This list enumerates the specialized information technology and telecommunications products and goods that must be declared compliant with regulations in Vietnam. The products include personal computers, servers, network devices such as routers, switches, firewalls, ground digital terrestrial broadcasting signal decoders DVB-T2, PBX systems, lithium batteries for mobile devices, and many other telecommunication-related equipment. Each product has its own applicable technical standards.

CIRCULAR
REGULATIONS ON THE LIST OF PRODUCTS AND GOODS WITH POTENTIAL TO CAUSE SAFETY HAZARDS UNDER THE RESPONSIBILITY OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS
Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;
Pursuant to the Law on Telecommunications dated November 23, 2009;
Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;
Pursuant to Decree No. 25/2011/NĐ-CP dated April 6, 2011, issued by the Government, detailing and guiding the implementation of certain provisions of the Law on Telecommunications;
Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Pursuant to the proposal of the Director of the Science and Technology Department,
The Minister of Information and Communications issues this Circular to regulate the List of products and goods with potential to cause safety hazards under the responsibility of the Ministry of Information and Communications.
Article 1. Scope of Regulation
This Circular regulates the List of products and goods with potential to cause safety hazards under the responsibility of the Ministry of Information and Communications (hereinafter referred to as the List of products and goods group 2).
Article 2. Applicability
This Circular applies to:
1. Organizations and individuals engaged in production and business of products and goods listed in the List of products and goods group 2 in Vietnam.
2. Organizations and individuals involved in the quality of products and goods listed in the List of products and goods group 2 in Vietnam.
Article 3. List of Products and Goods Group 2
1. The List of products and goods group 2 and management forms are regulated as follows:
a) "List of specialized information technology and telecommunications products and goods that must be certified and declared compliant" is stipulated in Appendix I of this Circular.
b) "List of specialized information technology and telecommunications products and goods that must be declared compliant" is stipulated in Appendix II of this Circular.
2. At each period, the Ministry of Information and Communications reviews, revises, and supplements the List of products and goods group 2 in accordance with state management policies.
Article 4. Principles for managing the quality of products and goods group 2
1. The management of the quality of products and goods listed in the List of products and goods group 2 shall be carried out in accordance with Circular No. 30/2011/TT-BTTTT dated October 31, 2011, issued by the Minister of Information and Communications on regulations regarding certification and declaration of compliance for specialized information technology and telecommunications products and goods and corresponding national technical standards and regulations.
2. In case new technical standards or regulations modify, supplement, or replace existing technical standards or regulations applicable to products and goods listed in the List of products and goods group 2, the new technical standards or regulations shall be applied according to the provisions of the new technical standards and the regulations on the application of technical standards and regulations of the Ministry of Information and Communications.
Article 5. Effectiveness and Responsibility for Implementation
1. This Circular takes effect from the date October 1, 2017 and replaces Circular No. 05/2014/TT-BTTTT dated March 19, 2014, issued by the Minister of Information and Communications on regulations on the List of products and goods with potential to cause safety hazards under the responsibility of the Ministry of Information and Communications.
2. After October 1 2017, products and goods that have already completed compliance certification will continue to apply Circular No. 05/2014/TT-BTTTT dated March 19, 2014, issued by the Minister of Information and Communications on regulations on the List of products and goods with potential to cause safety hazards under the responsibility of the Ministry of Information and Communications until the expiration date on the compliance certification certificate.
3. The Director of the Office, Heads of Science and Technology Departments, Heads of agencies and units under the Ministry of Information and Communications, and related organizations and individuals are responsible for implementing this Circular.
4. During implementation, if there are difficulties or obstacles, agencies, organizations, and individuals should promptly report them to the Ministry of Information and Communications (Science and Technology Department) for consideration and resolution./.

Note:
(a) Provisions shall only apply during the validity period of the Licenses for establishing networks and providing mobile terrestrial telecommunications services using CDMA technology.
(b) Certification and declaration of conformity shall only be carried out when the equipment complies with the frequency bands and technical conditions and operational requirements specified in Circular No. 03/2012/TT-BTTTT dated March 20, 2012 of the Minister of Information and Communications on the List of Radio Equipment Exempted from Frequency Usage Licenses, Technical Conditions and Operational Requirements attached thereto.
(c) Not applicable to short-range radio transmitting and receiving equipment using spread spectrum techniques in the 2.4 GHz band and radio access equipment in the 5 GHz band.
(d) Effective from October 1, 2018. Testing and conformity assessment shall be conducted in accordance with the guidelines of the Ministry of Information and Communications.
(e) Other equipment refers to similar products not listed in the List, or equipment listed in the List but not within the scope of application of the corresponding technical standards and regulations.
