On the classification of urban areas
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Construction Law dated November 26, 2003;
Considering the proposal of the Minister of Construction,
DECREE:
Chapter 1
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. Scope of regulation: This Decree stipulates the classification of urban areas, the organization of drafting, reviewing proposals, and deciding to recognize the classification of urban areas.
2. Applicability: organizations and individuals within Vietnam and abroad related to the classification of urban areas and the development of urban areas on the territory of Vietnam.
The classification of urban areas aims at:
1. Organizing, arranging, and developing the national urban system.
2. Drafting and examining construction planning for urban areas.
3. Enhancing the quality of urban areas and sustainable urban development.
4. Establishing policies and management mechanisms for urban areas and urban development.
In this Decree, the following terms are understood as follows:
1. A new urban area is an urban area expected to be formed in the future, gradually invested in and constructed to meet the standards of urban areas as prescribed by law.
2. Urban population refers to the population within the administrative boundaries of the urban area, including inner city, outer city, inner town, outer town, and town.
3. An integrated urban infrastructure system is when the technical infrastructure and social infrastructure systems have been invested in and constructed to achieve 70% of the requirements of the urban construction planning project according to each phase; meeting technical standards and other relevant regulations.
4. A complete urban infrastructure system is when the technical infrastructure and social infrastructure systems have been invested in and constructed to meet the requirements of the urban construction planning project according to each phase; meeting technical standards and other relevant regulations.
5. Urban areas with special characteristics are those urban areas that possess unique values regarding cultural heritage (tangible and intangible), history, nature, and tourism recognized at both national and international levels.
Urban areas are classified into six types as follows: special type, Type I, Type II, Type III, Type IV, and Type V, decided by competent state agencies.
1. Special type urban area is a centrally-administered city with inner city districts, suburban counties, and directly affiliated urban areas.
2. Type I and Type II urban areas are centrally-administered cities with inner city districts, suburban counties, and may include directly affiliated urban areas; Type I and Type II urban areas are provincial cities with inner city wards and suburban communes.
3. Type III urban areas are provincial cities or towns with inner city wards, inner town wards, and suburban communes.
4. Type IV urban areas are provincial towns with inner town wards and suburban communes.
5. Type IV and Type V urban areas are townships under counties with concentrated residential areas and may include rural settlements.
1. Adjustments to expand the administrative boundaries of urban areas must be based on urban construction plans approved by competent state agencies. Areas adjusted for expansion must be developed and constructed to meet basic classification standards for urban areas.
The People's Committee of the province or centrally-administered city (hereinafter referred to as the Provincial People's Committee) shall organize the drafting of proposals to adjust the administrative boundaries of urban areas according to current regulations, submit them to competent state agencies for decision. Recognition of the type of urban area will be carried out after the decision to expand the administrative boundary has been made and when the urban area has met the basic classification standards.
2. For areas expected to form new urban areas, there must be urban construction plans approved by competent state agencies and already basically achieved the classification standards. The Provincial People's Committee shall organize the drafting of proposals to establish new urban areas according to Clause 1, Article 18 of this Decree. Recognition of the type of urban area will be carried out after the decision to establish the new urban area has been made and when the urban area has met the basic classification standards.
3. In special cases due to territorial management requirements, national sovereignty, or economic and social development management, the administrative management authority of an area may be decided by competent state management agencies before the area has been developed and constructed to meet the basic classification standards.
The basic criteria for classifying urban areas are considered and evaluated based on the current status of urban development in the year immediately preceding the year of drafting the urban classification proposal or at the time of drafting the urban classification proposal, including:
1. Urban function
It is a comprehensive center or a specialized center at the national level, inter-provincial regional level, provincial level, district level, or a center within a province's region; playing a role in promoting the economic and social development of the entire country or a specific territorial area.
2. Minimum total urban population must reach 4,000 people or more.
3. Population density appropriate to the scale, nature, and characteristics of each type of urban area and calculated within the inner city, inner town, and concentrated residential areas of towns.
4. The ratio of non-agricultural labor force must reach a minimum of 65% compared to the total number of labor force within the boundaries of the inner city, inner town, and concentrated construction areas.
5. Urban infrastructure system includes social infrastructure systems and technical infrastructure systems:
a) For the inner city and inner town areas, they must be developed and constructed synchronously and have a degree of completeness according to each type of urban area;
b) For suburban and outer town areas, they must be developed and constructed synchronously with infrastructure networks and ensure environmental protection requirements and sustainable urban development.
6. Urban architecture and landscape: urban development must follow approved urban architectural management regulations, having model urban areas, civilized urban streets, public spaces serving the spiritual life of urban residents; having architectural complexes or representative buildings that are suitable to the environment and natural landscape.
