Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

Pursuant to the Law on Credit Institutions dated June 16, 2010 and the Law Amending and Supplementing Certain Articles of the Law on Credit Institutions dated November 20, 2017;

Based on the Enterprise Law dated November 26, 2014;

On the basis of the Investment Law dated November 26, 2014;

Pursuant to Decree No. 10/2010/NĐ-CP dated February 12, 2010 of the Government on credit information activities and Decree No. 57/2016/NĐ-CP dated July 1, 2016 of the Government amending and supplementing Article 7 of Decree No. 10/2010/NĐ-CP dated February 12, 2010 of the Government on credit information activities;

Pursuant to Government Decree No. 16/2017/NĐ-CP dated February 17, 2017 on the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of Banking Inspection and Supervision;

The Governor of the State Bank of Vietnam issues this Circular amending and supplementing certain provisions of Circular No. 16/2010/TT-NHNN dated June 25, 2010 of the Governor of the State Bank of Vietnam guiding the implementation of Decree No. 10/2010/NĐ-CP dated February 12, 2010 of the Government on credit information activities (hereinafter referred to as Circular No. 16/2010/TT-NHNN).

Article 1. Amending and supplementing certain provisions of Circular No. 16/2010/TT-NHNN

1. Point c(viii) Clause 1 Article 5 of Circular No. 16/2010/TT-NHNN (amended and supplemented at Clause 4 Article 1 of Circular No. 23/2016/TT-NHNN dated June 30, 2016 of the Governor of the State Bank of Vietnam on amending and supplementing certain provisions of Circular No. 16/2010/TT-NHNN) shall be amended and supplemented as follows:

"viii) Documents of credit institutions, foreign bank branches committing to provide credit information to enterprises according to Model No. 04/TTTD issued together with this Circular;"

2. Replace the phrase "Commercial banks" with the phrase "Credit institutions, foreign bank branches" in Model No. 04/TTTD issued together with Circular No. 16/2010/TT-NHNN.

Article 2. Responsibility for Implementation

The Director of the Office, the Director of the Banking Inspection and Supervision Department, Heads of units under the State Bank of Vietnam, Governors of the State Bank of Vietnam Branches in provinces and centrally governed cities, General Directors of the National Credit Information Center of Vietnam, Chairmen of the Board of Directors, Members of the Board of Management and General Directors (Directors) of credit institutions, foreign bank branches, Chairmen of the Board of Directors, Members of the Board of Management and General Directors (Directors) of credit information companies are responsible for organizing the implementation of this Circular.

Article 3. Effectiveness

This Circular takes effect from February 18, 2019./.
