CIRCULAR
ISSUING THE LIST OF SOFTWARE AND HARDWARE, ELECTRONIC PRODUCTS
Pursuant to the Law on Information Technology dated June 29, 2006;
The Minister of Information and Communications promulgates this Circular amending and supplementing Circular No. 09/2013/TT-BTTTT dated April 8, 2013 of the Minister of Information and Communications on the List of software and hardware, electronic products.
WHEREAS, Decree No. 187/2007/NĐ-CP dated December 25, 2007 of the Government stipulates the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications, and Decree No. 50/2011/NĐ-CP dated June 24, 2011 of the Government amending Decree No. 187/2007/NĐ-CP;
At the proposal of the Director of the Department of Information Technology;
THE MINISTER OF INFORMATION AND COMMUNICATIONS issues this Circular on the issuance of the List of Software and Hardware, Electronic Products.
Article 1. Scope of Regulation
This Circular promulgates the List of Software and Hardware, Electronic Products (hereinafter referred to as the List), including:
1. The List of Software products is specified in Appendix No. 01.
2. The List of Hardware, Electronic Products is specified in Appendix No. 02.
Article 2. Applicability
This Circular applies to agencies, organizations, and individuals participating in information technology industry activities, management, production, and trading of software and hardware, electronic products in Vietnam.
Article 3. Principles for Construction and Purpose of Application of the List
1. The List is established to form a specialized product system in the software and hardware, electronic industries for business registration; investment activities; application of tax policies; preferential policies; import-export management; quality management; and other related activities involving software and hardware, electronic products.
2. Based on market development conditions and information technology development policies in each period, the Ministry of Information and Communications adjusts the List to meet management requirements.
Article 4. Effective date
This Circular takes effect from May 23, 2013.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Director of the Office, Heads of the Department of Information Technology, Heads of agencies and units under the Ministry of Information and Communications, Directors of Provincial Departments of Information and Communications, and enterprises, organizations, and individuals mentioned in Article 2 shall be responsible for implementing this Circular.
2. In the course of implementation, if any difficulties arise, organizations and individuals are requested to report to the Ministry of Information and Communications for supplementation and amendment to ensure suitability./.