1. Special-class cities, Class I or Class II cities directly under the Central Government: inner-city districts are evaluated according to the standards of special-class cities, Class I or Class II cities.
For cities adjacent to the inner-city boundary managed for development and classified according to the inner-city area standards. Other cities within the city are evaluated according to the standards determined by the overall urban planning and the current development status of the city.
2. Class I, Class II, Class III, and Class IV cities in provinces: inner-city wards are evaluated according to the standards of Class I, Class II, Class III, and Class IV cities.
3. Class IV and Class V cities in districts: concentrated residential areas are evaluated according to the standards of Class IV and Class V cities.
4. Suburban and outer-town areas are evaluated based on the standards stipulated in point b, Clause 5 of Articles 9, 10, 11, 12, 13, and 14 of this Decree.
Article 8. Urban Development Program
To serve as a basis for proposing urban classification, People's Committees at all levels base on the urban classification criteria prescribed in this Decree to develop an Urban Development Program, mobilizing resources for investment in urban development. The Urban Development Program must ensure improvements in the quality of life for residents, urban architectural and landscape appearance towards civilization, modernity, sustainability, and preserving the refined values and cultural identity of each urban area.
Chapter II
CRITERIA FOR URBAN CLASSIFICATION
1. The function of the city is the Capital or a city with functions as an economic, financial, administrative, scientific and technological, educational and training, tourism, healthcare, transportation hub, and international exchange center, playing a role in promoting national socio-economic development.
2. The total population of the city is five million people or more.
3. The population density in the inner city area is fifteen thousand people/km² or more.
4. The minimum ratio of non-agricultural labor to the total number of workers is ninety percent.
5. Urban infrastructure system
a) Inner city area: is invested in and constructed synchronously and basically completed, ensuring urban environmental sanitation standards; all new production facilities must apply clean technology or be equipped with devices to minimize environmental pollution;
b) Outer city area: is invested in and constructed with basic synchronization of infrastructure networks and key technical infrastructure projects serving the city; the development of projects causing environmental pollution must be minimized; infrastructure networks at rural residential points must be constructed synchronously; areas of land suitable for agricultural development, green zones serving the city, and ecological landscape areas must be protected.
6. Urban architecture and landscape: implement urban development according to urban architectural management regulations. New urban areas must meet model city standards, and over sixty percent of main urban streets must meet civilized urban street standards, providing public spaces serving the spiritual life of the people, and having architectural complexes or landmark buildings with national significance.
1. Urban function
Central-affiliated cities have functions as economic, cultural, scientific and technological, administrative, educational and training, tourism, service centers, transportation hubs, and domestic and international exchanges, playing a role in promoting regional socio-economic development across multiple provinces or nationwide. Province-affiliated cities have functions as economic, cultural, scientific and technological, administrative, educational and training, tourism, service centers, transportation hubs, and domestic exchanges, playing a role in promoting socio-economic development in one or several regions across multiple provinces.
2. Population size of the city
a) Central-affiliated cities have a total city population of one million people or more;
b) Province-affiliated cities have a total city population of five hundred thousand people or more.
3. Average population density in the inner city area
a) Central-affiliated cities have a population density of twelve thousand people/km² or more;
b) Province-affiliated cities have a population density of ten thousand people/km² or more.
4. Minimum ratio of non-agricultural labor in the inner city area to the total number of workers is eighty-five percent.
5. Urban infrastructure system
a) Inner city area: many aspects are invested in and constructed synchronously and basically completed; ensuring environmental sanitation standards; all new production facilities must apply clean technology or be equipped with devices to minimize environmental pollution;
b) Outer city area: many aspects are invested in and constructed synchronously and basically completed; the development of projects causing environmental pollution must be minimized; infrastructure networks at rural residential points must be constructed synchronously; areas of land suitable for agricultural development, green zones serving the city, and ecological landscape areas must be protected.
6. Urban architecture and landscape: implement urban development according to urban architectural management regulations. New urban areas must meet model city standards, and over fifty percent of main urban streets must meet civilized urban street standards. There must be public spaces serving the spiritual life of the people and architectural complexes or landmark buildings with national significance.
1. Urban Function The urban area has the function of being an economic, cultural, scientific and technological, administrative, educational and training, tourism, service, transportation hub, and exchange center within the province or inter-provincial region, playing a role in promoting socio-economic development of a province or an inter-provincial territory.
In the case where a Class II urban area is a centrally-administered city, it must have the function of being an economic, cultural, scientific and technological, administrative, educational and training, tourism, service, transportation hub, and domestic and international exchange center, playing a role in promoting socio-economic development of an inter-provincial territory or certain fields nationwide.
