JOINT CIRCULAR
Guidelines for Implementing Decision No. 47/2002/QD-TTg dated April 11, 2002 of the Prime Minister on the treatment of military personnel, defense workers who participated in the anti-French resistance war and were discharged (demobilized, retired) before December 31, 1960
Joint Circular No. 104/TTLT-BQP-BTC dated August 1, 2002 of the Ministry of National Defense and the Ministry of Finance guiding the implementation of Decision No. 47/2002/QD-TTg dated April 11, 2002 of the Prime Minister on the treatment of military personnel, defense workers who participated in the anti-French resistance war and were discharged (demobilized, retired) before December 31, 1960 has been amended and supplemented by:
Circular No. 103/2025/TT-BQP dated September 26, 2025 of the Minister of National Defense amending joint circulars, circulars, and decisions of the Minister of National Defense in the field of policy.
Implementing Decision No. 47/2002/QD-TTg dated April 11, 2002 of the Prime Minister on the treatment of military personnel (QN), defense workers (CNVQP) who participated in the anti-French resistance war and were discharged (demobilized, retired) before December 31, 1960; after receiving unified opinions from the Central Organization Commission at Document No. 1337 CV/TCTW dated June 5, 2002, the Ministry of Labor - Invalids and Social Affairs at Document No. 2373/LDTBXH-TL dated July 19, 2002, the Central Cadre and Civil Servant Administration at Document No. 79/BTCCBCP-TL dated July 4, 2002, and the Vietnam Association of War Invalids and Families at Document No. 202/CV-CCB dated June 21, 2002, the Joint Ministry of National Defense - Finance guides the implementation as follows [1] :
I. SUBJECTS AND CONDITIONS
1. Subjects and conditions for application:
Military personnel (main force troops, local troops), defense workers belonging to military agencies and units who joined the anti-French resistance war and were recruited into the army from December 22, 1944 to before July 20, 1954, were discharged (demobilized, retired) before December 31, 1960, not entitled to monthly pension or disability allowance or veteran benefits under Decree No. 500/NĐ-LB dated November 12, 1958 of the Joint Ministry of Social Relief - Finance - National Defense and Decree No. 523/TTg dated December 6, 1958 of the Prime Minister, and fall into one of the following cases:
a) Military personnel, defense workers who were injured, or had poor health, or faced difficult family circumstances, or did not have the need to be retained by their unit and were sent home before July 20, 1954;
b) Military personnel, defense workers whose numbers were reduced after July 20, 1954 (including those captured by the enemy and later released and granted discharge);
c) Military personnel, defense workers who transferred to economic work or other jobs and retired before December 31, 1960;
d) Military personnel, defense workers in the South, who were sent home by their unit before the unit moved north according to the Geneva Agreement (1954), and subsequently did not continue to operate or continued to evade operations but were discharged or retired in the South before April 30, 1975 without enjoying monthly pension, disability allowance, or veteran benefits (the time counted for benefit is the actual service time in the military from before July 20, 1954).
The subjects specified in Points a, b, c, and d above who have received or are currently receiving one-time or monthly allowances such as: Disability allowance for wounded veterans, allowance for relatives of martyrs; preferential allowance for heroes; allowance for people active in the revolution before August 1945; imprisonment allowance; allowance for contributors to the revolution; monthly occupational injury allowance; participation in resistance allowance; living expenses for village, town, and township cadres while working or after retirement still enjoy the benefits stipulated in this Circular.
If the subjects mentioned above have passed away, their surviving spouse shall receive the allowance. If the surviving spouse has also passed away, the legal heir shall receive the allowance in the following order:
- Father, mother, adoptive father, adoptive mother, biological child, adopted child of the deceased person (first order heirs);
- Grandfather, grandmother, paternal grandfather, paternal grandmother, brother, sister, younger brother, younger sister of the deceased person (second order heirs);
- Uncle, aunt, uncle, aunt, cousin of the deceased person; nephew or niece of the deceased person if the deceased person was an uncle, aunt, uncle, aunt, or cousin (third order heirs).
