THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Memorandum of Understanding between the Ministry of Agriculture and Rural Development and the organization Traffic South East Asia (monitoring wildlife trade in Southeast Asia), signed on March 9, 2000;

Considering the proposal of the Forest Protection Department at document number 170/KL-BTTN dated March 28, 2000;
At the proposal of the Director of the Cadre and Civil Servant Department,

Article 1.- The competent authority for managing the CITES Vietnam Office, abbreviated as the CITES Vietnam Office, under the Forest Protection Department is hereby established.

International name: VIETNAM CITES MANAGEMENT AUTHORITY

Article 2.-The CITES Office is a permanent component of the Vietnamese authority responsible for implementing the CITES Convention (Convention on International Trade in Endangered Species of Wild Fauna and Flora). The Office has the function of advising the Director of the Forest Protection Department on organizing and implementing the provisions of the Convention and related matters authorized by the Minister of Agriculture and Rural Development.

The CITES Office shall have the following tasks:

1/ Regularly liaise with the CITES Secretariat and the management authorities of member countries: Submit periodic reports, receive documents, exchange information, coordinate participation in preparing regional conferences and meetings of member states, guide the implementation of Convention regulations.

2/ Guide and supervise wildlife breeding farms and forest plant nurseries (involved in import and export) to comply with domestic and international laws.

3/ Organize or coordinate with relevant units to inspect and control the trade in wildlife and plants as well as the enforcement of laws; propose measures to prevent illegal exploitation, use, storage, transportation, and trade in endangered wildlife and plants in import and export; contribute to effectively protecting national natural resources, primarily species at risk of extinction.

4/ Promote awareness of the CITES Convention and national laws related to the import and export of endangered wildlife and plants; organize annual training and instruction on professional duties for individuals inside and outside the sector involved in implementing the CITES Convention.

5/ Implement the issuance of CITES permits or certificates for the import and export of wildlife and plants in accordance with national laws and consistent with the CITES Convention to ensure that it does not harm their existence in nature.

Article 3.- The CITES Office shall have a staff of five persons, drawn from the Forest Rangers' establishment and assigned to the Head of the Natural Conservation Division. In the first year, two existing positions from the Forest Protection Department will be utilized and three contracts will be recruited with funding provided by Traffic South East Asia for salaries.

Article 4.- THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

Article 5.- The Heads of the General Office of the Ministry, the Personnel Department, the Forest Protection Department, and the Heads of related units under the Ministry are responsible for enforcing this decision. /./
