Pursuant to the Law on the State Bank of Vietnam No. 01/1997/QH10 and the Law on Credit Organizations No. 02/1997/QH10 dated December 12, 1997;
Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of ministries and ministerial-level agencies;
Pursuant to Decree No. 63/1998/NĐ-CP dated August 17, 1999 of the Government on foreign exchange management;
Pursuant to the Rules for Issuing Commercial Bank Bonds and Development Bank Bonds issued together with Decision No. 212/QĐ-NH1 dated September 22, 1994 of the Governor of the State Bank of Vietnam;
At the proposal of the Head of the Monetary Policy Department.
DECISION:
Article 1: The Development Bank of Vietnam is permitted to issue Development Bank bonds for the First Tranche/2000 with a total face value of 2,000 billion VND, including approximately 600 billion VND in VND-denominated bonds and approximately 100 million USD in foreign currency-denominated bonds. The bond purchasers shall be individuals and various strata of the population. The face value, term, issuance period, interest rate, and other conditions of the bonds shall be implemented according to the Proposal for Issuing Development Bank Bonds - First Tranche/2000 submitted in Document No. 2139/CV-NHĐT dated November 15, 1999.
Article 2: The bond form of the Development Bank of Vietnam shall be carried out according to the attached bond form in Document No. 2197/TT-NHĐT dated November 17, 1999 of the Development Bank of Vietnam.
Article 3: The Development Bank of Vietnam shall implement other provisions regarding bond issuance in the Rules for Issuing Commercial Bank Bonds and Development Bank Bonds issued together with Decision No. 212/QĐ-NH1 dated September 22, 1994 of the Governor of the State Bank of Vietnam.
Article 4: The Development Bank of Vietnam is responsible for paying both principal and interest on USD-denominated bonds to the owners of USD-denominated bonds upon maturity in accordance with the regulations on foreign currency savings deposits set forth in Decree No. 63/1998/NĐ-CP dated August 17, 1999 of the Government on Foreign Exchange Management (Clause 3, Article 5).
Article 5: The Director of the Office, the Inspector General, Heads of units under the State Bank of Vietnam, Governors of State Bank of Vietnam Branches in provinces and cities, Chairman of the Board of Directors and General Director of the Development Bank of Vietnam are responsible for implementing this Decision./.