(Each order of heirs is represented by one person authorized by the members of that order. A representative from a subsequent order can only claim benefits if there is no representative from a prior order.)
2. Subjects and conditions not applicable:
a) Subjects specified in Clause 1, Section I above, who after being discharged (demobilized, retired) re-enlisted, recruited into the military or continued to evade work and were discharged, retired in the North after December 31, 1960 and in the South after April 30, 1975;
b) Those who deserted or left the military, recorded in their personal history or notified by a battalion-level or higher authority or listed in the desertion records stored at the military district (city) office;
c) Subjects who, after being discharged, retired, joined the puppet army or puppet government at the village level or higher in the South; or did not join the puppet army or puppet government at the aforementioned level but cooperated with the enemy, causing damage to the revolution;
d) Subjects currently serving a prison sentence;
đ) People captured by the enemy who surrendered, betrayed, confessed, recorded in their personal history or listed in the management files of competent authorities in the military;
e) Subjects who have passed away but have no legal heirs.
Those who enjoy pensions, veteran benefits, disability allowances, militia, self-defense forces, youth volunteers, fireline civilians, and wartime civilians do not belong to the subjects defined in this Circular.
II. BENEFITS ENJOYED
1. Principles for Calculation:
a) The period for enjoying the benefit is the actual time served in the military from December 22, 1944 to December 31, 1960, where the enlistment date or recruitment date of the soldier or civilian employee must be before July 20, 1954, and discharge (demobilization, resignation) must be on or before December 31, 1960.
b) Within the period from December 22, 1944 to December 31, 1960, if the soldier or civilian employee has interrupted service time, the actual time served in the military will be accumulated to calculate the benefit.
2. Method of Enjoyment:
a) Calculation Formula:
The period for enjoying the benefit is determined according to the following formula:
| Total number of years counted for enjoyment | = | Total number of months counted for enjoyment divided by 12 months |
When calculating time according to the above formula, if there is a fractional month, six months or more are counted as one year, less than six months are counted as half a year.
b) Calculation Method:
- Calculated based on the actual years of service in the military of the subject, each year entitles to 420,000 VND (four hundred twenty thousand dong).
Example 1: Mr. Nguyen Van A was enlisted in January 1946 and discharged in June 1958. The amount of benefit is as follows:
+ Time of service counted for enjoyment of benefits = 12 years 6 months, rounded up to 13 years
+ One-time allowance amount: 420,000 VND/year ' 13 years = 5,460,000 VND.
Example 2: Mr. Pham Van B was enlisted in November 1947 and discharged in October 1949 due to illness, allowed to take long-term leave at home; re-enlisted in August 1954 and demobilized in December 1958. The amount of benefit is as follows:
+ Time of service counted for enjoyment of benefits = 2 years (first term) + 4 years 5 months (second term) = 6 years 5 months, counted as 6.5 years;
+ One-time allowance amount: 420,000 VND/year ' 6.5 years = 2,730,000 VND.
- For subjects with a service time in the military of two years or less, the benefit level is unified at 840,000 VND (eight hundred forty thousand dong).
Example 3: Mr. Tran Van C was enlisted in January 1950 and discharged in March 1951 due to illness. The amount of benefit is as follows:
+ Time of service counted for enjoyment of benefits: from January 1950 to March 1951 is 1 year 3 months (less than 2 years)
+ Amount received: 840,000 VND
- For subjects who passed away before May 1, 2002 (before the effective date of Decision No. 47/2002/QD-TTg dated April 11, 2002 of the Prime Minister), the spouse or legal heir of the deceased receives a one-time allowance of 2,000,000 VND (two million dong), regardless of the time served in the military.
