CIRCULAR

Amending and supplementing some articles of Circular No. 34/2019/TT-BCT dated November 28, 2019 of the Minister of Industry and Trade regarding the Energy Information Systemprovisions on the Energy Information System

                                       

Pursuant to the Law on Rational and Efficient Use of Energy dated June 28, 2010, amended and supplemented by some articles of Law No. 28/2018/QH14 dated June 15, 2018;

Pursuant to the Law on Statistics dated November 23, 2015; Law amending and supplementing some articles and the National Statistical Indicators Appendix of the Law on Statistics No. 89/2015/QH13; Law amending and supplementing some articles and the National Statistical Indicators Appendix of the Law on Statistics No. 01/2021/QH15 dated November 12, 2021;

Pursuant to Decree No. 96/2022/NĐ-CP dated November 29, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade; Decree No. 105/2024/NĐ-CP dated August 1, 2024 of the Government amending and supplementing some articles of Decree No. 96/2022/NĐ-CP dated November 29, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 21/2011/ND-CP dated March 29, 2011, issued by the Government, detailing and providing measures to implement the Law on Rational and Efficient Energy Use;

Pursuant to Decree No. 09/2019/NĐ-CP dated January 24, 2019 of the Government on the reporting system of administrative agencies;

At the proposal of the Director of the Electricity and Renewable Energy Department;

The Minister of Industry and Trade issues this Circular amending and supplementing some articles of Circular No. 34/2019/TT-BCT dated November 28, 2019 stipulating the Energy Information System.

Article 1. Amending and supplementing some articles of Circular No. 34/2019/TT-BCT dated November 28, 2019 stipulating the Energy Information System

1. Amending Clause 2 of Article 6 as follows:

"2. Energy information is collected periodically and urgently, including:

a) Quarterly Report (3 months): Conducted quarterly. The data collection period for each quarter runs from the first day of the quarter to the last day of the quarter; the report must be submitted before the 15th day of the first month of the next quarter; the report format shall comply with point b, Clause 3, Article 7 of this Circular.

b) Annual Report: Conducted annually, the data collection period runs from January 1 to December 31; the report format shall comply with Clause 3, Article 7 of this Circular.

c) Urgent Report: Conducted when there is an urgent requirement to serve state management."

2. Amending Point b of Clause 3 of Article 7 as follows:

"b) Electronic document sent to the electronic reporting software system at the energy information system website www.veis.gov.vn or via email [email protected]."

3. Amending Clause 1 of Article 9 as follows:

"1. Energy information is collected based on surveys conducted by the lead unit according to plans to supplement necessary information that has not been collected as prescribed in Articles 7 and 8 of this Circular."

4. Amend Article 11 as follows:

a) Amending Point đ of Clause 1 as follows:

"đ) Comprehensive energy statistics indicators: primary energy supply, primary energy intensity, total energy supply; degree of dependence on imported energy in total primary energy supply; degree of energy diversification, share of fuel in primary energy supply;"

b) Amend Clause 2 as follows:

"2. Energy information is published on the energy information system website at www.veis.gov.vn."

5. Amending and supplementing Article 15 as follows:

a) Supplementing Points đ and e of Clause 1 as follows:

"đ) Develop investigation and statistical plan for energy information and data, along with the draft investigation and statistical plan for review by the Department of Planning and Finance; explain the review comments of the central statistical agency;

e) Fulfill the responsibilities of the investigating and statistical agency as prescribed by the Law on Statistics."

b) Supplement Clause 1a after Clause 1 as follows:

"1a. Department of Planning and Finance

a) Review the investigation and statistical plan for energy information;

b) Send the investigation and statistical plan for energy information to the central statistical agency for review;

c) Take the lead and coordinate with relevant units under the Ministry to organize the review of the results of the investigation and statistical plan for energy information."

6. Amending Article 16 as follows:

"Article 16. Responsibilities of Provincial Departments of Industry and Trade

Provincial Departments of Industry and Trade (or specialized agencies assigned by provincial People's Committees) are responsible for directing, urging, and requiring organizations and individuals related to provide information and submit reports as prescribed in Forms 5.1 to 5.8 of Appendix V, Form 1.17 of Appendix I, and Forms 2.1 to 2.6 of Appendix II issued together with this Circular and send them to the Ministry of Industry and Trade for consolidation."

