On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

The Minister of Transport issues this Circular amending and supplementing certain articles of Circular No. 29/2018/TT-BGTVT dated May 14, 2018, issued by the Minister of Transport on quality inspection, technical safety, and environmental protection for railway transportation vehicles, and Circular No. 18/2019/TT-BGTVT dated May 20, 2019, issued by the Minister of Transport guiding the implementation of Decree No. 139/2018/NĐ-CP dated October 8, 2018, of the Government on business operations of vehicle inspection services.

The Minister of Transport shall issue a Circular to provide provisions on the cargo box of dump trucks, concrete mixer trucks, and trucks participating in road traffic.

Article 1. Scope of Regulation

1. This Circular provides for the cargo box of dump trucks, concrete mixer trucks, and trucks (hereinafter referred to collectively as vehicles) participating in road traffic.

2. This Circular does not apply to the cargo boxes of the following vehicles:

a) Vehicles produced, assembled, or imported for the purposes of national defense and security of the Ministry of Defense and the Ministry of Public Security;

b) Vehicles produced, assembled, or imported that do not participate in road traffic.

Article 2. Applicability

This Circular applies to organizations and individuals related to the importation, production, assembly, and use of vehicles; management, inspection, testing, and certification agencies of vehicles.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Dump Trucks include the following types of vehicles: Dump trucks including articulated dump trucks, push-pull trucks, and lift trucks (types Arm Roll Truck, Hook Lift Truck) with open cargo boxes; trailer dump trucks; semi-trailer dump trucks.

2. Concrete Mixer Trucks include the following types of vehicles: Concrete mixer trucks; trailer concrete mixer trucks; semi-trailer concrete mixer trucks including concrete mixer trucks carrying loose materials.

3. Trucks include the following types of vehicles: Trucks, trailer trucks, semi-trailer trucks, except for those specified in Clause 1 and Clause 2 of this Article, cargo vans, pickup trucks, specialized cargo trucks, and other cargo trucks defined in Vietnam National Standard TCVN 7271: 2003 "Road Transport Vehicles - Trucks - Classification According to Purpose of Use", specialized trailers, and semi-trailers defined in Vietnam National Standard TCVN 6211: 2003 "Road Transport Vehicles - Types - Terminology and Definitions".

4. Cargo Box includes enclosed and open cargo boxes.

5. Open Cargo Box is a cargo box designed as an open-top box; the rear and side walls of the cargo box can be opened for loading and unloading goods. An open cargo box includes covered open cargo boxes and uncovered open cargo boxes.

6. Enclosed Cargo Box is a cargo box designed as a closed box; it may have doors on the rear and side walls for loading and unloading goods.

7. Insulated Cargo Box is a closed cargo box equipped with thermal insulation material.

8. Refrigerated Cargo Box is a closed cargo box equipped with thermal insulation material and cooling equipment.

9. Apparent Density g_v is the ratio between the permissible load weight of the cargo carried by the dump truck (tons) and the cargo box volume (cubic meters).³).

10. Internal Height of the Cargo Box H_{organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.} (m) is the vertical distance between the top surface of the cargo box floor and the ceiling of the cargo box for enclosed cargo boxes and covered open cargo boxes, or the vertical distance between the top surface of the cargo box floor and the highest point of the side wall for uncovered open cargo boxes (see Illustration I in this Circular).

11. Cover includes the cover panel and frame, installed on open cargo boxes, used to cover goods.

Article 4. Provisions on the Cargo Box

1. The cargo box must have a sturdy structure, ensuring safety for transported goods, with a floor and cargo box walls at the front, sides, and rear. The cargo box must not have structures that allow the installation of parts or assemblies leading to an increase in cargo capacity. For open cargo boxes of semi-trailer trucks designed to carry goods and containers, additional container securing devices must also be arranged.

2. After installing the cargo box onto the vehicle, it must comply with the following requirements:

a) The permitted dimensions of the vehicle must comply with the provisions of National Technical Regulation QCVN 09: 2011/BGTVT "National Technical Regulations on Quality, Safety, and Environmental Protection for Trucks" and National Technical Regulation QCVN 11: 2011/BGTVT "National Technical Regulations on Quality and Safety for Trailers and Semi-trailers". Additionally, for dump trucks and trucks, the overall length of the cargo box must comply with the requirement for the overall length of the vehicle (L) as stipulated in Appendix II of this Circular.

b) The rear overhang (ROH) must not exceed 60% of the calculated wheelbase (WB) determined according to the principle set out in Appendix III of this Circular.

c) The total permissible gross weight of the vehicle and the distribution of weight on the axles after installing the cargo box must be determined according to the principle set out in Appendix III of this Circular.

d) The weight distributed to the kingpin position of the semi-trailer truck, including semi-trailer trucks carrying containers (except for semi-trailer trucks carrying containers with an overall length less than 10 meters), must ensure that it is not less than 35% of the total permissible gross weight for semi-trailer trucks with three or more axles; not less than 40% of the total permissible gross weight for semi-trailer trucks with two axles.

