On the training and improvement of Administrative Court Judges at all levels

On April 20, 1995, the seventh session of the Ninth National Assembly passed a Resolution on the establishment of the Administrative Court. The establishment and preparation of conditions for the Administrative Court to operate are extremely urgent. In the short term, it is necessary to urgently train and improve over 1,000 people to become Administrative Court Judges so that the Administrative Courts can start operating immediately after the Ordinance on Procedures for Handling Administrative Cases is promulgated.

To implement this task, the Prime Minister instructs the Ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally governed cities to fulfill well the requirements and tasks below:

1. Urgently develop the Standards for Administrative Court Judges to submit to the Standing Committee of the National Assembly for approval, serving as the basis for the training and improvement of Administrative Court Judges at all levels.

The criteria for selecting individuals for training and improving Administrative Court Judges must be clearly and specifically defined, paying attention to both capacity and character.

The individuals selected for training and improving Administrative Court Judges are those currently working in State Inspection agencies, local authorities at various levels, with experience in administrative management, having a certain level of legal knowledge, and some university graduates in Law with good grades and excellent moral qualities.

Assign the Government Organizational and Cadre Affairs Board to take the lead, in collaboration with the Ministry of Justice and the State Inspectorate, to coordinate with the Supreme People's Court:

- Develop planning and annual training and improvement programs for Administrative Court Judges, initially focusing on the 1995 training and improvement program for Administrative Court Judges.

- Develop professional standards for Administrative Court Judge positions at all levels and selection criteria for individuals to be trained and improved as Administrative Court Judges.

- Guide ministries, sectors, and localities in selecting individuals for training and improving Administrative Court Judges and organizing the selection process according to the established criteria.

- Allocate trainees after completing training and improvement courses for Administrative Court Judges.

2. The training and improvement program for Administrative Court Judges must include essential contents on laws, administrative management, administrative adjudication, linked to the practical situation of the country and incorporating foreign experiences.

The compilation of textbooks and lectures must ensure substantive content suitable for each type of trainee.

The teaching staff, including part-time teachers, must be selected from individuals with high professional qualifications, practical experience in administrative agencies, and good teaching abilities to participate in the training and improvement of Administrative Court Judges.

Assign the National Academy of Public Administration to take the lead, in collaboration with the Ministry of Justice and the State Inspectorate, to coordinate with the Supreme People's Court:

- Develop the training and improvement program for Administrative Court Judges to submit to the Prime Minister for approval.

- Compile textbooks and lectures, prepare teaching staff and other conditions and means to serve the training and improvement of Administrative Court Judges.

- Organize training and improvement courses for Administrative Court Judges, ensuring quantitative and qualitative targets, meeting immediate and long-term requirements.

- The People's Committees of provinces and centrally governed cities, following the guidance of the Government Organizational and Cadre Affairs Board and the Supreme People's Court, are responsible for selecting local cadres for training and improving Administrative Court Judges, ensuring the allocated quantitative targets, correct categories, and specified criteria.

3. The budget for implementing the training and improvement of Administrative Court Judges will be sourced from the retraining budget for managerial cadres and civil servants of the state.

Assign the State Planning Commission, the Ministry of Finance, and the Government Organizational and Cadre Affairs Board, based on adjusting the state budget for 1995, to prepare the 1995 budget and subsequent years for this activity.

4. The Ministers, Heads of the Government Organizational and Cadre Affairs Board have the responsibility to guide central ministries, sectors, and localities in organizing the implementation of this Directive. The Ministers, Heads of ministerial-level agencies, agencies under the Government, Chairmen of People's Committees of provinces and centrally governed cities are responsible for enforcing this Directive.