In cases where the subject passed away from May 1, 2002 onwards and had not yet enjoyed the benefit as prescribed in this Circular, the spouse or legal heir of the deceased receives a one-time allowance according to the actual time served in the military of the subject.
III. PROCEDURES AND DOCUMENTS
1. Documents
a) Documents serving as grounds for review:
- Original documents or documents considered as original:
+ Military personnel file: discharge military personnel file;
+ Party member file (if applicable);
+ Discharge orders; discharge notification;
+ Long-term leave permit;
+ Reserve military identification card;
- Related documents:
+ Medal or certificate of award for participation in the anti-French resistance war issued by the competent authority pursuant to Decree No. 28/CP dated April 29, 1995 of the Government;
+ Golden Honor Certificate, Honorable Family Certificate;
+ Other related documents...
b) [2] Regulations on appraisal and review procedures:
- For subjects who still have original documents or documents considered as original, the dossier includes:
+ Personal declaration form (Form No. 1a); or of the relative being the spouse or legal heir (Form No. 1b) in case the subject has passed away, with confirmation by the People's Committee of the commune, ward, town (hereinafter referred to as commune) of residence.
If the legal heir makes the declaration, it must be accompanied by a power of attorney from co-heirs of the same rank, confirmed by the People's Committee of the commune of residence of the person granting the power of attorney (Form No. 1c).
+ A copy of one of the original documents or documents considered as original as stipulated in point a, Clause 1, Section of this Article, together with the original for verification.
- For subjects who no longer have original documents or documents considered as original (only have related documents, or none), the dossier includes:
+ Personal declaration form or of the relative as specified above.
+ A copy of related documents as stipulated in point a, Clause 1, Section of this Article (if available), together with the original for verification.
+ Minutes of the meeting of the Veterans' Association of the commune (with representatives of veterans who have been awarded benefits under Decision No. 47/2002/QD-TTg or veterans currently receiving retirement, disability, or monthly loss of labor capacity benefits) sent to the People's Committee of the commune for review (Form No. 3).
+ Confirmation and recommendation letter of the People's Committee of the commune (Form No. 4).
For professional soldiers or defense civilian employees who have been discharged (demobilized, resigned) and belong to the subjects prescribed in this Circular but now reside in another locality, if they do not have sufficient certification of their time served in the military, they must have a confirmation letter from the People's Committee of the commune of their place of origin or place of enlistment (recruitment as defense civilian employees); or confirmation from the agency or unit managing the subject before enlistment or during service.
2 [3] . Procedure and responsibilities of the subject, agencies, units, localities, and central authorities
a) Responsibilities of the subject
- Fill out the declaration form as prescribed.
- Submit one set of dossier including: Declaration form and a copy of one of the original documents or documents considered as original or copies of related documents (if available) to the People's Committee of the commune.
b) Responsibilities of the People's Committee of the commune
- Direct and implement the dissemination and popularization among the people and subjects about the content of the benefit system and organize its implementation to ensure democracy, transparency, strictness, accuracy, and correct targeting in the locality.
- Establish the Village Policy Council chaired by the Chairman (or Vice-Chairman) of the People's Committee, with the Military Command Post of the village serving as the permanent body, and members comprising representatives from the Party Committee, the Vietnam Fatherland Front, the Association of Veterans, the police, the social and cultural civil servant (responsible for internal affairs), and other members deemed necessary to assist the People's Committee in organizing the implementation of benefits for eligible individuals in accordance with Decision No. 47/2002/QĐ-TTg and this Circular.
- Direct subordinate agencies to accept applications from eligible individuals seeking benefits. Compile a list to submit to the Provincial Civil Service Department and the local Social Insurance Agency for review of those recognized as martyrs, individuals entitled to retirement benefits, disabled workers, and monthly war invalids. Organize the examination of individuals who have been discussed and given opinions by the Association of Veterans. For cases without original documents or considered as such, not clearly identified as eligible individuals or time periods for benefit calculation, meetings shall prepare documentation confirming each specific case and consider resolving them after verification and conclusion.
