CIRCULAR

Article 24||| establishing code numbers, occupational title standardsand salary grading civil servants

in the project management for inland waterways specialty

 

Pursuant to the Law on Civil Servants dated November 15, 2010; the Law amending and supplementing certain articles of the Law on Fisheries, Public Officials, and Civil Servants dated November 25, 2019;, the Law on FisheriesFor power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract. and the Law on Civil Servants dated November 25, 2019;

Pursuant to Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, public officials, civil servants, and armed forces; and Decree No. 17/2013/NĐ-CP dated February 19, 2013 and Decree No. 117/2016/NĐ-CP dated July 21, 2016 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, public officials, civil servants, and armed forces;

Decree No. 56/2022/NĐ-CP dated 24 the 8 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;22 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry Ministry of Transport;

At the proposal of the Director of the Department of Organization and Cadres and the Director of the Vietnam Inland Waterway Administration;                       

The Minister of Transport hereby issues this Circular to establish code numbers, occupational title standards, and salary grading for civil servants in the project management for inland waterways specialty. 1. This Circular stipulates code numbers, occupational title standards, and salary grading for civil servants in the project management for inland waterways specialty.

 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

2. This Circular applies to civil servants in the project management for inland waterways specialty at public service units and related organizations and individuals.

3. Non-public service units may apply the provisions of this Circular.

Article 2. Code Numbers of Occupational Titles for Civil Servants in the Project Management for Inland Waterways Specialty

1. Project Manager for Inland Waterways Class I Code Number: V.12.51.01

2. Project Manager for Inland Waterways Class II Code Number: V.12.51.02

3. Project Manager for Inland Waterways Class III Code Number: V.12.51.03

4. Project Manager for Inland Waterways Class IV Code Number: V.12.51.04

1. Adhere to the Party's policies and State laws.

Article 3. General standards for professional ethics

3. Have a sense of moral cultivation, maintain professional integrity, reputation, and prestige; refrain from exploiting work positions or assigned tasks for personal gain; foster unity, creativity, self-improvement, readiness to learn new knowledge; have a sense of cooperation, assistance, and sharing of experience with colleagues; actively participate in scientific research topics, technical innovations to develop the profession and enhance competence.

2. Be honest, objective, and highly responsible for assigned tasks; fulfill all obligations of a civil servant in professional activities.

Article 4. Project Manager for Inland Waterways Class I - Code Number: V.12.51.01

Chapter II

OCCUPATIONAL STANDARDS

a) Lead the implementation of the owner's tasks and supervise the project execution process according to regulations;

1. Tasks

b) Lead the research and development of topics, plans, quality targets, economic and technical norms to innovate and improve management mechanisms, enhancing the effectiveness of project management activities;

c) Lead the compilation and development of professional guidance materials in the field of project management for inland waterways;

d) Lead the organization of specialized training, vocational training, or dissemination of knowledge and experience within the assigned scope of duties;

đ) Lead the implementation of professional and vocational tasks within the unit's functions and responsibilities as prescribed by law;

e) Participate in drafting and implementing legal normative documents related to project management for inland waterways;

b) Hold a certificate in professional career training for civil servants in the project management for inland waterways specialty.

g) Perform other tasks assigned by competent authorities.

2. Qualification requirements for education and training

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

a) Understand the Party's policies and State laws; knowledge of management in the industry, strategy, planning, and development of the inland waterways sector;

3. Professional Qualification Standards

b) Understand the administrative management system of the State; project management for construction investment in the inland waterways sector;

c) Possess analytical and synthesis skills to propose methods to perfect or resolve practical issues within the assigned industry or field;

d) Have in-depth knowledge and experience in project management for inland waterways;

đ) Possess organizational implementation skills, practical summary, and proposal of solutions or participation in the development of strategies, policies, and plans for development in the project management for inland waterways sector; researching and applying scientific and technological advancements to improve and enhance the quality and efficiency of work in the assigned industry or field;

