On the basis of the Law amending and supplementing some provisions of the Waterway Traffic Law domestic dated June 17, 2014;

On the basis of the Maritime Code on November 25, 2015;

WHEREAS of2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;0Considering the proposal of the Director of the Department of Science and Technology and the Director General

of the Vietnam Registration Agency;inThe Minister of Transport issues this Circular to amend and supplement some Articles of Circulars in the field of inspection. Article 1. Amending, supplementing, and abolishing some Articles of Circular No. 89/2015/TT-BGTVT dated December 31, 2015 of the Minister of Transport on technical quality safety and environmental protection inspections for specialized motor vehicles (hereinafter referred to as Circular No. 89/2015/TT-BGTVT).

||| Article 2. General provisions regarding foreign non-governmental organizations operating in Vietnam (as stipulated from Article 5 to Article 15 of the Decree): "1. This Circular stipulates technical quality safety and environmental protection (hereinafter referred to as ATKT & BVMT) inspections for imported specialized motor vehicles; modifications and exploitation usage."

"This Circular applies to agencies, organizations, and individuals related to management, importation inspection; modification and exploitation usage of specialized motor vehicles."

1. Amend Clause 1 of Article 1 as follows:

"Article 3. Explanation of terms Some terms and technical standards and regulations used in this Circular include:

Specialized motor vehicle (hereinafter referred to as Vehicle) includes types of vehicles listed in National Standard TCVN 7772:2007 "Vehicles, Machines and Mobile Construction Equipment - Classification" and types of Vehicles specified in Circular No. 39/2016/TT-BGTVT dated December 6, 2016 of the Minister of Transport on the List of Products and Commodities with Potential Safety Hazards under the Management Responsibility of the Ministry of Transport.

3. Amend Article 3 as follows:

2. Same type of Vehicle refers to Vehicles of the same industrial owner, brand, design, basic technical parameters, and country of manufacture.

3. Quality certificate means one of the following documents: Notification of Exemption from Technical Quality Safety and Environmental Protection Inspection for Imported Vehicles (hereinafter referred to as Notification of Exemption), Certificate of Technical Quality Safety and Environmental Protection for Imported Vehicles (hereinafter referred to as Quality Certificate); Notification of Non-Conformity with Technical Quality Safety and Environmental Protection Standards for Imported Vehicles (hereinafter referred to as Non-Conformity Notification); Certificate of Design Approval for Modifications; Certificate of Technical Quality Safety and Environmental Protection for Modified Vehicles.

4. Certificate of Technical Quality Safety and Environmental Protection for Vehicles in Exploitation Usage (hereinafter referred to as Certificate CNAT) is a certificate confirming that the Vehicle has been inspected and meets the technical standards, regulations, and requirements for technical quality safety and environmental protection.

5. Technical Quality Safety and Environmental Protection Inspection Label for Vehicles in Exploitation Usage (hereinafter referred to as Inspection Label) is a symbol issued to Vehicles that have been granted a Certificate CNAT and are permitted to participate in road traffic according to the validity period indicated on the Inspection Label.

6. Importer is an organization or individual importing Vehicles.

7. Design approval for modifications is the examination and verification of the contents of the product design files against current technical standards, regulations, and requirements to ensure that modified products meet the quality technical safety and environmental protection requirements.

8. Vehicle Technical Quality Safety and Environmental Protection Inspection Units in Exploitation Usage (hereinafter referred to as Inspection Units) are Motor Vehicle Registration Centers and Branches with sufficient material conditions, equipment, and human resources to conduct Vehicle inspections in accordance with regulations and publicly announced on the website of the Vietnam Registration Agency.

9. Vehicle Owner is an organization or individual owning the Vehicle; driver or person bringing the Vehicle for inspection.

