Management, Education, Medical Examination and Treatment of Individuals Infected with HIV/AIDS

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for civil servants, public officials, and members of the armed forces;

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Prevention and Control of HIV/AIDS dated June 29, 2006;

The Prime Minister issues this Decision to stipulate allowances for police officers directly engaged in management, education, medical examination and treatment of individuals infected with HIV/AIDS

At the proposal of the Minister of Public Security,

This Decision stipulates allowances for police officers directly engaged in management, education, medical examination and treatment of individuals infected with HIV/AIDS at detention centers, temporary detention facilities, compulsory educational facilities, reformatory schools, and holding houses..

Article 1. Scope of Regulation

Heads of sub-camps, Deputy Heads of sub-camps, Heads of sub-zones, Deputy Heads of sub-zones, Heads of sub-offices, Deputy Heads of sub-offices; Team Leaders, Deputy Team Leaders, and equivalent positions; health care staff, investigators, camp guards, facility guards, searchers, educators, administrative officers, prison wardens, vocational instructors, photography officers, fingerprinting officers, cultural teachers, class headmasters in reformatory schools under the People's Public Security Force who come into contact with individuals infected with HIV/AIDS.

Article 2. Applicability

Article 1. The allowances prescribed in this Decision shall only apply to the subjects specified in Article 2 during their direct engagement in management, education, and medical examination and treatment of individuals infected with HIV/AIDS.

Article 3. Principles of Implementation

Article 2. The allowances prescribed in this Decision shall be paid concurrently with monthly salaries and shall not be used to calculate contributions or benefits under social insurance and health insurance schemes.

Article 4. Allowance System

1. Amount: VND 500,000/person/month, applicable to: Health care staff, investigators, camp guards, facility guards, searchers, educators, administrative officers, prison wardens, vocational instructors, photography officers, fingerprinting officers, cultural teachers, and class headmasters in reformatory schools under the People's Public Security Force at detention centers, temporary detention facilities, compulsory educational facilities, reformatory schools, and holding houses.

2. Amount: VND 400,000/person/month, applicable to: Heads of sub-camps, Deputy Heads of sub-camps, Heads of sub-zones, Deputy Heads of sub-zones, Heads of sub-offices, Deputy Heads of sub-offices; Team Leaders, Deputy Team Leaders, and equivalent positions; other police officers performing remaining duties at detention centers, temporary detention facilities, compulsory educational facilities, reformatory schools, and holding houses.

The funding for implementing the allowance system stipulated in Article 4 of this Decision shall be guaranteed by the state budget in accordance with the State Budget Law.

Article 5. Source of funds for payment

Article 1. This Decision shall take effect from November 1, 2015.

Article 6. Effectiveness

Article 2. The Decision No. 22/2003/QĐ-TTg dated January 30, 2003 of the Prime Minister regarding allowances for police officers directly engaged in management, education, care, medical examination and treatment, and struggle against individuals infected with HIV/AIDS is hereby abolished.

2. Repeal Decision No. 22/2003/QĐ-TTg dated January 30, 2003 of the Government Chairman regarding the regime for police officers directly engaged in management, education, care, medical examination and treatment, and struggle against individuals infected with HIV/AIDS.

Article 7. Responsibility for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
