of the Vocational Training General Department under the Ministry of Labor, Invalids and Social Affairs

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Vocational Training Law dated November 29, 2006;

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Decree No. 07/2021/NĐ-CP

The Prime Minister issues this decision to stipulate the functions, tasks, powers, and organizational structure of the Vocational Training General Department under the Ministry of Labor, Invalids and Social Affairs.

Article 1. Position and Functions

1. The Vocational Training General Department is an organization under the Ministry of Labor, Invalids and Social Affairs, performing the function of advising the Minister of Labor, Invalids and Social Affairs on state management of vocational training, including: programs, textbooks, content, plans, quality of vocational training, national occupational qualification frameworks, national skill qualification frameworks, standards for lecturers, teachers, and vocational training managers, examination regulations, admission policies, systems of certificates and diplomas, lists of training occupations, material infrastructure and equipment for vocational training; organizing the implementation of state management tasks in the field of vocational training as prescribed by law.

2. The Vocational Training General Department has legal personality, uses a seal with the National Emblem, is a budgetary unit at level II under the Ministry of Labor, Invalids and Social Affairs, and has its own account at the State Treasury.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Vocational Training General Department performs specific tasks and powers as follows:

1. Submit to the Minister of Labor, Invalids and Social Affairs for submission to the Government and the Prime Minister for consideration and decision:

a) Draft laws, ordinances; draft resolutions of the National Assembly and the Standing Committee of the National Assembly; draft resolutions, decrees of the Government on vocational training;

b) Strategies, planning, long-term, five-year, annual plans on vocational training; national target programs, development projects and programs on vocational training; draft decisions and directives of the Prime Minister on vocational training;

c) Planning the network of vocational college schools, intermediate vocational schools, and vocational training centers.

2. Submit to the Minister of Labor, Invalids and Social Affairs for approval and decision:

a) Draft decisions, directives, circulars on vocational training;

b) Regulations on standards, technical norms, economic-technical quotas; professional procedures within the field of vocational training.

3. Assist the Minister of Labor, Invalids and Social Affairs in directing, guiding, inspecting, supervising, evaluating, and being responsible for organizing the implementation of legal normative documents, policies, strategies, planning, national target programs, and projects and programs on vocational training after approval.

4. Issue according to its authority professional guidance documents on vocational training and individual documents as prescribed by law.

5. On regular vocational training:

a) Manage the list of training occupations;

b) Take the lead in organizing the construction and review of the framework program for higher vocational college and intermediate vocational levels for each occupation;

c) Guide and inspect vocational training institutions in the construction, issuance, and implementation of vocational training programs; the compilation, selection, review, approval, and use of vocational training textbooks; the application of foreign vocational training programs; registration for vocational training activities; implementation of vocational training admissions, examinations, graduation recognition, and issuance of vocational diplomas and certificates. Inspect Vietnamese vocational training institutions in issuing foreign vocational diplomas and certificates; joint training and cooperative training of vocational training institutions;

d) Implement registration for higher vocational training activities.

6. On continuous vocational training:

a) Guide on specific conditions and procedures for opening continuous vocational training courses; on the target groups and enrollment methods for continuous vocational training; on continuous vocational training programs, textbooks, learning materials; cooperation in continuous vocational training; organization of continuous vocational training, testing, evaluation, graduation recognition, and issuance of diplomas and certificates in continuous vocational training;

b) Guide and inspect the implementation of regulations on continuous vocational training;

c) Guide and inspect the implementation of work to provide vocational training for rural laborers as prescribed.

7. On lecturers, teachers, and vocational training managers:

a) Guide and inspect the establishment of Vocational Education Departments in vocational colleges;

b) Guide and inspect the construction and implementation of training and upgrading programs for lecturers, teachers, and vocational training managers; the implementation of salary and policy systems for lecturers, teachers, and vocational training managers; professional standards for vocational lecturers and teachers; standards for heads of vocational training institutions; recruitment of vocational civil servants; Lecturer and Teacher Competitions at various levels. Inspect the implementation of evaluation regulations for vocational civil servants;

c) Manage professional training and upgrading for lecturers, teachers, and vocational training managers;

d) Organize vocational civil servant career advancement exams according to its authority;

đ) Organize the implementation of awards for distinguished educators and vocational training managers as prescribed by law;

e) Organize the implementation of National Lecturer and Teacher Competitions.

8. On student and trainee affairs in vocational training:

a) Guide and inspect the implementation of student and trainee management regulations; work to prevent crime and social evils and build a healthy educational environment in vocational training institutions; ideological, moral, lifestyle, cultural, and aesthetic education for students and trainees; physical education and health care work in vocational training institutions; cultural, artistic, sports movements among students and trainees; implementation of scholarship policies from the state budget and other policies for vocational learners;

b) Inspect the implementation of regulations on tuition fees and other charges for students and trainees.