10. National technical standards, standards, and permissible measurement errors used in this Circular:

a) QCVN 13: 2011/BGTVT: National technical standard on technical quality safety and environmental protection for specialized motor vehicles;

b) QCVN 22: 2010/BGTVT: National technical standard on manufacturing and inspecting transportation equipment and handling devices;

c) QCVN 12: 2011/BGTVT National technical standard on permissible errors and rounding for dimensions and weight of motor vehicles; permissible errors and rounding for dimensions and weight of Vehicles applied similarly to specialized motor vehicles;

d) TCVN 7772: National standard on Mobile Construction Equipment, Vehicles, and Machines - Classification;

e) TCVN 4244: National standard on Lifting Equipment, Design, Manufacturing, and Technical Inspection.

4. Abolish point b and point c Clause 1 Article 4.

"4. Within four working days from the date of completion of the actual Vehicle inspection and receipt of all required documents, the Vietnam Registration Agency shall issue a Quality Certificate."

6. Abolish point a Clause 1 Article 6.

"4. Announcing specific information on the website of the Vietnam Maritime Administration regarding the address and account of the ship registration authority for organizations and individuals to submit applications through postal services and pay fees and charges according to regulations via bank transfer services."

7. Abolish Clause 3 Article 7.

8. Abolish Chapter III.

9. Amend Clause 3 Article 18 as follows:

"3. Time limit for issuing Modification Certificate: Within three working days from the date the modified Vehicle is accepted and meets the requirements."

10. Amend Clause 4 Article 21 as follows:

"4. Issuance of Certificate CNAT, Inspection Label

a) Vehicles inspected and found compliant with the regulations shall be issued: Certificate CNAT and Inspection Label according to the model prescribed in Appendix XXII and Appendix XXIII attached to this Circular. Certificate CNAT and Inspection Label shall be printed from the Specialized Motor Vehicle Management software;

b) The validity period of Certificate CNAT and Inspection Label as stipulated in point a of this clause is twelve months. Certificate CNAT and Inspection Label must have the same serial number;

a) Vehicles that meet the requirements for inspection according to the regulations shall be issued with: Certificate of Conformity and Inspection Sticker in accordance with the models prescribed in Appendix XXII and Appendix XXIII attached to this Circular. The Certificate of Conformity and Inspection Sticker shall be printed from the Motorcycle Management Software;

b) The validity period of the Certificate of Conformity and Inspection Sticker prescribed in point a of this clause is twelve months. The Certificate of Conformity and Inspection Sticker must have the same serial number;

c) The Certificate of Conformity (CNAT) and Inspection Label prescribed in point a of this clause shall become invalid when: The content of the CNAT does not match the actual technical specifications of the vehicle; A new CNAT has been issued for the vehicle; The owner has reported the loss of the vehicle; There has been a notice of recall from inspection units; The vehicle has been involved in an accident to the extent that it no longer meets safety and environmental protection standards; It has been damaged or torn.

d) In case the CNAT and Inspection Label issued under point a of this clause are lost or damaged, they will only be reissued after the vehicle has been inspected and meets the requirements stipulated in Article 20 of this Circular. When there is a change of ownership or a transfer of regions, the CNAT and Inspection Label remain valid within their period of validity.

11. Amend Article 23 as follows:

"Article 23. Responsibilities of the Vietnam Vehicle Registration Bureau

The Vietnam Vehicle Registration Bureau is the management agency responsible for organizing and implementing inspections, testing, and certifying the quality of safety and environmental protection of imported vehicles, modified vehicles, and operational vehicles. The Vietnam Vehicle Registration Bureau is responsible for:

1. Implementing and enforcing this Circular.

2. Developing software programs for managing vehicles during importation, modification, and operation, uniformly printing, managing blank CNAT certificates, inspection labels, and quality certificates as prescribed in this Circular."

12. Amend Article 27 as follows:

"Article 27. Responsibilities of Modification Facilities

1. Adhere to technical standards and current regulations when modifying vehicles and bear responsibility for the quality of the modified products.