- Publicize the list of examined individuals at the People's Committee office to solicit public opinion and announce the list of examined individuals through local mass media.
- After ten days, if there are no public complaints or objections, the People's Committee will compile and report to the Provincial People's Committee (through the Provincial Military Command), including: The request letter of the People's Committee (Form No. 5), accompanied by a summary list of eligible individuals (Form No. 6a, 6b) and one set of the individual's file.
For individuals without original documents or considered as such, the People's Committee must thoroughly verify, prepare documentation confirming their status, and propose each specific case (Form No. 4) and be responsible for the content of the confirmation.
For cases with public complaints or objections, the People's Committee must continue to verify, examine, and report later.
- Organize the confirmation of individuals' military service period (for benefit calculation) based on the current place of residence of the applicant (the process of examination and file organization follows the procedure for individuals without original documents or considered as such in the locality). Within twenty days, transfer the reviewed files or respond to the applicant.
- Continue to verify and report cases where the identity or military service period is unclear and unresolved issues according to the requirements of the competent authority.
- Based on the notification of funds and lists transferred by the Provincial Military Command, direct subordinate agencies to implement payments to eligible individuals and report back to the Provincial Military Command.
- Maintain a list of individuals receiving benefits under local management and propose measures to resolve related issues.
c) Responsibilities of the Provincial People's Committee
- Direct localities and relevant functional agencies to promote awareness, organize implementation, and inspect compliance with the regulations.
- Establish a Steering Committee chaired by the Chairman (or Vice-Chairman) of the Provincial People's Committee, with the Provincial Military Command serving as the permanent body, and members comprising representatives from the Provincial Party Organization Committee, the People's Committee, the Association of Veterans, the Provincial Civil Service Department, the Social Insurance Agency, the Provincial Finance Department, and other relevant departments to assist the Provincial People's Committee in directing functional agencies and localities under its jurisdiction to implement, guide, and organize the execution.
- Direct and host training sessions for relevant functional agencies; lead local authorities and functional agencies at the commune level.
- Direct the Provincial Military Command to coordinate with relevant agencies to review the examination results at various levels, compile reports to the Military Region Command (through the Policy Office).
- Host the resolution of local issues and emerging problems.
d) Responsibilities of the Provincial Military Command
- Lead and coordinate with relevant agencies to assist the Provincial People's Committee in promoting awareness, disseminating information, and implementing at all levels.
- Accept files from village People's Committees; organize reviews, examinations, inspections; compile reports to seek approval from the Steering Committee and the Provincial People's Committee.
- Prepare lists, compile files to report to the Military Region (through the Policy Office), including: The request letter of the Provincial Military Command (Form No. 5); a summary list of eligible individuals (Form No. 6a, 6b); individual files (one file per individual).
- Based on the notification of funds and lists decided upon, compile and transfer to village People's Committees to direct subordinate agencies to implement payments and settle accounts according to current regulations.
- Maintain a list of individuals receiving benefits and files (one file per individual) under local unit management and propose measures to resolve related issues.
đ) Responsibilities of the Military Region
- Direct and guide subordinate units to implement.
- Accept reports and files from the Provincial Military Command. Organize monitoring, reviews, inspections, and compile reports to the Ministry of Defense (through the Policy and Social Affairs Bureau/General Political Department), including: The request letter of the Military Region Command (Form No. 5); a summary list of eligible individuals (Form No. 6a, 6b); individual files (one file per individual).
- Based on the notification of funds and lists decided upon, direct the Provincial Military Command to pay benefits to eligible individuals and settle accounts according to current regulations with the Ministry of Defense (through the Financial Bureau/Ministry of Defense).