2. Population Size The total population of the urban area must reach at least 300,000 people.
In the case where a Class II urban area is centrally-administered, the total population of the urban area must exceed 800,000 people.
3. Population Density in the Inner City Area
For urban areas under provincial administration, the population density in the inner city area must be at least 8,000 people per square kilometer; for urban areas under central administration, the population density must be at least 10,000 people per square kilometer.
4. Proportion of Non-Agricultural Labor in the Inner City Area The minimum proportion of non-agricultural labor in the inner city area must reach 80% of the total labor force.
5. Urban infrastructure system
a) Inner City Area: Must be invested in and constructed in a coordinated manner, moving towards basic completion; all new production facilities must apply clean technology or be equipped with devices to minimize environmental pollution.
b) Outer City Area: Some aspects must be invested in and constructed in a coordinated manner; the infrastructure network in rural residential areas must be basically invested in and constructed; the development of projects causing environmental pollution must be restricted; areas of land suitable for agricultural development, green zones serving the city, and ecological landscapes must be protected.
6. Urban Architecture and Landscape: Implement urban development according to the urban architectural management regulations. New urban areas must meet model urban standards, and over 40% of the main urban streets must meet civilized street standards. There must be public spaces serving the spiritual life of the people and a complex of architecture or architectural works with national significance.
1. Urban function
The urban area serves as an economic, cultural, scientific and technological, administrative, educational and training, tourism, service, transportation hub, and exchange center within the province or inter-provincial region, playing a role in promoting socio-economic development of a region within the province, a province, or certain fields within the inter-provincial region.
2. Population Size The total population of the urban area must be at least 150,000 people.
3. Population Density in the Inner City or Town Area The population density in the inner city or town area must be at least 6,000 people per square kilometer.
4. Proportion of Non-Agricultural Labor in the Inner City or Town Area The minimum proportion of non-agricultural labor in the inner city or town area must reach 75% of the total labor force.
5. Urban infrastructure system
a) Inner City or Town Area: Each aspect must be invested in and constructed in a coordinated manner, moving towards basic completion; all new production facilities must apply clean technology or be equipped with devices to minimize environmental pollution.
b) Outer City or Town Area: Each aspect must be invested in and constructed towards coordination; the development of projects causing environmental pollution must be restricted; the infrastructure network in rural residential areas must be basically invested in and constructed; areas of land suitable for agricultural development, green zones serving the city, and ecological landscapes must be protected.
6. Urban Architecture and Landscape: Implement urban development according to the urban architectural management regulations. New urban areas must meet model urban standards, and over 40% of the main urban streets must meet civilized street standards, with public spaces serving the spiritual life of the people and architectural works with regional or national significance.
1. Urban Function.
The urban area is the economic, cultural, administrative, scientific and technological, educational and training, tourism, service center, and transportation hub of a region within a province or a province. It plays a role in promoting the socio-economic development of a region within a province or certain sectors for a province.

b) Outer city area: is being invested in construction towards synchronization; must protect areas of land favorable for agricultural development, green zones serving the urban area, and ecological landscapes.
6. Urban architecture and landscape: gradually implement urban development according to the urban architectural management regulations.
1. Urban Function. The urban area is a comprehensive or specialized center for economy, administration, culture, education and training, tourism, and services, playing a role in promoting the socio-economic development of a district or a cluster of communes.
2. Total population size of the urban area from 4 thousand people upwards.
3. Average population density from 2,000 people/km² upwards.
4. The minimum ratio of non-agricultural labor force in the built-up areas must reach 65% compared to the total number of labor force.
5. Urban infrastructure system: has been or is being constructed towards synchronization, new production facilities must apply clean technology or be equipped with devices to minimize environmental pollution.
6. Urban architecture and landscape: gradually implement urban development according to the urban architectural management regulations.
For urban areas in highland, deep inland, remote, border, and island regions, the population size and population density may be lower, but must at least reach 50% of the prescribed standards, other standards must ensure at least 70% of the prescribed levels compared to similar types of urban areas.
For urban areas identified as special character urban areas, the standards for population size and population density may be lower, but must at least reach 60% of the prescribed standards, other standards must meet the prescribed requirements for similar types of urban areas and ensure suitability with the special characteristics of each urban area.
Chapter III
ESTABLISHMENT, REVIEW AND AUTHORITY TO DECIDE ON URBAN AREA CLASSIFICATION AND URBAN DEVELOPMENT PROGRAMS
1. Special type urban areas, Type I and Type II urban areas directly under the Central Government, and urban areas with special characteristics: The provincial People's Committee organizes the establishment of urban classification proposals; submits to the same-level People's Council for approval before submitting to the Prime Minister.
