CIRCULAR
Issuing the List of Digital Content Products
Pursuant to the Law on Information Technology dated June 29, 2006;
On the basis of the Investment Law dated November 26, 2014;
Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Pursuant to Decree No. 71/2007/NĐ-CP dated May 3, 2007 of the Government detailing and guiding the implementation of certain provisions of the Law on Information Technology regarding the information technology industry; Article 3 of the Law on Information Technology;
Article 1. Amending and supplementing Circular No. 09/2013/TT-BTTTT dated April 8, 2013 of the Minister of Information and Communications on the List of software and hardware, electronic products as follows:

Article 1. Scope of Regulation
Clause 1. This Circular promulgates the List of Digital Content Products (or digital content products as defined in the Investment Law), as specified in the Appendix attached hereto.
Clause 2. The List of Digital Content Products includes types of digital content products belonging to groups as stipulated in Clause 11, Article 3 and Clause 2, Article 10 of Decree No. 71/2007/NĐ-CP dated May 3, 2007, categorized according to the functions and features of the products.
Article 2. Applicability
This Circular applies to agencies, organizations, and individuals participating in management, production, business, and use of digital content products in Vietnam.
Article 3. Principles for Building and Purpose of Applying the List of Digital Content Products
Clause 1. The List of Digital Content Products systematizes specialized products of the digital content industry to serve investment activities, application of tax policies and preferential policies, import-export management, quality control, and other related activities concerning digital content products.
Clause 2. Based on market development conditions, information technology development policies, and management requirements in each period, the Department of Information Technology shall study and submit to the Minister of Information and Communications for revision and supplementation of the List of Digital Content Products.
Article 4. Effective date
This Circular takes effect from February 10, 2017.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
Clause 1. The Director of the Office, Heads of the Department of Information Technology, heads of units under the Ministry of Information and Communications, Directors of Provincial Departments of Information and Communications, and agencies, organizations, and individuals mentioned in Article 2 are responsible for implementing this Circular.
Clause 2. In the course of implementation, if any difficulties arise, please send a written report to the Ministry of Information and Communications (Department of Information Technology) for resolution, guidance, or appropriate amendment and supplementation./ .