- Direct and inspect the implementation by subordinate units.
e) Responsibilities of functional agencies of the Ministry of Defense
- The Policy and Social Affairs Bureau/General Political Department:
+ Direct and manage the examination, review, and proposals of Military Regions; compile and submit to the head of the General Political Department for decisions on benefits for eligible individuals;
+ Prepare payment vouchers for one-time allowances and notify lists of eligible individuals to units;
+ Coordinate with the Financial Bureau/Ministry of Defense to prepare budget estimates to report to the Ministry of Finance and develop budget allocation plans for units to organize payments to eligible individuals;
+ Take the lead in coordinating with competent agencies to inspect and supervise the implementation and resolve any issues related thereto;
+ Maintain a list and file for each beneficiary (one beneficiary one file);
- The Finance Department/Military Ministry:
+ Take the lead and coordinate with the Policy-Social Affairs Department/General Political Department to prepare the budget estimate; notify and allocate funds to units; guide, direct, and supervise the disbursement and settlement of accounts with units;
+ Take the lead and coordinate with the Policy-Social Affairs Department/General Political Department to assist the Military Ministry in settling accounts with the Ministry of Finance according to current regulations;
- The Cadre Department/General Political Department, the Military Service Department/Military General Staff:
+ Monitor the number of beneficiaries;
+ Coordinate to handle any arising issues and difficulties during the implementation process;
IV. IMPLEMENTATION
1. Military Ministry:
a) Delegate authority to the General Political Department to direct the entire process of implementing the benefits regime for beneficiaries as stipulated in this Circular; based on the proposals of military regions, decide the level of benefits for beneficiaries;
b) Manage and direct the organization of disbursements and settlement of accounts in accordance with the prescribed regulations on state budget funds;
c) Coordinate with relevant ministries, departments, and local authorities to resolve any related issues;
2. Ministry of Finance:
a) Based on the list proposed by the Military Ministry, the Ministry of Finance allocates funds for disbursement to beneficiaries and administrative fees for disbursement in each period through a budget limit for the Military Ministry (via the Finance Department) to implement through the local military system;
b) Direct the settlement of accounts according to current regulations;
3. The process of reviewing, auditing, and disbursing benefits for beneficiaries at the implementation level is as follows:
- For beneficiaries who have complete documentation confirming their eligibility and time period for benefit calculation, review and disburse benefits conclusively in 2002 and the first quarter of 2003;
- For beneficiaries whose files are incomplete or unclear, local authorities shall cooperate with competent agencies to continue verification, examination, and resolution;
- For cases without documentation, unclear eligibility, or time period for benefit calculation, compile, examine, and report later;
4. The funding for the disbursement of benefits as stipulated in this Circular is guaranteed by the state budget;
- Administrative fees (including: fees for publicity, implementation, management, review, and disbursement work) amount to 4% of the total disbursement funds for implementing the benefits regime, sourced from the state budget;
- Management, disbursement, and settlement of accounts must be strictly, promptly, and accurately carried out in accordance with current regulations;
5. Any person engaging in false declarations, tampering, or forging documents will be subject to disciplinary action or criminal prosecution and must compensate for any damages incurred, as provided by law;
6. This Circular takes effect from May 1, 2002;
During the implementation process, if any issues arise, they should be reported to the Joint Board for consideration and resolution;

Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of National Defense;
Based on Decree No. 03/2025/NĐ-CP dated February 28, 2025 of the Government amending and supplementing certain provisions of Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;
Amending and supplementing certain provisions of 11 Decrees of the Government within the scope of management of the Ministry of National Defense;
Based on Decision No. 22/2025/QĐ-TTg dated July 10, 2025 of the Prime Minister amending and supplementing certain provisions of the Prime Minister's Decisions on benefits and policies for those who participated in the resistance, national defense wars, and international missions under the management of the Ministry of National Defense;
At the proposal of the Director of the General Political Department;
The Minister of National Defense issues this Circular amending and supplementing certain provisions of joint circulars, circulars, and decisions of the Minister of National Defense in the field of policy.”