2. Modification records must be stored for at least two years from the date the Vietnam Vehicle Registration Bureau issues the Modification Certificate."

13. Repeal Article 30.

14. Replace Appendix I attached to Circular No. 89/2015/TT-BGTVT with Appendix I attached to this Circular.

15. Repeal Appendices VIII, IX, X, XI, XII, XIII, XIV, and Appendix XXI of Circular No. 89/2015/TT-BGTVT.

Article 2. Amend and supplement some Articles of Circular No. 85/2014/TT-BGTVT dated December 31, 2014, of the Minister of Transport on the modification of road motor vehicles (hereinafter referred to as Circular No. 85/2014/TT-BGTVT)

1. Amend Clause 4 of Article 4 as follows:

"4. Vehicles other than passenger vehicles shall not be modified into passenger vehicles and vice versa, except for passenger vehicles with up to 16 seats (including the driver's seat) which can be modified into special purpose vehicles or light trucks."

2. Amend point c of Clause 5 of Article 7 as follows:

"c) The design approval authority conducts design approval according to the regulations: If the design meets the requirements, the design approval authority shall issue a Design Approval Certificate within five working days from the date of receipt of complete design documents. If the design is not approved, the design approval authority shall notify the organization or individual in writing and specify the reasons within two working days from the date of the approval result;"

3. Repeal Clause 6 of Article 12.

Article 3. Amend, supplement, and repeal some Articles of Circular No. 86/2014/TT-BGTVT dated December 31, 2014, of the Minister of Transport on conditions for four-wheeled motorized vehicles carrying passengers to participate in traffic within limited areas (hereinafter referred to as Circular No. 86/2014/TT-BGTVT)

1. Repeal point b of Clause 1 of Article 10.

2. Amend and supplement Clause 1 and Clause 2 of Article 12 as follows:

"1. The importing entity shall prepare one set of registration inspection documents in accordance with Clause 1 of Article 10 of this Circular and submit them to the Vietnam Vehicle Registration Bureau either directly, through postal services, or via the National Single Window Portal.

2. The Vietnam Vehicle Registration Bureau shall accept and review the contents of the registration inspection documents and provide feedback to the importing entity within a maximum of one working day. If the registration inspection documents are complete as required, the Vietnam Vehicle Registration Bureau shall confirm the Registration Inspection Form. If the registration inspection documents are incomplete, the Vietnam Vehicle Registration Bureau shall guide the importing entity to supplement and perfect the documents.

The Vietnam Vehicle Registration Bureau shall coordinate with the importing entity regarding the time and location of the inspection. The inspection period shall not exceed five working days from the date of the importing entity's request for inspection."

3. Replace Appendix VI of Circular No. 86/2014/TT-BGTVT with Appendix II attached to this Circular.

4. Supplement Clause 8 of Article 25 as follows:

"8. Store the retention copy of the Quality Inspection Report and product quality inspection files for a minimum of three years from the date of vehicle production. When destroying these documents, the production facility must ensure data retrieval for recall purposes."

Article 4. Amend, supplement, and abolish certain Articles of Circular No. 31/2011/TT-BGTVT dated April 15, 2011, issued by the Minister of Transport on the inspection of vehicle quality, safety technical standards, and environmental protection for imported motor vehicles (hereinafter referred to as Circular No. 31/2011/TT-BGTVT).

1. Abolish the certified copy of import documents including: Commercial invoices or equivalent documents; and the customs declaration form in the registration application for inspection as stipulated in Point b, Clause 1, Article 6 of Circular No. 31/2011/TT-BGTVT (amended at Clause 2, Article 1 of Circular No. 55/2014/TT-BGTVT).