3. The height H

The cargo capacity of the cargo box of dump trucks is determined based on the internal geometric dimensions of the cargo box and must ensure that the apparent density g

complies with the provisions in Appendix II of this Circular._v 5. The cargo capacity of the cargo box of concrete mixer trucks must comply with the following requirements:

a) The cargo capacity of the concrete mixer truck cargo box V

(excluding the volume of loading doors) is determined based on the internal geometric dimensions of the concrete mixer truck and must not exceed the volume determined by dividing the permissible load weight of the transported goods by the specific gravity of the transported goods as stated in relevant technical documents or published by authorized agencies or organizations. In cases where the specific gravity of the transported goods varies within a range of values, the specific gravity is recorded as the average value of the range._{organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.} b) For concrete mixer trucks carrying liquefied gases that expand during transportation or loaded under certain pressure and temperature conditions, the cargo capacity is determined as follows: V

c) In cases where there are no documents describing the features and technical specifications, or where the volume capacity measurement result differs from the stated figures in the documents by more than 10%, the cargo volume of the tank truck shall be determined through actual measurement methods.

Article 5. Provisions on Canopy Covers

1. The canopy cover must be a tarpaulin.

2. Canopy frame

a) Must be designed to ensure stability and safety when the vehicle is in traffic.

b) The distance between two adjacent canopy frame beams (t) must not be less than 0.55 meters.

Article 6. Effectiveness

This Circular takes effect from November 1, 2014, and replaces Circular No. 32/2012/TT-BGTVT dated August 9, 2012, issued by the Minister of Transport regarding the size limits of cargo compartments for dump trucks, trailers, semi-trailers, tank trucks, trailer tanks, and semi-trailer tank trucks participating in road traffic.

Article 7. Transitional Provisions

1. For vehicles produced and assembled

a) Certificates of Technical Safety and Environmental Protection for vehicle models with cargo compartments that do not comply with this Circular, issued to production and assembly facilities before November 1, 2014, will cease to be valid from January 1, 2015.

b) Quality inspection certificates issued before January 1, 2015, for vehicles produced and assembled remain valid for vehicle registration procedures, technical safety inspections, and environmental protection checks.

2. For imported vehicles

a) Imported vehicles arriving at the port or customs border gate of Vietnam before January 1, 2015, but with cargo compartments that do not comply with this Circular, may still be inspected and certified according to Circular No. 31/2011/TT-BGTVT dated April 15, 2011, issued by the Minister of Transport regarding quality inspections for imported motor vehicles, and Circular No. 32/2012/TT-BGTVT dated August 9, 2012, issued by the Minister of Transport regarding the size limits of cargo compartments for dump trucks, trailers, semi-trailers, tank trucks, trailer tanks, and semi-trailer tank trucks participating in road traffic.

b) Certificates of Technical Safety and Environmental Protection for imported motor vehicles, notifications of exemption from quality inspections for imported motor vehicles, issued before January 1, 2015, for vehicles arriving at the port or customs border gate of Vietnam, remain valid for initial technical safety inspections and environmental protection checks, vehicle registration, and import procedures as stipulated by law.

3. Vehicles specified in Clause 1 and Clause 2 of this Article and those already certified for technical safety and environmental protection before November 1, 2014, but with cargo compartments that do not comply with this Circular, may continue to participate in traffic. Violations concerning load capacity will be handled according to the regulations on administrative penalties in the field of road traffic.

Article 8. Implementation organization

1. The Vietnam Vehicle Inspection Agency is responsible for organizing and implementing this Circular.

2. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director-General of the Vietnam Highway Administration, the Director of the Vietnam Vehicle Inspection Agency, the Directors of Provincial Departments of Transport under the Central Government, and the Heads of relevant agencies, organizations, and individuals are responsible for enforcing this Circular.

3. During implementation, organizations and individuals should promptly report any issues arising to the Ministry of Transport for consideration and resolution./.
