Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Legislative Acts of 03 June 2008;
At the proposal of the Minister of Agriculture and Rural Development;
The Prime Minister issues this Decision on support for organizations and units employing laborers who are ethnic minorities in mountainous areas and particularly difficult regions,
This Decision stipulates the policy of support regarding training, health insurance, social insurance, unemployment insurance, labor quota, land rental fees, sources of support funds, and the responsibilities of relevant state agencies in implementing this policy.
Article 2. Applicability
The objects to which this Decision applies include: State-owned single-member limited liability companies in agriculture, forestry, and aquaculture; Special-use Forest Management Boards, Protective Forest Management Boards; cooperatives; non-state enterprises (including foreign-invested enterprises) using land for agricultural, forestry, and aquaculture production purposes (hereinafter referred to collectively as labor-using units) that employ ethnic minority laborers residing legally within the territory of the Central Highlands provinces, mountainous areas, and particularly difficult regions (attached list).
Article 4. Preparation of Budget Estimates and Consolidation of Support Expenditure Budgets
The state budget will support short-term vocational training costs (up to primary vocational level and under three months) with a maximum of three million dong per person per course (specific support levels according to each profession and actual training time) for general laborers who are ethnic minorities, meeting the recruitment conditions set forth in the recruitment and training plan of the labor-using unit.
2. On Health Insurance, Social Insurance, Unemployment Insurance
The state budget will support the payment of social insurance, health insurance, and unemployment insurance premiums on behalf of the labor-using unit for newly recruited or contracted ethnic minority laborers. The state will provide budgetary support for five years for each individual laborer.
3. On Labor Quotas
Labor-using units may apply a labor quota equal to eighty percent of the common labor quota of the unit for contracting or paying wages to ethnic minority laborers. The application period is five years for each laborer starting work at the unit.
Labor-using units that employ between thirty and less than fifty percent of their total workforce as ethnic minority laborers shall be granted a fifty percent reduction in land rental fees for the year for the area of land required to be rented according to the law on land. Labor-using units that employ fifty percent or more of their total workforce as ethnic minority laborers shall be exempt from one hundred percent of land rental fees for the year for the area of land required to be rented according to the law on land.
Article 4. Sources of Support
1. The central government budget will cover one hundred percent of the costs for training, health insurance, social insurance, unemployment insurance, and twenty percent of the common labor quota of the unit for contracting or paying wages to ethnic minority laborers.
2. Training support funds will be directly provided to labor-using units according to the approved training plans by the provincial People's Committee for units under the province; by ministries or sectors for units under ministries or sectors; and by the Group Corporation 91 for subordinate units.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Ministry of Finance, in collaboration with the Ministry of Agriculture and Rural Development, will lead the implementation of this Decision.
2. The Ministry of Agriculture and Rural Development and the People's Committees of the provinces listed in the attached list will be responsible for monitoring, supervising, urging, inspecting, and directing the implementation.
Article 6. Effectiveness
This Decision takes effect from December 1, 2012, replacing Decision No. 75/2010/QĐ-TTg dated November 29, 2010, issued by the Prime Minister on supporting organizations and units employing ethnic minority laborers residing legally in the Central Highlands provinces.
Article 7. Responsibility for Implementation
Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, State Economic Groups, and Group Corporation 91, Chairmen of the People's Committees of provinces and centrally-administered cities (attached list) are responsible for implementing this Decision./.