7. Amending and supplementing Article 17 as follows:

a) Amend Clause 1 as follows:

"1. Vietnam Electricity Corporation shall submit reports as prescribed in Forms 1.6 to 1.16 of Appendix I issued together with this Circular."

b) Supplement Clause 1a after Clause 1 as follows:

"1a. National Power System Operation and Electricity Market Company Limited (NSMO) shall submit reports as prescribed in Forms 1.2, 1.3, 1.4, 1.5, and 1.6a of Appendix I issued together with this Circular."

c) Amend Clause 2 as follows:

"2. Non-Vietnam Electricity Corporation power generation units shall submit reports as prescribed in Forms 1.17 to 1.18 of Appendix I issued together with this Circular."

d) Supplementing Clause 2a after Clause 2 as follows:

"2a. Project investors of power sources, transmission networks, and other energy projects currently in the construction phase shall submit reports as prescribed in Form 6 of Appendix VI issued together with this Circular."

đ) Amending Clause 3 as follows:

"3. Coal exploitation organizations shall submit reports as prescribed in Forms 2.2, 2.3, and 2.6 of Appendix II issued together with this Circular; coal trading organizations shall submit reports as prescribed in Forms 2.4 and 2.5 of Appendix II issued together with this Circular."

e) Amending Clause 9 as follows:

"9. Vietnam Oil and Gas Group and key oil and gas trading enterprises shall submit reports as prescribed in Forms 4.1 to 4.2 of Appendix IV issued together with this Circular."

g) Supplementing Clause 10 as follows:

"10. Units prescribed in Clause 2a of this Article shall follow the reporting system as prescribed in point a and point c of Clause 2 of Article 6 of this Circular."

h) Supplementing Clause 11 as follows:

"11. The units specified from Clause 1 to Clause 9 (excluding the cases provided for in Clause 2a of this Article) shall implement the reporting regime prescribed in Point b and Point c of Clause 2 of Article 6 of this Circular."

8. Amend and supplement Article 20 as follows:

"Article 20. Responsibilities for Implementation

1. During the implementation of this Circular, if there are difficulties or obstacles, they should be promptly reflected to the Ministry of Industry and Trade for study and resolution.

2. The Electricity and Renewable Energy Department shall be responsible for urging, guiding the implementation of this Circular; receiving reflections; studying and resolving according to its authority or reporting to the Ministry's leadership for resolution of difficulties and obstacles during the implementation of this Circular."

Article 2. Amend and supplement some forms attached to Circular No. 34/2019/TT-BCT dated November 28, 2019 on the energy information system.

1. Amend and supplement Appendix I as follows:

a) Amend the forms:

- Form 1.2. Design capacity and available capacity of power plants in the power system;

- Change the title of Form 1.4 to: "Incident rate of power plants in the power system";

- Form 1.5. Monthly electricity production volume of power plants in the power system;

- Form 1.13. Fuel consumption data for coal-fired power plants during the period.

b) Supplement the forms:

- Form 1.6a. Typical daily load profile by season of the system;

- Form 1.7a. Length of transmission lines by province and centrally governed city;

- Form 1.7b. Length of 110kV transmission lines by province and centrally governed city;

- Form 1.8a. Number of transmission substations by province and centrally governed city;

- Form 1.8b. Number of 110kV substations by each province and centrally governed city;

- Form 1.8c. Data on electricity import and export during the period;

- Form 1.18. Information on new power plants.

2. Amend and supplement Appendix II as follows:

a) Amend the forms:

- Form 2.1. Summary report form for the coal industry;

- Form 2.2. Coal production volume and losses;

- Form 2.4. Coal consumption by type and demand;

b) Supplement the forms:

- Form 2.5. Data on coal import and export situation during the period;

- Form 2.6. Report on the implementation of planning for coal exploration and mining projects.

3. Amend Appendix III as follows:

Amend Form 3.2. Oil and gas exploitation and import/export.

4. Amend and supplement Appendix IV as follows:

Replace Form 4 with Form 4.1 and Form 4.2

a) Form 4.1. Data on exports, imports, and stock levels of petroleum products of main petroleum trading companies;

b) Form 4.2. Domestic consumption of petroleum products.

5. Amend and supplement Appendix V as follows:

a) Amend the forms:

- Form 5.4. Solar power plants in the area (excluding rooftop solar power projects);

- Amend Form 5.7. Power plants using solid waste in the area;

b) Supplement the forms:

- Form 5.4a. Data on rooftop solar power projects in the area;

- Form 5.8. Data on electric vehicle charging stations in the area.

6. Supplement Appendix VI as follows:

Form 6. Report on the implementation of planning for power generation projects, grid projects, and other energy projects.

Article 3. Implementation Provisions

1. This Circular takes effect from March 1, 2025.

2. In case the agencies and units specified in Articles 15, 16, and 17 of Circular No. 34/2019/TT-BCT dated November 28, 2019 on the energy information system change their names or organizational structure (merger), the new agency or unit shall be responsible for performing the assigned tasks under the Circular on the Energy Information System.
