CIRCULAR

Regulations on code numbers, occupational standardsand salary grading for civil servants in the maritime project management specialty

pursuant to the Civil Servants Law dated November 15, 2010; the Law Amending and Supplementing Certain Provisions of the Civil Servants Law and the Civil Servants Law dated November 25, 2019;

 

On the basis of Decision No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants;

Pursuant to Decree No.based on Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for civil servants, public officials, and military personnel; Decree No. 17/2013/NĐ-CP dated February 1, 2013 andDecree No. 117/2016/NĐ-CP dated July 21, 2016 of the Government amending and supplementing certain provisions of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for civil servants, public officials, and military personnel;

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 3. General standards for professional ethics

2. Be honest, objective, and highly responsible for assigned tasks; fulfill all obligations of a civil servant in professional activities.

Article 4. Maritime Project Management Level I - Code Number: V.12.41.01

Chapter II

a) Lead the implementation of tasks assigned to the project owner and supervise the project execution process according to regulations;b) Lead the research and development of topics, plans, quality targets, economic and technical norms to innovate and improve project management mechanisms, enhancing efficiency and effectiveness;

c) Lead the compilation and development of specialized guidance materials on maritime project management;

1. Duties:

d) Lead training sessions, seminars, and professional skill enhancement within the scope of assigned tasks;

đ) Lead the implementation of professional tasks and functions of the unit according to legal regulations;

e) Participate in drafting and implementing legal documents related to maritime project management;

b) Hold a certificate in professional development meeting the occupational standards for civil servants in the maritime project management specialty.

a) Understand Party guidelines, State policies, and laws; possess knowledge in maritime industry management, strategy, planning, and development;

b) Understand administrative state management systems; maritime investment construction project management;

g) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

c) Be familiar with domestic and international legal regulations concerning maritime project management; understand the functions and responsibilities of the unit;

3. Qualifications regarding professional expertise and skills:

d) Have analytical and synthesis skills to propose methods to improve or resolve practical issues within the assigned sector or field;

đ) Possess in-depth knowledge and experience in maritime project management activities;

e) Have organizational skills to address practical issues, propose solutions, or participate in developing strategies, policies, and plans for maritime project management development; apply scientific and technological advancements to improve work quality and efficiency in the assigned sector or field;

g) Have basic information technology skills and proficiency in foreign languages or ethnic minority languages if working in areas inhabited by ethnic minorities as required by job position.

Article 4. Criteria and Conditions for Registering to Take Examinations or Being Promoted to the Maritime Project Management Level I Position: Civil servants can register to take examinations or be promoted to the Maritime Project Management Level I position when they meet the criteria and conditions stipulated in Article 32 of Decision No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants, and the following criteria and conditions:

a) Have held the Maritime Project Management Level II position or equivalent for at least six years. In cases where the equivalent period is shorter, there must be at least one year (twelve months) holding the Maritime Project Management Level II position up to the deadline for submitting examination registration or promotion application forms;

b) During the time holding the Maritime Project Management Level II position or equivalent, achieve at least one of the following criteria or conditions:

Lead the development of one topic, plan, project, or program at the ministry or provincial level that has been issued or approved by the competent authority;

Lead the development of two topics, plans, projects, or programs at the organizational level that have been issued or approved by the competent authority;

Serve as the project manager for one Group A project or two Group B projects of the same type;

Lead the design, review, or verification of two Class I projects or three Class II projects.

Take the lead in developing two topics, projects, programs in science and technology at the institutional level that have been issued or accepted by competent authorities for the agency entrusted to conduct research and development;

Has served as project director for one Class A project or two Class B projects of the same type;

Has taken the lead in designing or reviewing or examining the design of two Class I projects or three Class II projects;

Has been in charge of or participated in managing one project of Group A or two projects of Group B or one Class I construction project or two Class II construction projects in terms of investment cost management;

Has participated in managing one project of Group A or two similar projects of Group B and holds one of the four professional certificates: Project Management Class I, Construction Design Class I, Construction Supervision Class I, or Construction Valuation Class I.

Article 5. Maritime Project Management Class II - Code: V.12.41.02

1. Duties:

a) To be in charge of or participate in performing the tasks of the investor and supervise the implementation process of the project according to regulations;

b) To be in charge of or participate in researching, building topics, programs, quality objectives, economic and technical norms aimed at innovating and perfecting management mechanisms, enhancing the effectiveness of project management activities;

c) To be in charge of or participate in compiling and building professional guidance materials on maritime project management;

d) To be in charge of or participate in organizing training sessions, specialized seminars, vocational training, disseminating knowledge and experience within the scope of assigned tasks;

