DECISION OF THE PRIME MINISTER

On strengthening cadres and civil servants to communes for poverty reduction work on a temporary basis

concerning communes engaged in poverty reduction activities

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Cadres and Civil Servants Ordinance dated February 26, 1998;

Pursuant to Decision No. 133/1998/QĐ-TTg dated July 23, 1998 of the Government Prime Minister approving the National Target Program on Poverty Reduction for the period 1998-2000;

Pursuant to Decision No. 05/1998/QĐ-TTg dated January 14, 1998 of the Prime Minister on managing national target programs;

At the proposal of the Minister of Labor, War Invalids and Social Affairs and the Ministers, Heads of the Government Organization and Cadre Department,

DECISION:

Article 1. Strengthening cadres and civil servants from districts and provinces to communes for poverty reduction work.

Article 2. Cadres and civil servants strengthened to communes must meet the following criteria:

- Understanding commune construction, poverty reduction policies, having knowledge about agricultural, forestry, fishery production and customs of commune residents;

- Having good moral character, sense of responsibility, enthusiasm for work, voluntarily accepting assigned tasks;

- Having health to undertake the job.

Article 3. Cadres and civil servants strengthened to communes have the following responsibilities:

- Assisting the Commune People's Committee to implement the poverty reduction program down to villages, households;

- Assisting the commune to build small projects on infrastructure development and resettlement, relocation, new economic zones that are practical and effective (using both central, provincial financial support, local mobilization, and other sources of capital);

- Assisting village chiefs to establish mutual assistance groups, credit-savings groups, combining with organizing guidance on farming, forestry, fishery practices;

- Assisting the commune to organize the integration of activities related to poverty reduction in the locality to concentrate resources for poverty reduction goals;

- Assisting the commune to organize propaganda, guidance, experience sharing, mid-term and final reviews of good mechanisms and models to expand widely.

Article 4. Cadres and civil servants falling under Article 1 of this Decision shall enjoy the following benefits:

1. Maintaining their original salary, allowances, other benefits (if any), and positions at the dispatching agency. After completing the mission, they will return to their original agency to continue working. If they perform excellently, they may be promoted one year earlier than the regulation stipulates.

2. In addition to the above benefits, cadres and civil servants strengthened to communes shall receive additional monthly allowances depending on specific conditions at the workplace and the budget capacity of the locality. The amount of additional monthly allowance for cadres and civil servants strengthened to communes shall be decided by the Chairman of the Provincial People's Committee or the Municipal People's Committee directly under the Central Government.

3. Other policies shall be implemented according to current regulations.

The benefits of cadres and civil servants strengthened to communes stipulated in this Article shall be paid by the dispatching agency and may be partially funded from the project management budget at the local level.

Article 5. The Chairman of the Provincial People's Committee or the Municipal People's Committee directly under the Central Government shall direct the Provincial Organization Department to develop Regulations and organize the dispatch of cadres and civil servants to poor communes in the direction: For a commune in a district, the district shall strengthen it; when there is a shortage, the province shall strengthen it, within the total number of positions allocated by the competent state agency in the annual plan of the province or municipality directly under the Central Government.

Article 6. The Commune People's Committee shall be responsible for managing and creating favorable conditions for cadres strengthened to communes to participate in poverty reduction activities, arranging accommodation and workplaces to enable cadres and civil servants strengthened to complete their tasks well.

Article 7. This Decision shall take effect fifteen days from the date of signature.

Article 8. The Minister, Head of a ministerial-level agency, Head of a government-affiliated agency, Chairman of the Provincial People's Committee or the Municipal People's Committee directly under the Central Government, and the Steering Committee of the National Target Program on Poverty Reduction shall be responsible for implementing this Decision.