The Ministry of Construction organizes the review of the proposal submitted to the Prime Minister for consideration and decision.
2. Type I and Type II urban areas belonging to provinces: The municipal People's Committee coordinates with the Department of Construction to organize the establishment of urban classification proposals to submit to the provincial People's Committee for submission to the same-level People's Council for approval before submitting The Prime Minister.
The Ministry of Construction organizes the review before submitting to the Prime Minister for consideration and decision.
3. Type III and Type IV urban areas: The municipal People's Committee and town People's Committee coordinate with the Department of Construction to organize the establishment of urban classification proposals to submit to the provincial People's Committee for submission to the same-level People's Council for approval before submitting to the Ministry of Construction. The Ministry of Construction reviews, organizes the review, and decides on the recognition of Type III and Type IV urban areas.
1. Recognition of new urban area types: The provincial People's Committee shall organize the preparation of proposals for recognizing new urban area types when such areas have been basically invested in and constructed to meet the classification standards for urban areas, and submit these proposals to the same-level People's Council for approval.
The Ministry of Construction shall organize reviews and issue approval documents to serve as the basis for preparing proposals for establishing new urban areas before submitting them to the Prime Minister for consideration and decision regarding the type of urban area.
2. Recognition of Class V urban areas: The district People's Committee shall organize the preparation of proposals for classifying urban areas. The Department of Construction shall review these proposals, which the provincial People's Committee will then submit to the same-level People's Council for approval before considering and deciding.

Article 19. Preparation and Approval of Urban Development Programs
1. The People's Committees of centrally-administered cities shall organize the preparation of urban development programs, and submit these programs to the same-level People's Council for approval before making decisions.
2. The People's Committees of cities and towns under provinces shall organize the preparation of urban development programs and submit them to the provincial People's Committee for consideration and decision after obtaining approval from the same-level People's Council.
3. The district People's Committees shall organize the preparation of urban development programs and programs for developing residential areas with urbanization trends that are preparing to become Class V urban areas within their administrative jurisdiction, and submit these programs to the provincial People's Committee for consideration and decision after obtaining approval from the same-level People's Council.
4. Investment projects for urban development must comply with urban development programs that have been decided upon by competent authorities.
Article 20. Capital for Urban Classification Work and Urban Development Programs
1. Capital for implementing urban classification work and urban development programs shall be sourced from state budget funds allocated annually for economic public services to localities.
2. The expenses for implementing urban classification work and urban development programs include:
a) Surveys and collection of materials to support the preparation of proposals for urban classification and urban development programs;
b) Preparation, review, and approval of proposals for urban classification and urban development programs;
c) Organization of the announcement of decisions recognizing urban classifications.
3. Local People's Committees at all levels shall be responsible for preparing capital plans for urban classification work and urban development programs within their administrative jurisdictions, and submit these plans to the provincial People's Committee for consideration and decision according to current regulations.
4. The Ministry of Planning and Investment and the Ministry of Finance shall balance the annual budget from economic public service funds for urban classification work and urban development programs of localities according to current regulations.
Chapter IV
ORGANIZATION AND IMPLEMENTATION
1. For urban areas that have already received decisions recognizing their urban classifications prior to the effective date of this Decree, they shall retain their existing urban classifications without needing to go through recognition procedures again.
2. Based on the urban classification criteria stipulated in this Decree, local People's Committees shall organize reviews of the current status of urban development, assess remaining issues, prepare urban development programs, and continue investment and construction to ensure that urban areas meet the urban classification criteria stipulated in this Decree.
1. The Ministry of Construction shall be responsible to the Government and uniformly manage state affairs related to urban classification throughout the country.
2. People's Committees at all levels shall be responsible for managing state affairs related to urban classification within their administrative boundaries.
Article 23. Inspection of Urban Classification Work and the Urban Development Program
2. The Ministry of Construction shall cooperate with the Ministry of Planning and Investment and the Ministry of Finance to conduct annual inspections of the implementation of the Urban Development Program nationwide.
Article 24. Reporting on Urban Classification Work and the Urban Development Program
Provincial People's Committees shall be responsible for:

Article 25. Effective Date
This Decree replaces Decree No. 72/2001/NĐ-CP dated October 5, 2001 of the Government on Urban Classification and Urban Management Levels. This Decree takes effect from July 2, 2009.
Article 26. Responsibility for Implementation
1. The Ministry of Construction shall coordinate with relevant ministries and sectors to guide, monitor, and inspect the enforcement of this Decree.
2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally administered cities are responsible for implementing this Decree./.
