Circular No. 41/2018/TT-BYT promulgates National Technical Regulations and provisions on quality control and supervision of clean water for domestic purposes.

Article 1. Issuing Technical Standards

Attached to this Circular are the National Technical Regulations on the quality of clean water for domestic purposesđổdated May 2013;|||For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.gfor daily use;

Article 2. Provisions on inspection and supervision of the quality of clean water used for domestic purposes

1. The results of testing the parameters of clean water quality specified in Clause 2 and 3 of Article 5 of the Technical Standards issued with this Circular must be publicly disclosed by the water supply unit within three days from the date of receipt of the test resultsdevelopment on the electronic information page of the water supply unit (in case there is no electronic information page, the water supply unit must)n l post public notices at prominent locationsof the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsp water supply units (in cases where there is no electronic information page, the water supply unit must post public notices at prominent locations)đ) including the following contents:June 2024;a) The total number of water samples tested and the sampling locations., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPb) The specific parameters and test results of each water sample.inc) Measures and timeframes for rectifying non-compliant issues.

2. State agencies with competent authority shall inspect (external inspections) the implementation of regulations ensuring the quality of clean water by water supply units as follows:

a) Inspect the implementation of testing the parameters of clean water quality by water supply units as stipulated in Clause 2 and 3 of Article 5 of the Technical Standards issued with this Circular; monitoring and management records of clean water quality; public disclosure of clean water quality information as prescribed in Clause 1 of Article 2 of this Circular..

b) Collect samples and test the parameters of clean water quality as specified in Clause 2 and 3 of Article 5 of the Technical Standards issued with this Circular.No.c) Within five working days of conducting external inspections, the inspection agency shall notify in writing the inspected water supply unit; publish on its electronic information page; and inform the competent authority selecting the water supply unit and the supervising agency of the inspected water supply unit (if applicable) about the inspection results including the following information:

- Name of the inspected unit.shall- Inspection results of the contents prescribed in Clause 1 of Article 2 of this Circular.development3. External inspections of clean water quality

a) Each water supply unit must undergo external inspections once per year.tob) Unscheduled external inspections shall be conducted in the following situations:l* When there are concerns about the quality of finished water products through periodic quality reports,i unexpected incidents of water quality deterioration reported by the water supply unit.organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.periodi- When environmental accidents occur that may affect the quality of source water.ng- When inspection results or disease surveillance indicate a risk of water contamination.

- When there are complaints from organizations, individuals regarding water quality.No.- When there are special requirements from competent authorities.1. This Circular takes effect from June 15, 2019.2. Circular No. 50/2015/TT-BYT dated December 11, 2015 of the Minister of Health on the inspection of hygiene and quality of drinking water and domestic water use becomes invalid from the date this Circular takes effect.

3. Circular No. 04/2009/TT-BYT dated June 17, 2009 of the Minister of Health on issuing the National Technical Regulations on the quality of drinking water (QCVN 01:2009/BYT); Circular No. 05/2009/TT-BYT dated June 17, 2009 of the Minister of Health on issuing the National Technical Regulations on the quality of domestic water (QCVN 02:2009/BYT) continue to be effective for application to the subjects specified in Clause 2 of Article 4 of this Circular until June 30, 2021 when local technical standards on the quality of clean water for domestic use are issued and take effect.gtoy kdevelopment on the electronic information page of the water supply unit (in case there is no electronic information page, the water supply unit must)n lFor provinces and centrally administered cities that have not issued local technical standards on the quality of clean water for domestic use within the time limit specified in Clause 3 of Article 3 of this Circular, water supply units may apply one of the following two options:development1. Apply the National Technical Regulations on the quality of clean water for domestic use issued with this Circular but must test all parameters of clean water quality listed in Article 4 of the Standards.development2. Continue applying the National Technical Regulations on the quality of drinking water (QCVN 01:2009/BYT) and the National Technical Regulations on the quality of domestic water (QCVN 02:2009/BYT) until June 30, 2021.logo. The Department of Environmental Health - Ministry of Health shall be responsible for disseminating, guiding, and supervising the implementation of this Circular nationwide.2. Provincial People's Committees and centrally administered city people's committees shall be responsible for:a) Organizing and supervising the implementation of this Circular in their respective localities.đb) Issuing local technical standards on the quality of clean water for domestic use to ensure they are effective before July 1, 2021.2013 of the Government detailing and guiding the implementation of the Price Law;3. Specialized Institutes under the Ministry of Health shall be responsible for:

a) Compiling, analyzing, and reporting on the situation of clean water quality in the provinces under their jurisdiction and planning training programs, providing technical support to localities in implementing the Standards.

b) Conducting external inspections of clean water quality upon request of the Ministry of Health; reporting the results of external inspections according to Model 01 attached to this Circular.

c) Providing technical assistance to provinces and centrally administered cities under their jurisdiction in developing local technical standards on clean water quality.ầd) Reporting in writing every six months and annually to the Department of Environmental Health within fifteen days from the end of June and December respectively; reporting according to Model 02 attached to this Circular.of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairs4. Departments of Health of provinces and centrally administered cities shall be responsible for:

a) Taking the lead and coordinating with relevant units to implement this Circular in their jurisdictions.of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsb) Directing subordinate units to implement dissemination and training activities.đshall be subject to unscheduled inspectionby the Prime Minister 01/annuallyamendm shall be used.

b) Unscheduled inspections shall be carried out in the following cases:

* When there is suspicion abouti the quality of finished water based on periodic reports on water quality,of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsuations of water quality through monitoring,ìility of water through regular testing,đergency situations reported by the water supply unit.

