On the basis of The Vietnam Maritime Code dated November 25, 2015;
On the basis of The Inland Waterway Traffic Law dated June 15, 2004, and The Law Amending and Supplementing Certain Provisions of the Inland Waterway Traffic Law dated June 17, 2014;
Pursuant to the Government Decree No. Decision No. 12/2017/NĐ-CP dated February 10, 2017 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;
At the proposal of the Director of the Legal Department and the Director of the Vietnam Ship Survey Bureau;
The Minister of Transport issues this Circular on the forms of certificates and logbooks for technical safety and environmental protection issued to ships, floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels.[2].
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Regulation
Article 1. This Circular stipulates the forms of certificates and logbooks for technical safety and environmental protection issued to ships, diving vessels[3], floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels.
Article 2. This Circular does not apply to ships, diving vessels[4], floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels used for national defense, security purposes, and fishing vessels.
Article 2. Applicability
This Circular applies to organizations and individuals involved in the design, manufacture, construction, repair, conversion, import, use, and implementation of quality control, technical safety, environmental protection, and labor safety inspections for ships, diving vessels[5], floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels.
Article 3. Application of Law
In case the legal regulations cited in this Circular are amended, supplemented, or replaced, the corresponding amended, supplemented, or replaced legal regulations shall be applied.
Chapter II. CERTIFICATE AND LOGBOOK FORMS FOR TECHNICAL SAFETY AND ENVIRONMENTAL PROTECTION
Article 4. Certificate and logbook forms for technical safety and environmental protection according to Vietnamese laws
Point 1. Certificate and logbook forms for technical safety and environmental protection issued to ships, diving vessels[6] are specified in Appendix I attached to this Circular.
Point 2. Certificate and logbook forms for technical safety and environmental protection issued to floating docks, floating storage units, mobile platforms are specified in Appendix II attached to this Circular.
Point 3. Certificate and logbook forms for technical safety and environmental protection issued to inland waterway vessels are specified in Appendix III attached to this Circular.
Point 4. Certificate forms for industrial products used for inland waterway vessels are specified in Appendix IV attached to this Circular.
Article 5. Forms of certificates for technical safety and environmental protection issued to ships, floating storage units, and mobile platforms according to international conventions of the International Maritime Organization (IMO) and the International Labour Organization (ILO)
1. Certificates for technical safety and environmental protection issued according to international conventions of the IMO and ILO that Vietnam is a member of shall apply the forms prescribed by these international conventions.
2. Certificates for technical safety and environmental protection issued according to international conventions of the IMO and ILO that Vietnam is not yet a member of or where the conventions do not specify the form of the certificate, upon request of the shipowner of ships, floating storage units, and mobile platforms to provide information to relevant authorities confirming compliance, the forms of certificates prescribed in Appendix V attached hereto shall be applied.
Article 6. Forms of temporary certificates or conditional certificates
Temporary certificates or conditional certificates issued to ships, diving vessels[7], floating units, floating storage units, and mobile platforms shall apply the corresponding forms set out in this Circular and add the words "Temporary" or "Conditional" to the certificate.
Article 7. Forms of certificates and technical safety and environmental protection logs issued by foreign classification societies authorized to issue certificates to Vietnamese ships, diving vessels
In cases where foreign classification societies authorized to issue certificates and technical safety and environmental protection logs for Vietnamese ships, diving vessels[9], floating storage units, and mobile platforms apply the forms prepared by the foreign classification society according to the provisions of international conventions of the IMO and ILO that Vietnam is a member of or apply the forms prescribed in this Circular.
Article 8. Certificates and technical safety and environmental protection logs issued electronically
Certificates and technical safety and environmental protection logs issued electronically shall be implemented in accordance with the laws on electronic transactions and guidelines of the IMO and ILO.
Chapter III. IMPLEMENTING PROVISIONS[10]
Article 9. Effective Date
1. This Circular takes effect from January 1, 2023.
2. Repeal Circular No. 25/2017/TT-BGTVT dated July 28, 2017 of the Minister of Transport stipulating forms of certificates and technical safety and environmental protection logs issued to ships, inland waterway vessels, and industrial products used for inland waterway vessels and Circular No. 41/2019/TT-BGTVT dated October 30, 2019 of the Minister of Transport amending and supplementing certain articles of Circular No. 25/2017/TT-BGTVT dated July 28, 2017 of the Minister of Transport stipulating forms of certificates and technical safety and environmental protection logs issued to ships, inland waterway vessels, and industrial products used for inland waterway vessels.
3. Forms of certificates and technical safety and environmental protection logs issued to ships, inland waterway vessels, and industrial products used for inland waterway vessels in accordance with Circular No. 25/2017/TT-BGTVT and Circular No. 41/2019/TT-BGTVT shall continue to be valid until the expiration date of those certificates and technical safety and environmental protection logs.
Article 10. Implementation Organization
The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Ship Survey Bureau, Directors of the Vietnam Maritime Administration, Directors of the Vietnam Inland Waterways Administration, Heads of agencies and units under the Ministry of Transport, organizations and individuals related thereto are responsible for implementing this Circular./.