2. Amend and supplement Points a and b, Clause 1, Article 10 as follows:

"a) The importer shall prepare one set of registration application documents in accordance with Article 6 of this Circular and submit them to the Inspection Authority either directly, through postal service, or via the National Single Window Portal.

b) The Inspection Authority shall accept and review the contents of the registration application for inspection and notify the importer of the results within a maximum of one working day. If the registration application for inspection is complete as required, the Inspection Authority shall confirm it on the Registration Application Form. If the registration application for inspection is incomplete as required, the Inspection Authority shall guide the importer to supplement and perfect it.

The Inspection Authority shall agree with the importer on the time and location for inspection. The inspection period shall not exceed five working days from the date the importer requests the inspection."

3. Amend Point b, Clause 3, Article 10 as follows:

"b) For issuing the quality certificate: within four working days from the completion of the inspection of imported motor vehicles meeting the requirements and receiving all necessary documents as prescribed."

4. Replace Appendix I of Circular No. 31/2011/TT-BGTVT with Appendix III promulgated together with this Circular.

Article 5. Amend, supplement, and abolish certain Articles of Circular No. 41/2013/TT-BGTVT dated November 5, 2013, issued by the Minister of Transport on the inspection of electric bicycle quality, safety technical standards (hereinafter referred to as Circular No. 41/2013/TT-BGTVT).

1. Abolish Point b, Clause 2, Article 5.

2. Amend Point c, Clause 1, Article 8 as follows:

"c) Within ten working days from the date of receipt of all required documents, the Quality Control Authority shall examine the contents of the registration application and conduct the COP assessment in accordance with Article 6 of this Circular. If the requirements are not met, the Quality Control Authority shall notify the manufacturer to improve; if the requirements are met, the Quality Control Authority shall issue the Certificate according to the model specified in Appendix IIIa promulgated together with this Circular within three working days from the completion of the inspection and assessment meeting the requirements."

3. Amend Points a, b, and c, Clause 2, Article 8 as follows:

"a) The importer shall prepare one set of registration application documents in accordance with Clause 2, Article 5 of this Circular and submit them to the Quality Control Authority either directly, through postal service, or via the National Single Window Portal.

b) The Quality Control Authority shall accept and review the contents of the registration application for inspection and notify the importer of the results within a maximum of one working day. If the registration application for inspection is complete as required, the Quality Control Authority shall confirm it on the Registration Application Form. If the registration application for inspection is incomplete as required, the Quality Control Authority shall guide the importer to supplement and perfect it.

The Quality Control Authority shall agree with the importer on the time and location for inspection. The inspection period shall not exceed five working days from the date the importer requests the inspection.

c) The Quality Control Authority shall conduct the inspection and review the test results of the vehicle in accordance with Article 7 of this Circular. If the requirements are not met, within four working days from the completion of the inspection, the Quality Control Authority shall notify the importer to rectify; if the importer does not take corrective measures within thirty days from the notification date, the Quality Control Authority shall notify non-compliance with the import quality requirements according to the model specified in Appendix IIIc promulgated together with this Circular. If the requirements are met, the Quality Control Authority shall issue the Certificate according to the model specified in Appendix IIIb promulgated together with this Circular within four working days from the date of obtaining the satisfactory inspection results."

4. Replace Appendix II of Circular No. 41/2013/TT-BGTVT with Appendix IV promulgated together with this Circular.

Article 6. Amend and supplement some Articles of Circular No. 44/2012/TT-BGTVT dated October 23, 2012, issued by the Minister of Transport on quality and technical safety inspection and environmental protection for imported motorcycles and engines used to produce and assemble motorcycles (hereinafter referred to as Circular No. 44/2012/TT-BGTVT).

1. Repeal Point b Clause 1 Article 4.

2. Amend Clause 1 and Clause 2 Article 6 as follows:

"a) Organizations and individuals importing shall prepare one set of registration files for inspection in accordance with Article 4 of this Circular and submit them to the Inspection Authority through direct submission, postal service, or the National Single Window Portal.

b) The Inspection Authority shall receive and review the contents of the registration files for inspection and notify organizations and individuals importing of the results within a maximum of one working day. If the registration files for inspection are complete in accordance with regulations, the Inspection Authority shall confirm on the Registration Form for Inspection. In case the registration files for inspection are incomplete, the Inspection Authority shall guide organizations and individuals importing to supplement and perfect the files.