- When environmental incidents occur that may affect the quality of water sources.

- When the results of water quality checks or changestr indicate a risk of water source pollution.ẽ- When there are complaints from agencies, organizations, or individuals regarding water quality.

- When there are special requirements from competent authorities.

1. This Circular takes effect from June 15, 2019.

Article 3. Effectiveness

2. Circular

 No. 50/2015/TT-BYT dated December 11, 2015 of the Minister of Health prescribing the inspection of hygiene and water quality for drinking and domestic purposesconcerning the classification and determination of state management authority in the field of crop production shall cease to be effectivepolicies from the date this Circular takes effect.No.3. Circular No. 04/2009/TT-BYT dated June 17, 2009 of the Minister of Health promulgating the National Technical Regulation on Drinking Water Quality (QCVN 01:2009/BYT); Circulardevelopment No. 05/2009/TT-BYT dated June 17, 2009 of the Minister of Health promulgating the National Technical Regulation on Domestic Water Quality (

CVN 02:2009/BYT) shall continue to be effective for application to the objects specified in Clause 2, Article 4 of this Circularỹ until June 30, 2021 when the Local Technical Regulations on Clean Water Quality for Domestic Purposes are issued and take effect.Pursuant to Decree No. 24/2018/NĐ-CP dated February 27, 2018 of the Government on handling complaints and reports in the fields of labor, vocational education, dispatching Vietnamese workers abroad under contracts, employment, occupational safety and health;For provinces and centrally governed cities that have not issued Local Technical Regulations on Clean Water Quality for Domestic Purposes within the time limit stipulated in Clause 3, Article 3 of this Circular, water supply units may apply one of the following two options:policies1. Apply the National Technical Regulation on Clean Water Quality for Domestic Purposes issued together with this Circular but must test all parameters of clean water quality listed in Article 4 of the Standard.ỹ2. Continue applying the National Technical Regulation on Drinking Water Quality (QCVN 0Article 24:2009/BYT), the National Technical Regulation on Domestic Water Quality (QCVN 02:2009/BYT) until June 30, 2021.. The Department of Environmental Health Inspection - Ministry of Health shall be responsible for disseminating, guiding, and supervising the implementation of this Circular throughout the country.2. Provincial People's Committees and Municipal People's Committees directly under the Central Government shall be responsible for:Nationala) Organizing and inspecting the implementation of this Circular at their localities.đb) Issuing Local Technical Regulations on Clean Water Quality for Domestic Purposes to ensure they are effective before July 1, 2021.ỹc) Allocating budgets and directing the work of inspecting and monitoring clean water quality either unexpectedly or annually; investing in upgrading laboratory equipment for the Provincial Center for Preventive Medicine/Disease Control Center to have the capacity to conduct tests according to the provisions of this Circular.organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.3. Specialized Institutes under the Ministry of Health shall be responsible for:organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.a) Summarizing, analyzing, and reporting the situation of clean water quality in the provinces under their jurisdiction and developing training plans and technical support for localities in implementing the Standards.tob) Conducting unscheduled inspections of clean water quality when requested by the Ministry of Health; reporting the results of unscheduled inspections according to Form No. 01 attached to this Circular.

Article 4. Transitional Provisions

For provinces and centrally governed cities that have not issued local technical standards on the quality of potable water for domestic purposes within the time limit specified in Clause 3, Article 3 of this Circular, water supply units may apply one of the following two cases:

1. Apply the national technical standard on the quality of potable water for domestic purposes issued together with this Circular but must test all parameters of potable water quality listed in Article 4 of this Circular.THE4. Departments of Health of provinces and centrally governed cities shall be responsible for:

a) Taking the lead and coordinating with relevant units to implement this Circular in their jurisdictions.yb) Directing subordinate units to implement the dissemination of information on the number of households not yet identified, reporting the results of unscheduled inspections according to Form No. 01 attached to this Circular.ỹb) Developing annual plans and budgets for organizing the implementation of activities related to water quality testing and submitting them for approval by the competent authority.amendc) Reporting in writing quarterly, every six months, and annually to the Provincial Disease Control Center within five days from the end of March, June, September, and December respectively; the content of the report according to Form No. 04 attached to this Circular.17. Water Supply Units shall be responsible for:

Article 5. Responsibilities for Implementation

1a) Implementing the provisions of this Circular.lb) Being accountable under the law for the quality of clean water supplied by their unit.policiesc) Storing and managing files tracking the quality of clean water:development- Local Technical Regulations on Clean Water Quality for Domestic Purposes issued by the People's Committee of the province or centrally governed city.