đ) To be in charge of or participate in organizing the implementation of professional tasks under the functions and responsibilities of the unit in accordance with the provisions of the law;

b) Understand administrative state management systems; maritime investment construction project management;

g) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

c) Be familiar with domestic and international legal regulations concerning maritime project management; understand the functions and responsibilities of the unit;

3. Qualifications regarding professional expertise and skills:

a) Proficient in the Party's guidelines and policies, State policies and laws; knowledge of industry management, strategy, planning, and maritime sector development;

b) Proficient in the system of administrative state management knowledge; project management in the maritime construction sector;

e) Have organizational skills to address practical issues, propose solutions, or participate in developing strategies, policies, and plans for maritime project management development; apply scientific and technological advancements to improve work quality and efficiency in the assigned sector or field;

d) Possess knowledge and experience in maritime project management activities;

đ) Possess organizational implementation capabilities, practical summarization, and proposal of solutions or participation in building strategies, policies, plans for development in the field of maritime project management; research and application of scientific and technological progress to improve and enhance the quality and efficiency of work in the assigned sector;

e) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages for civil servants working in ethnic minority areas according to job requirements.

4. Standards and conditions for registering to take the examination or being considered for promotion to the position of Maritime Project Manager Class II:

a) Having held the position of Maritime Project Manager Class III and equivalent for at least nine years (excluding probationary and trial periods). In cases with equivalent time, there must be at least one year (twelve months) holding the position of Maritime Project Manager Class III up to the deadline for submitting registration applications for the examination or promotion;

b) During the period of holding the position of Maritime Project Manager Class III and equivalent, achieving at least one of the following standards and conditions:

Civil servants are eligible to register for the examination or promotion to the position of Maritime Project Manager Class II when meeting all the standards and conditions stipulated in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, use, and management of civil servants and the following standards and conditions:

Participated in building one topic, program, project, science and technology program at the ministry level or provincial level and above that has been issued or accepted by the competent authority;

Participated in building two topics, programs, projects, science and technology programs at the grassroots level where the employing agency was responsible for researching and building and have been issued or accepted by the competent authority;

Has served as the director of project management for one project of Group B or two projects of Group C of the same type;

Has been in charge of designing or reviewing or checking the design of two Class II construction projects or three Class III construction projects;

Has been in charge of managing one project of Group B or two projects of Group C or one Class II construction project or two Class III construction projects in terms of investment cost management;

Has participated in managing at least one project of Group B or two projects of Group C and holds one of the four professional certificates: Project Management Class II, Construction Design Class II, Construction Supervision Class II, or Construction Valuation Class II.

Article 6. Management of Class III Maritime Projects - Code: V.12.41.03

1. Duties:

a) Participate in performing the tasks of the project investor and supervise the implementation process of the project in accordance with regulations;

b) Participate in developing research topics, plans, quality objectives, economic and technical norms to innovate and improve management mechanisms, enhancing the effectiveness and efficiency of project management activities;

c) Participate in compiling and developing specialized guidance materials on maritime project management;

d) Participate in implementing specialized training sessions, vocational training, disseminating knowledge within the scope of assigned tasks;

đ) Participate in performing specialized and professional work within the functions and duties of the unit as prescribed by law;

e) Implement legal regulatory documents related to maritime project management work;

g) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

c) Be familiar with domestic and international legal regulations concerning maritime project management; understand the functions and responsibilities of the unit;

3. Qualifications regarding professional expertise and skills:

a) Firmly grasp the Party's guidelines and policies, the State's laws and policies; knowledge of management in the maritime industry, strategy, planning, and development;

b) Possess the ability to systematize administrative state management knowledge; project management in the maritime construction sector;

c) Have knowledge and experience in maritime project management activities;

d) Possess the ability to compile reports, coordinate activities, work independently and in teams; have the capacity to implement tasks ensuring progress, quality, and effectiveness;

đ) Have basic computer skills and be able to use foreign languages or ethnic minority languages as required by the position for civil servants working in ethnic minority areas.

4. Standards and conditions for registering to take the examination or be considered for promotion to the position of Class III Maritime Project Manager:

a) Have held the position of Class IV Maritime Project Manager or equivalent for at least three years (excluding probationary and trial periods). In cases with equivalent time, there must be at least one year (full twelve months) holding the position of Class IV Maritime Project Manager up to the deadline for submitting registration application for examination or promotion;

b) During the period of holding the position of Class IV Maritime Project Manager or equivalent, meet at least one of the following standards and conditions:

A civil servant may register to take the examination or be considered for promotion to the position of Class III Maritime Project Manager when meeting all the standards and conditions stipulated in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, employment, and management of civil servants and the following standards and conditions:

Has participated in managing one Class C project;

Has led or reviewed or verified the design of two Class III works;

Has led the implementation of one of the cost management tasks of one Class C project or one Class III work;