4. Criteria and Conditions for Registration to Take Examinations or Apply for Promotion to the Project Manager for Inland Waterways Class I Civil Servant Position Civil servants can register to take examinations or apply for promotion to the Project Manager for Inland Waterways Class I position when meeting the criteria and conditions stipulated in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants, and the following criteria and conditions:

e) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages for civil servants working in ethnic minority areas according to job requirements.

a) Have held the Project Manager for Inland Waterways Class II position or equivalent for at least six years. If there is equivalent time, they must have held the Project Manager for Inland Waterways Class II position for at least one year (twelve months) up to the deadline for submitting examination registration or promotion application forms;

b) During the period holding the Project Manager for Inland Waterways Class II position or equivalent, meet at least one of the following criteria and conditions:

Lead the development of one topic, plan, project, program of science and technology at the ministry or provincial level or higher that has been issued or accepted by the competent authority;

Lead the development of two topics, plans, projects, programs of science and technology at the grassroots level that have been issued or accepted by the competent authority;

Have served as the director managing one Class A project or two Class B projects of the same type;

Have led the design or review or verification of design of two Class I works or three Class II works;

Have led the implementation of one of the cost management tasks of one Class A project or two Class B projects or one Class I work or two Class II works;

Have participated in the management of one Class A project or two Class B projects of the same type and hold one of the four professional certificates: Class I project management, Class I construction design, Class I construction supervision, or Class I construction valuation.

Has participated in managing one Group A project or two Group B projects of the same type and holds one of the four professional certificates: Project Management Class I, Construction Design Class I, Construction Supervision Class I, or Construction Cost Estimation Class I.

Article 5. Management of Class II inland waterway projects - Code: V.12.51.02

1. Tasks

a) To take the lead or participate in performing the tasks of the project investor and to inspect and supervise the implementation process of the project in accordance with regulations;

b) To take the lead or participate in researching, building topics, programs, quality targets, economic and technical norms aimed at innovating and perfecting management mechanisms, enhancing the effectiveness and efficiency of project management activities;

c) To take the lead or participate in compiling and building specialized and vocational guidance materials on the field of inland waterway project management;

d) To take the lead or participate in organizing guidance, specialized training sessions, vocational training, disseminating knowledge and experience within the scope of assigned tasks;

e) To take the lead or participate in organizing the implementation of specialized and vocational work under the functions and tasks of the unit in accordance with the provisions of the law;

b) Hold a certificate in professional career training for civil servants in the project management for inland waterways specialty.

g) Perform other tasks assigned by competent authorities.

2. Qualification requirements for education and training

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

a) Understand the Party's policies and State laws; knowledge of management in the industry, strategy, planning, and development of the inland waterways sector;

3. Professional Qualification Standards

a) To thoroughly understand the Party's guidelines and policies, the State's policies and laws; knowledge of management in the industry, strategy, planning, development of the inland waterway sector;

b) To thoroughly understand the system of administrative state management knowledge; project management in the construction investment field of inland waterways;

c) To have knowledge and experience in inland waterway project management activities;

d) To have the ability to organize implementation, summarize practical experiences, and propose solutions or participate in building strategies, policies, plans for development in the field of inland waterway project management; to study and apply scientific and technological progress and techniques to improve and enhance the quality and efficiency of work in the assigned sector;

đ) Have basic computer skills and be able to use foreign languages or ethnic minority languages for staff working in ethnic minority areas as required by job positions;

4. Criteria and conditions for registering to take the examination or be considered for promotion to the position of Class II Inland Waterway Project Manager Civil Servant may register to take the examination or be considered for promotion to the position of Class II Inland Waterway Project Manager when meeting all criteria and conditions stipulated in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, use, and management of civil servants and the following criteria and conditions:

a) Having held the position of Class III Inland Waterway Project Manager or equivalent for at least nine years (excluding probationary and trial periods). In cases where there is equivalent time, they must have at least one year (twelve months) holding the position of Class III Inland Waterway Project Manager up to the deadline for submitting application registration for the examination or promotion;

b) During the period of holding the position of Class III Inland Waterway Project Manager or equivalent, achieving at least one of the following criteria and conditions:

Participating in building one topic, program, project, science and technology program at the ministry level or provincial level or higher that has been issued or accepted by the competent authority;

