guiding the system for trial allowances

Implementing Decision No. 154/TTg dated March 12, 1996 of the Prime Minister on the implementation of the trial allowance system, the Government Organizational and Cadre Affairs Department - Ministry of Finance - Ministry of Justice guides the implementation of the trial allowance system as follows:

I. PURPOSE AND SIGNIFICANCE

The trial allowance system for Judges, Court Secretaries, Prosecutors participating in trials, Court Security Officers, and Police Escorts bringing defendants to court aims to provide support to these individuals during the trial process.

II. AMOUNT OF ALLOWANCE AND APPLICABLE SUBJECTS

- Amount of 15,000 VND/person/day of trial, applicable to Judges presiding over the trial.

- Amount of 10,000 VND/person/day of trial, applicable to Judges, Court Secretaries, Prosecutors participating in trials, Court Security Officers, and Police Escorts bringing defendants to court.

III. IMPLEMENTATION

1. The trial allowance for Judges, Court Secretaries, Court Security Officers, and Police Escorts bringing defendants to court shall be paid by the court that decides to bring the case to trial.

The trial allowance for Prosecutors shall be paid by the People's Procuracy that dispatches personnel to participate in the trial.

2. The financial resources for implementing the trial allowance system shall be allocated in the annual budget plan of each unit.

Specifically, the funds for payment by Military Courts and Military Procuracies at all levels shall be allocated in the annual budget plan assigned to the Ministry of National Defense.

The allowance system shall be accounted for, budgeted, and settled according to current regulations.

3. This Circular takes effect from March 12, 1996, and any provisions regarding trial allowances contrary to this Circular shall be abolished.

4. Any difficulties encountered during implementation should be reported to the Joint Ministries for study and resolution./.