Has participated in managing one Class C construction investment project and holds one of the four professional certificates: Class III project management, Class III construction design, Class III construction supervision, or Class III construction valuation;

Article 7. Management of Class IV Maritime Projects - Code: V.12.41.04

1. Duties:

a) Perform specialized and professional work within the functions and duties of the unit as prescribed by law;

b) Participate in establishing and implementing file management systems, organizing statistics and archiving project documents according to regulations;

c) Coordinate in organizing specialized training sessions and vocational training for project management work;

d) Implement legal regulatory documents related to maritime project management work;

đ) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a college degree or higher in a relevant field that meets the requirements of the position;

c) Be familiar with domestic and international legal regulations concerning maritime project management; understand the functions and responsibilities of the unit;

3. Qualifications regarding professional expertise and skills:

a) Firmly grasp the Party's guidelines and policies, the State's laws and policies; knowledge of management in the maritime industry, strategy, planning, and development;

b) Possess the ability to compile reports, coordinate activities, work independently and in teams; have the capacity to implement tasks ensuring progress, quality, and effectiveness;

c) Possess skills in drafting documents and presenting issues assigned for research and advisory purposes;

d) Proficiently use office equipment and other tools necessary for task requirements.

Chapter III

SALARY RANK FOR THE PROFESSIONAL POSITION OF MARITIME PROJECT MANAGEMENT CIVIL SERVANT

Article 8. Principles for setting salaries for professional titles of maritime project management civil servants

1. The appointment and setting of salaries for professional titles of maritime project management civil servants must be based on the job position, responsibilities, expertise, and vocational qualifications currently held, and must fully meet the standards as prescribed in this Circular.

2. When transferring to a corresponding professional title of maritime project management civil servant, it shall not combine with salary grade increase or promotion of professional title of civil servant.

Article 9. Setting salaries for professional titles of maritime project management civil servants

1. From the date this Circular takes effect, in cases where civil servants do not yet meet the criteria and conditions for appointment to the professional titles of maritime project management civil servants as stipulated in Articles 4, 5, 6, and 7 of this Circular, the following measures shall be implemented:

a) If the civil servant still has less than five years (60 months) of service until retirement, they shall continue to hold their current rank or professional title grade and be paid according to the current salary scale.

b) If the civil servant still has five years (60 months) or more of service remaining, within three years (36 months), the employing agency shall be responsible for arranging training to ensure that the civil servant meets the criteria for the professional title grade of maritime project management civil servant as prescribed in this Circular. After the period specified herein, if the civil servant does not meet the prescribed criteria, the head of the public institution shall consider assigning other suitable work or implementing policies as prescribed.

2. The professional titles of maritime project management civil servants prescribed in this Circular shall apply the Salary Scale for Professional and Vocational Staff in State-Owned Public Institutions (Table 3) issued together with Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, staff, and armed forces as follows:

a) The professional title of Maritime Project Management Grade I shall apply the salary coefficient of civil servant type A3, group 1 (A3.1) from salary coefficient 6.20 to salary coefficient 8.00;

b) The professional title of Maritime Project Management Grade II shall apply the salary coefficient of civil servant type A2, group 1 (A2.1) from salary coefficient 4.40 to salary coefficient 6.78;

c) The professional title of Maritime Project Management Grade III shall apply the salary coefficient of civil servant type A1 from salary coefficient 2.34 to salary coefficient 4.98;

d) The professional title of Maritime Project Management Grade IV shall apply the salary coefficient of civil servant type A0 from salary coefficient 2.10 to salary coefficient 4.89.

3. The transfer of salary for civil servants in the field of maritime project management who are currently being paid at the civil servant rank they hold to the professional titles of maritime project management civil servants prescribed in this Circular shall be carried out in accordance with the guidance provided in Clause 2, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs on salary setting when upgrading ranks, transferring ranks, or changing types of civil servants, specifically as follows:

a) Assigning the salary for the professional title of Maritime Project Management Grade I, code V.12.41.01 for civil servants currently being paid at type A3, group 1 (A3.1);

b) Assigning the salary for the professional title of Maritime Project Management Grade II, code V.12.41.02 for civil servants currently being paid at type A2, group 1 (A2.1);

c) Assigning the salary for the professional title of Maritime Project Management Grade III, code V.12.41.03 for civil servants currently being paid at type A1;

d) Assigning the salary for the professional title of Maritime Project Management Grade IV, code V.12.41.04 for civil servants currently being paid at type A0.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Effective Date

1. This Circular takes effect from March 1, 2023.

2. In cases where the legal normative documents referred to in this Circular are amended, supplemented, or replaced, implementation shall be in accordance with the provisions of the amended, supplemented, or replacing document.

Article 11. Implementation Organization

The Head of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Maritime Administration Department, the Heads of agencies, units, and organizations, and related individuals are responsible for implementing this Circular./.
