CIRCULAR

Regarding the issuance of the "Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam"

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business; and Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production and business;

Pursuant to the Law on Product Quality and Goods dated November 21, 2007;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of some provisions of the Law on Product Quality and Goods;

Pursuant to Decision No. 100/2008/QĐ-BNN dated October 15, 2008 of the Minister of Agriculture and Rural Development on the issuance of regulations on fertilizer production, business, and use;

The Ministry of Agriculture and Rural Development hereby issues the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam,

Article 1. Attached hereto is the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam (Annex 1 attached) including 414 types, divided into:

1. Micronutrient fertilizers 31 types;

2. Organic fertilizers 08 types;

3. Bio-organic fertilizers 34 types;

4. Mineral organic fertilizers 44 types;

5. Microbial organic fertilizers 26 types;

6. Microbial fertilizers 03 types;

7. Foliar fertilizers 259 types;

8. Fertilizers with growth regulators added 03 types;

9. Soil amendment materials 02 types;

10. Hydroponic fertilizers 04 types.

Article 2. Organizations and individuals permitted to produce, trade, and use the types of fertilizers listed in this Supplementary List must meet the conditions stipulated in Article 5 of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production and business; and the provisions set forth in Clause 4, Article 1 of Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production and business.

Article 3. This Circular shall take effect forty-five days from the date of issuance. Types of fertilizers (Annex 2 attached) will be removed from the list of fertilizers permitted for production, business, and use in Vietnam from the date this Circular takes effect.

Article 4. The Director of the Office of the Ministry, the Director of the Crop Production Department, the Director of the Science, Technology, and Environment Department, the Directors of the Departments of Agriculture and Rural Development of provinces and centrally governed cities, the Heads of units, organizations, and individuals related to fertilizer production, business, and use in Vietnam are responsible for implementing this Circular./.
