Decree No. 42/2018/ND-CP Abolishes Certain Decrees of the Government in the Banking Sector

DECREE

ABOLISHING SOME GOVERNMENTS' DECREES IN THE BANKING SECTOR

Pursuant to the Law on Government Organization dated June 19, 2015;

PURSUANTWHEREAS, pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

Pursuant to the Law on Credit Institutions dated June 16, 2010;

WHEREAS, pursuant to the Law Amending and Supplementing Certain Articles of the Law on Credit Institutions dated November 20, 2017;

At the proposal of the Governor of the State Bank of Vietnam;

THE GOVERNMENT ISSUES THIS DECREE TO ABOLISH SOME GOVERNMENTS' DECREES IN THE BANKING SECTOR.

ARTICLE 1. ABOLISH SOME GOVERNMENTS' DECREES IN THE BANKING SECTOR, INCLUDING:

1. DECREE NO. 14/CP DATED MARCH 2, 1993 OF THE GOVERNMENT ON THE REGULATIONS ON POLICIES FOR HOUSEHOLD PRODUCTION LOANS TO DEVELOP AGRICULTURE, FORESTRY, FISHERIES, AND RURAL ECONOMY.

2. DECREE NO. 48/2001/NĐ-CP DATED AUGUST 13, 2001 OF THE GOVERNMENT ON THE ORGANIZATION AND OPERATIONS OF PEOPLE'S CREDIT FUNDS.

3. DECREE NO. 69/2005/NĐ-CP DATED MAY 26, 2005 OF THE GOVERNMENT AMENDING AND SUPPLEMENTING CERTAIN ARTICLES OF DECREE NO. 48/2001/NĐ-CP DATED AUGUST 13, 2001 OF THE GOVERNMENT ON THE ORGANIZATION AND OPERATIONS OF PEOPLE'S CREDIT FUNDS.

4. DECREE NO. 22/2006/NĐ-CP DATED FEBRUARY 28, 2006 OF THE GOVERNMENT ON THE ORGANIZATION AND OPERATIONS OF FOREIGN BANK BRANCHES, JOINT-VENTURE BANKS, FOREIGN SOLELY OWNED BANKS, AND REPRESENTATIVE OFFICES OF FOREIGN CREDIT INSTITUTIONS IN VIETNAM.

5. DECREE NO. 59/2009/NĐ-CP DATED JULY 16, 2009 OF THE GOVERNMENT ON THE ORGANIZATION AND OPERATIONS OF COMMERCIAL BANKS.

6. DECREE NO. 05/2010/NĐ-CP DATED JANUARY 18, 2010 OF THE GOVERNMENT ON THE APPLICATION OF THE LAW ON BANKRUPTCY TO CREDIT INSTITUTIONS.

Article 2. Implementation Provisions

1. This Decree takes effect from July 1, 2018.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairpersons of provincial People's Committees shall be responsible for implementing this Decree./.