[7] The term "submarine" is added pursuant to Clause 1, Article 1 of Circular No. 26/2024/TT-BGTVT dated July 2, 2024 issued by the Minister of Transport amending and supplementing certain provisions of Circular No. 20/2022/TT-BGTVT dated July 29, 2022 issued by the Minister of Transport regarding samples of certificates and technical safety and environmental protection logbooks issued for seagoing vessels, floating drydocks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used on inland waterway vessels, which shall take effect from September 1, 2024.
[8] The term "submarine" is added pursuant to Clause 1, Article 1 of Circular No. 26/2024/TT-BGTVT dated July 2, 2024 issued by the Minister of Transport amending and supplementing certain provisions of Circular No. 20/2022/TT-BGTVT dated July 29, 2022 issued by the Minister of Transport regarding samples of certificates and technical safety and environmental protection logbooks issued for seagoing vessels, floating drydocks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used on inland waterway vessels, which shall take effect from September 1, 2024.

[10] Article 2 of Circular No. 26/2024/TT-BGTVT dated July 2, 2024, issued by the Minister of Transport, amending and supplementing certain provisions of Circular No. 20/2022/TT-BGTVT dated July 29, 2022, issued by the Minister of Transport, concerning forms of certificates and technical safety and environmental protection logs issued to ships, floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels, shall take effect from September 1, 2024, and is hereby stipulated as follows:
“Article 2. Implementation clause
1. This Circular takes effect from September 1, 2024.
2. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Maritime Administration Inspection Bureau, Directors of the Vietnam Inland Waterways Administration, Directors of Provincial and Municipal Departments of Transport under the Central Government, Heads of agencies and units under the Ministry of Transport, relevant organizations, and individuals are responsible for implementing this Circular.”

[12] Form No. III.04 shall be replaced as provided for in Clause 2, Article 1 of Circular No. 26/2024/TT-BGTVT dated July 2, 2024, issued by the Minister of Transport, amending and supplementing certain provisions of Circular No. 20/2022/TT-BGTVT dated July 29, 2022, issued by the Minister of Transport, concerning forms of certificates and technical safety and environmental protection logs issued to ships, floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels, which shall take effect from September 1, 2024.
[13] Form No. III.05 shall be replaced as provided for in Clause 2, Article 1 of Circular No. 26/2024/TT-BGTVT dated July 2, 2024, issued by the Minister of Transport, amending and supplementing certain provisions of Circular No. 20/2022/TT-BGTVT dated July 29, 2022, issued by the Minister of Transport, concerning forms of certificates and technical safety and environmental protection logs issued to ships, floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels, which shall take effect from September 1, 2024.
[14] Form No. III.06 shall be replaced as provided for in Clause 2, Article 1 of Circular No. 26/2024/TT-BGTVT dated July 2, 2024, issued by the Minister of Transport, amending and supplementing certain provisions of Circular No. 20/2022/TT-BGTVT dated July 29, 2022, issued by the Minister of Transport, concerning forms of certificates and technical safety and environmental protection logs issued to ships, floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels, which shall take effect from September 1, 2024.
[15] Form No. III.07 shall be replaced as provided for in Clause 2, Article 1 of Circular No. 26/2024/TT-BGTVT dated July 2, 2024, issued by the Minister of Transport, amending and supplementing certain provisions of Circular No. 20/2022/TT-BGTVT dated July 29, 2022, issued by the Minister of Transport, concerning forms of certificates and technical safety and environmental protection logs issued to ships, floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels, which shall take effect from September 1, 2024.
[16] Form No. III.08 shall be replaced as provided for in Clause 2, Article 1 of Circular No. 26/2024/TT-BGTVT dated July 2, 2024, issued by the Minister of Transport, amending and supplementing certain provisions of Circular No. 20/2022/TT-BGTVT dated July 29, 2022, issued by the Minister of Transport, concerning forms of certificates and technical safety and environmental protection logs issued to ships, floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels, which shall take effect from September 1, 2024.