9. On material infrastructure and equipment for vocational training:

a) Develop standards for material infrastructure of vocational colleges, intermediate vocational schools, and vocational training centers and equipment standards for each occupation;

b) Guide and inspect the implementation of standards for material infrastructure and equipment for vocational training institutions as prescribed; organize vocational training equipment competitions at various levels;

c) Guide the management of material infrastructure and equipment for vocational training;

d) Guide the acceptance and application of material standards and lists of vocational training equipment from foreign countries;

đ) Organize the implementation of the National Vocational Training Equipment Self-Made Competition;

10. Regarding quality assessment of vocational training:

a) Guide and inspect the implementation of regulations on quality assessment of vocational training;

b) Manage and organize the implementation of quality assessment for vocational training institutions and training programs. Take the lead in reviewing and recognizing vocational training institutions and programs that meet the quality assessment standards;

c) Guide and inspect the assurance of vocational training quality and self-assessment of quality by vocational training institutions;

d) Recognize, issue, and revoke certificates of meeting quality assessment standards for vocational training;

đ) Organize the public announcement of the list of vocational training institutions and training programs that have been quality assessed;

e) Organize professional training and development for quality assessors of vocational training and quality management staff of vocational training institutions; issue, revoke, and manage quality assessor cards for vocational training;

g) Take the lead in organizing the review of the establishment or permission to establish quality assessment organizations for vocational training;

h) Guide the establishment, organization, and operation of vocational training quality assessment centers established by organizations and individuals; recognition of foreign organizations authorized to assess the quality of vocational training programs taught in Vietnam;

11. Regarding vocational skills:

a) Manage the national framework of vocational skill levels and the system of national vocational skill standards;

b) Guide and inspect the issuance of national vocational skill standards for each occupation and each level of vocational skill; review, update, and adjust national vocational skill standards to meet the general requirements of each period; guide the use of national vocational skill standards and the application of vocational skill standards from ASEAN and global countries in Vietnam;

c) Manage the bank of vocational skill assessment tests;

d) Organize professional training and development for assessors, experts in building and reviewing national vocational skill standards and vocational skill assessment tests; issue, revoke, and manage national vocational skill assessor cards;

đ) Manage the assessment and issuance of national vocational skill certificates according to regulations;

e) Organize the National Vocational Skills Competition, participate in the ASEAN and world vocational skills competitions;

g) Manage the database system for vocational skill assessment and certification;

12. Regarding inspection, supervision, complaint resolution, and accusation handling:

a) Conduct specialized inspections in vocational training;

b) Guide professional and operational matters related to inspection, supervision, administrative violation handling in the field of vocational training;

c) Resolve complaints and accusations regarding vocational training within the scope of authority;

13. Guide and inspect the establishment, merger, division, dissolution of vocational training institutions, the establishment of foreign vocational training representative offices in Vietnam; recognition of principals, approval of private college charter. Organize the implementation of the review of the establishment of colleges;

14. Promote, disseminate, and educate laws within the scope of state management of vocational training;

15. Organize the implementation of statistical work, information, and the construction of databases on vocational training;

16. Organize the implementation of research, dissemination, and application of science and technology in the field of vocational training;

17. Guide and inspect the organization and activities of vocational training conducted by foreign-invested vocational training institutions in Vietnam; the implementation of joint ventures and cooperation between Vietnamese vocational training institutions and foreign vocational training institutions;

18. Implement international cooperation in the field of vocational training in accordance with the provisions of the law and the delegation of the Minister of Labor, Invalids, and Social Affairs;

19. Manage organizational structure, staffing, implement salary systems and incentive policies, appointment, reappointment, transfer, rotation, dismissal, resignation, secondment, retirement, termination, commendation, disciplinary action, professional training, and development for civil servants and officials under the management of the General Department of Vocational Training in accordance with the law and the delegation of the Minister of Labor, Invalids, and Social Affairs;

20. Implement administrative reform in the field of vocational training according to the Ministry of Labor, Invalids, and Social Affairs' administrative reform plan;

21. Manage financial resources and assets assigned and organize the implementation of allocated budgets in accordance with the law;

22. Carry out other tasks assigned by the Minister of Labor, Invalids, and Social Affairs and as prescribed by law.

Article 3. Organizational Structure

1. The Regular Vocational Training Department;

2. The Continuous Vocational Training Department;

3. The Teachers and Vocational Training Management Staff Department;

4. The Vocational Training Material and Equipment Department;

5. Department of Student and Trainee Affairs.

6. The Vocational Skills Department;

7. Cadre and Civil Servant Organization Department.

8. Planning and Finance Department.

9. The Legal Affairs and Inspection Department;

10. Office;

11. The Quality Assessment of Vocational Training Bureau;

12. The Scientific Research Institute for Vocational Education;

In this Article, units specified from Clause 1 to Clause 11 are units assisting the Director-General in performing state management functions; the unit specified in Clause 12 is a service unit for the state management function of the General Department;

The Director-General of the General Department of Vocational Training shall stipulate the functions, tasks, powers, and organizational structure of units under the General Department of Vocational Training.

Article 4. Leadership of the Vocational Training Administration

1. The Vocational Training Administration has a Director and no more than three Deputy Directors.

2. The Director and Deputy Directors shall be appointed, relieved of duty, and dismissed by the Minister of Labor, War Invalids, and Social Affairs in accordance with the provisions of the law.

3. The Director of the Vocational Training Administration is responsible to the Minister of Labor, War Invalids, and Social Affairs and to the law for all activities of the Vocational Training Administration. The Deputy Directors of the Vocational Training Administration are responsible to the Director of the Vocational Training Administration and to the law for the areas of work they are assigned to manage.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from September 10, 2013.

2. This Decision replaces Decision No. 86/2008/QĐ-TTg dated July 3, 2008 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the Vocational Training Administration under the Ministry of Labor, War Invalids, and Social Affairs, and Decision No. 53/2011/QĐ-TTg dated September 27, 2011 of the Prime Minister amending and supplementing Article 3 of Decision No. 86/2008/QĐ-TTg; abolishes other previous regulations that are contrary to this Decision.

3. The Minister of Labor, War Invalids, and Social Affairs, the Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government, and the Director of the Vocational Training Administration are responsible for implementing this Decision./.