The Inspection Authority shall agree with organizations and individuals importing on the time and location for inspection. The inspection period shall not exceed five working days from the date of the request for inspection by organizations and individuals importing."

3. Amend Point a and Point b Clause 3 Article 6 as follows:

"3. The Inspection Authority shall conduct inspections of imported vehicles and engines at the agreed location with organizations and individuals importing. Within four working days from the end of the inspection and upon receipt of all required files, the Inspection Authority shall issue a Certificate of Quality or a Notification of Non-Conformity as follows:

a) For vehicles and engines that meet quality requirements and have complete files in accordance with regulations, the Inspection Authority shall issue an Import Quality Certificate according to the corresponding model attached in Appendix IVa and IVb of this Circular.

During the inspection process, if the Inspection Authority receives official information from vehicle manufacturers or foreign authorities regarding recalls (recall) to repair defects, the Inspection Authority shall only issue an Import Quality Certificate after organizations and individuals importing provide a commitment letter accompanied by a confirmation letter from the manufacturer or authorized repair facilities stating that the imported vehicle has completed repairs and meets safety standards.

b) For vehicles and engines that do not comply with current national technical standards, the Inspection Authority shall notify organizations and individuals importing to rectify the issues within thirty days from the notification date. Beyond this period, if organizations and individuals importing fail to take corrective measures, the Inspection Authority shall issue a Notification of Non-Conformity for Importation according to the corresponding model attached in Appendices Va and Vb of this Circular."

4. Replace Appendix I of Circular No. 44/2012/TT-BGTVT with Appendix V issued together with this Circular.

Article 7. Amend and supplement some Articles of Circular No. 45/2012/TT-BGTVT dated October 23, 2012, issued by the Minister of Transport on quality and technical safety inspection and environmental protection during production and assembly of motorcycles (hereinafter referred to as Circular No. 45/2012/TT-BGTVT).

1. Amend Clause 3 of Article 7 as follows:

"3. The Supervisory Authority shall inspect the contents of the files and conduct a COP assessment in accordance with Clause 2 Article 6 of this Circular: If the requirements are not met, it shall notify the Production Facility to perfect the files; If the requirements are met, within four days from the date when the registration files are complete in accordance with regulations and the COP assessment results meet the requirements, the Supervisory Authority shall issue a Certificate for the product type according to the corresponding model stipulated in Appendix VIIa and VIIb issued together with this Circular."

2. Supplement Clause 4 Article 16 as follows:

"4. Retain the record section of the Quality Control Certificate and the quality inspection files of products for a minimum of three years from the date of vehicle shipment. When destroying these documents, the Production Facility must ensure data retrieval for recall purposes."

Article 8. Amending and supplementing some Articles of Circular No. 16/2014/TT-BGTVT dated May 13, 2014 of the Minister of Transport on conditions for four-wheeled motorized vehicles carrying goods to participate in road traffic (hereinafter referred to as Circular No. 16/2014/TT-BGTVT).

1. Amend Clause 3 of Article 7 as follows:

"3. Within ten working days from the date of receiving all required documents, the Vietnam Vehicle Inspection Center shall examine the content of the registration certification application and conduct a COP assessment in accordance with Clause 2, Article 6 of this Circular. If the requirements are not met, it shall notify the production facility to complete the process; if the requirements are met, it shall issue the Certificate according to the model specified in Appendix VIIa and VIIb attached to this Circular within three working days from the end of the examination and assessment meeting the requirements."

2. Supplement Clause 6 of Article 21 as follows:

"6. Store the retention part of the Quality Control Certificate for a minimum of three years from the date of vehicle production. When destroying these documents, the production facility must ensure data retrieval for recall purposes."

