for the National Student Excellence Selection Examination is responsible for submitting to the Minister of Education and Training for approval the list of candidates (by examination number) selected for training to prepare for participation in the regional and international Olympiads.
3. The Director of the Department of Testing and Quality Assurance in Education is responsible for organizing training for the selected candidates preparing for participation in the Olympiads and, based on the results of the training, submitting to the Minister of Education and Training for approval the official list of national teams for participation in the regional and international Olympiads."
7. Supplement Clause 5 to Article 36, as follows:
"5. Students participating in training organized by the Ministry of Education and Training to prepare for participation in the regional and international Olympiads shall be directly admitted to universities according to their registered preferences."
8. Supplement Article 39a after Article 39, as follows:
"Article 39a. Handling information reflecting negative practices during the examination
1. Providing information and evidence of examination regulation violations:
a) Encouraging candidates, examination staff, and the general public to identify and report violations of examination regulations;
b) Individuals discovering violations of examination regulations should promptly notify and provide evidence to the designated receiving body as stipulated in Clause 2 of this Article for appropriate handling;
c) Individuals providing information and evidence of examination regulation violations must bear legal responsibility for the authenticity of the provided information and evidence, and may not abuse the provision of information to negatively impact the examination.
2. Receiving bodies for information and evidence of examination regulation violations:
a) The National Student Excellence Selection Examination Steering Committee of the Ministry of Education and Training;
b) The Inspectorate of the Ministry of Education and Training.
3. Verified evidence of examination regulation violations serves as the basis for handling violators.
4. For organizations and individuals receiving information and evidence of examination regulation violations:
a) Organize the receipt of information and evidence in accordance with regulations; protect the original state of evidence; verify the authenticity of the provided information and evidence.
b) Promptly implement measures to prevent negative practices and violations of examination regulations based on the provided information.
c) Handle within authority or report to competent authorities for handling and publicly announce the results of handling individuals and organizations with violations of examination regulations.d) Protect the confidentiality of the identity of the information provider."
9. Point a of Clause 2 of Article 40 is amended and supplemented as follows:
"2. For candidates:"
a) Candidates who bring examination materials, items related to the examination as prescribed in Article 26 of this Regulation, weapons, explosives, flammable substances, beer, alcohol, communication devices, or information-containing devices that could be exploited for cheating during the examination process and the grading process into the examination room, whether used or not, shall be disqualified from the examination.
Article 2. This Circular takes effect from January 4, 2013.
Article 3. The Director of the Office, the Director of the Department of Examinations and Quality Assurance in Education, the Heads of relevant units under the Ministry of Education and Training; the Chairpersons of the People's Committees of provinces and centrally-run cities; the Directors of Departments of Education and Training; the Rectors of Hanoi National University; the Rectors of Ho Chi Minh City National University; the Principals of specialized high schools within universities and the Principals of boarding secondary schools for ethnic minorities under the Ministry of Education and Training are responsible for implementing this Circular.