- Results of regular and unscheduled tests of raw water quality.shall- Results of regular and unscheduled tests of clean water quality parameters.

- Files on chemicals used in the production process of clean water.

- Records of water sample storage (each time a sample is taken, it should specify the quantity of the sample, location, volume, preservation method, sampling and storage time, person who took and stored the sample).rime Minister csive cỹ- Reports on measures to address incidents related to clean water quality.n l- Publicizing information on clean water quality.

- Documents proving the implementation of safe water supply plans as prescribed.developmentd) Being subject to audits, inspections, and supervision by state agencies with competent authority.of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsd) Submitting water quality parameter data for the development of Local Technical Regulations on Clean Water Quality for Domestic Purposes.âe) Reporting the results of clean water quality tests quarterly to the District Health Centers, Provincial Disease Control Centers according to Forms 05 and 06 attached to this Circular.đổ Submit the test results to the Preventive Health Center/Disease Control Center of the province (Disease Control Center of the province) to ensure the capability to conduct tests on potable water quality as stipulated in this Circular.

3. The specialized institutes under the Ministry of Health shall be responsible for:

a) Synthesizing, analyzing, and reporting on the quality status of clean water in the provinces within their jurisdiction and planning training programs, technical support for localities in implementing the Technical Regulations.ì Monitor the quality of potable water in the areas under their jurisdiction and provide technical guidance to localities in implementing the standards.shallb) Conducting external inspections of clean water quality when requested by the Ministry of Health; reporting the results of such inspections according to Form No. 01 attached to this Circular.ỹ conduct external inspections when requested by the Ministry of Health; report the results of external inspections according to Model 1

4. The People's Committees of the provinces and centrally governed cities shall be responsible for:|||oc hn la) Taking the lead and coordinating with relevant units to implement this Circular in their jurisdictions.standards4. Provinces and centrally governed cities shall be responsible for:This Resolution takes effect from the date it is adopted by the National Assembly.b) Directing subordinate units to implement the plan for inspecting clean water quality, including cases where the number of households cannot be determined, and reporting the results according to Form No. 01 attached to this Circular.developmentb) Direct subordinate units to implement the testing of potable water quality.FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSb) Preparing plans and budget estimates annually for organizing the implementation of activities to inspect clean water quality, submitting them for approval by the competent authority.

b) Develop plans and budget estimates for approval.inc) Submitting written reports quarterly, every six months, and annually to the Disease Control Centers within five days from the last day of March, June, September, and December; the content of the report according to Form No. 04 attached to this Circular.无效 within five days from the last day of March, June, September, and December.

d) Develop plans, ensure human resources,ipment and allocate budget (in the annual budget) for the implementation of inspection and supervision of clean water quality within the province, city; inspect and supervise the quality of self-extracted water by households in areas at risk of water source pollution; take measures to ensure public health.tuthdevelopmentuth

5. The Centers for Disease Control and Prevention have the responsibility:无效a) Conduct periodic and unscheduled inspections of the quality of clean water from all water supply units with a scale of 500 households or more (or design capacity of 1,000 cubic meters/day-night or more); report results of external inspections according to Form M

District Health Centers have the responsibility:No.a) Conduct periodic and unscheduled inspections of the quality of clean water from all water supply units with a scale below 500 households (or design capacity below 1,000 cubic meters/day-night); report results of external inspections according to Form Mdevelopmentt 01 of the annex issued together with this Circular.FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSrom 202No.b) Develop plans and budgets for the organization and implementation of activities related to the inspection of clean water quality annually and submit them for approval by competent authorities.

c) Report in writing quarterly, every six months, and annually to the Centers for Disease Control and Prevention of the province within five days from the end of March, June, September, and December respectively; the content of the reports follows Form Myt 04 of the annex issued together with this Circular.by the Prime Minister7. Water Supply Units have the responsibility:a) Implement the provisions of this Circular.³/energytoIn which, the adjustment rate for the monthly income already contributed to social insurance for the corresponding year shall be implemented according to Table 2 below: Table 2:đb) Be responsible under the law for the quality of clean water supplied by the unit.Pursuant to Decision No. 668/QĐ-TTg dated May 16, 2017 of the Prime Minister approving the Plan to implement the recommendations of the United Nations Commission on the Elimination of All Forms of Discrimination Against Women;c) Maintain and manage records tracking the quality of clean water:- Local technical standards on the quality of clean water for domestic use issued by the People's Committee of the province, city directly under the Central Government.- Results of regular and unscheduled tests of raw water quality.

- Results of regular and unscheduled tests of clean water quality parameters.amend- Records of chemicals used in the production process of clean water.

d) Be subject to inspection, supervision, and monitoring by state agencies with authority.đd) Issue technical standards for the quality of clean water for domestic use.n le) Report the results of clean water quality testing quarterly to the district health center, Centers for Disease Control and Prevention of the province according to Forms Mt 05, M³t 06 of the annex issued together with this Circular.8. d) Be subject to inspection, supervision, and monitoring by competent state agencies.n lDuring the implementation process, if there are difficulties or issues, they are advised to reflect these to the Ministry of Health for consideration and resolution./.by the Prime Minister on potable water quality.