Article 9. Amending and supplementing some Articles of Circular No. 49/2015/TT-BGTVT dated September 22, 2015 of the Minister of Transport on standards, duties, and authorities of leaders, inspectors, and technical staff of inland waterway vessel inspection units (hereinafter referred to as Circular No. 49/2015/TT-BGTVT).

1. Amend Point c Clause 1 of Article 5 as follows:

"c) Hold a college degree or higher in one of the following fields: marine vessel control, internal combustion engines, ship electrical systems, mechanical engineering, power mechanics, automotive mechanics, and have received additional general training in marine engine or hull technology according to Program 1 or Program 3 stipulated in Section III of Appendix I of this Circular."

2. Amend Clause 3 of Article 5 as follows:

"3. The duration of practical training at the inspection unit is as follows:"

a) For those with qualifications as specified in Points a and b of Clause 1 of this Article, they shall perform tasks as prescribed in Point a of Clause 2 of Article 11: a minimum of 24 months for those with a college or associate degree, or 12 months for those with a bachelor's degree or higher.

b) For those with qualifications as specified in Point c of Clause 1 of this Article, they shall perform tasks as prescribed in Point b of Clause 2 of Article 11: a minimum of 12 months."

3. Amend Point b Clause 4 of Article 27 as follows:

"b) In the case of requesting recognition of promotion of inspector rank as stipulated in Clause 3 of this Article, the procedures for such requests shall be carried out in accordance with Points a, b, and c of Clause 3 of Article 23 and Article 24 of this Circular."

4. Amend Clause 1 of Article 33 as follows:

"1. The Vietnam Vehicle Inspection Center shall organize a review of inspectors currently holding ranks under Decision No. 2687/2000/QĐ-BGTVT who have conducted inspections in accordance with Article 11 of Decision No. 25/2004/QĐ-BGTVT, to recognize inspectors in accordance with the ranks of inspectors performing inspection work as prescribed in Circular No. 49/2015/TT-BGTVT as follows:"

"a) Inspectors recognized under Decision No. 2687/2000/QĐ-BGTVT who have conducted inspections of vessels equivalent to the size and type of vessels within the scope of work of inspectors performing inspection work as prescribed in Clause 2 of Article 12 of Circular No. 49/2015/TT-BGTVT will be recognized as inspectors performing inspection work corresponding to Rank II of Circular No. 49/2015/TT-BGTVT; those who have conducted inspections of vessels equivalent to the size and type of vessels within the scope of work of inspectors performing inspection work as prescribed in Clause 2 of Article 13 of Circular No. 49/2015/TT-BGTVT will be recognized as inspectors performing inspection work corresponding to Rank I of Circular No. 49/2015/TT-BGTVT. Inspectors recognized under this clause are exempted from the requirements stipulated in Clauses 3 and 5 of Article 6 or Clauses 3 and 5 of Article 7 of Circular No. 49/2015/TT-BGTVT.

b) Inspectors recognized under Decision No. 2687/2000/QĐ-BGTVT who are over 50 years old as of October 1, 2018, and have graduated from a college or associate degree in marine vessel or engine technology will be recognized as inspectors performing inspection work corresponding to Ranks I and II of Circular No. 49/2015/TT-BGTVT and are exempted from the requirements stipulated in Clause 1 of Article 6 and Clause 1 of Article 7 of Circular No. 49/2015/TT-BGTVT.

c) Inspectors over 50 years old who are currently holding Ranks I and II and design approval inspectors as of October 1, 2018, are exempted from language certificates when considering transfer.

d) The review and recognition must be completed before December 31, 2019."

Article 10. Effective Date

1. This Circular takes effect from October 15, 2018.

2. The Director of the Ministry's Office, the Chief Inspector of the Ministry, the Heads of Departments, the Director of the Vietnam Registration Agency, the Heads of agencies, organizations, and individuals related to this matter are responsible for enforcing this Circular./.