Participating in building two topics, programs, projects, science and technology programs at the grassroots level that the employing agency has been assigned to research and build and which have been issued or accepted by the competent authority;

Having served as the director managing one Group B project or two Group C projects of the same type;

Having led the design or reviewed or checked the design of two Class II works or three Class III works;

Having led the implementation of one of the cost management tasks of one Group B project or two Group C projects or one Class II work or two Class III works;

Having participated in managing at least one Group B project or two Group C projects and having one of the four practice certificates: Class II Project Management, Class II Construction Design, Class II Construction Supervision, Class II Construction Valuation.

Article 6. Management of Class III Waterway Projects - Code: V.12.51.03

1. Tasks

a) Participate in performing the tasks of the project owner and supervise the implementation process of the project in accordance with regulations;

b) Participate in developing research topics, plans, quality objectives, economic and technical norms to innovate and improve management mechanisms, enhance the effectiveness and efficiency of project management activities;

c) Participate in compiling and developing specialized and vocational guidance materials on waterway project management;

d) Participate in implementing specialized and vocational training sessions, vocational training, and disseminating knowledge within the scope of assigned tasks;

đ) Participate in performing specialized and vocational work under the functions and tasks of the unit as prescribed by law;

Implement related regulatory legal documents concerning waterway project management;

g) Perform other tasks assigned by competent authorities.

2. Qualification requirements for education and training

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

a) Understand the Party's policies and State laws; knowledge of management in the industry, strategy, planning, and development of the inland waterways sector;

3. Professional Qualification Standards

a) To thoroughly understand the Party's guidelines and policies, the State's policies and laws; knowledge of management in the industry, strategy, planning, development of the inland waterway sector;

b) Possess the ability to systematize administrative state management knowledge; project management in the waterway sector;

c) To have knowledge and experience in inland waterway project management activities;

d) Possess the ability to compile reports, coordinate activities, work independently and in teams; have the capacity to implement tasks ensuring progress, quality, and effectiveness;

đ) Have basic computer skills and be able to use foreign languages or ethnic minority languages as required by the position for civil servants working in ethnic minority areas.

4. Standards and Conditions for Registering to Take Examinations or Apply for Promotion to the Position of Class III Waterway Project Manager Civil Servant may register to take examinations or apply for promotion to the position of Class III Waterway Project Manager when meeting all standards and conditions stipulated in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, use, and management of civil servants and the following standards and conditions:

a) Have held the position of Class IV Waterway Project Manager or equivalent for at least three years (excluding probationary and trial periods). In cases of equivalent time, there must be at least one year (full twelve months) holding the position of Class IV Waterway Project Manager up to the deadline for submitting examination registration or promotion application forms;

b) During the period of holding the position of Class IV Waterway Project Manager or equivalent, meet at least one of the following standards and conditions:

Participated in managing one Class C project of the same type;

Led or reviewed or verified the design of two Class III works;

Led the implementation of one of the investment cost management tasks of one Class C project or one Class III work;

Participated in managing one Class C construction investment project and holds one of the four professional certificates: Class III Project Management, Class III Construction Design, Class III Construction Supervision, or Class III Construction Valuation.

Article 7. Management of Class IV Waterway Projects - Code: V.12.51.04

1. Tasks

a) Perform specialized and vocational work under the functions and tasks of the unit as prescribed by law;

b) Participate in establishing and implementing file management systems, organize statistics and archive project documents in accordance with regulations;

c) Coordinate in organizing specialized training sessions and vocational training for project management work;

d) Implement related regulatory legal documents concerning waterway project management;

đ) Perform other tasks assigned by competent authorities.

2. Qualification requirements for education and training

a) Hold a college degree or higher in a relevant field that meets the requirements of the position;

a) Understand the Party's policies and State laws; knowledge of management in the industry, strategy, planning, and development of the inland waterways sector;

3. Professional Qualification Standards

a) To thoroughly understand the Party's guidelines and policies, the State's policies and laws; knowledge of management in the industry, strategy, planning, development of the inland waterway sector;

b) Possess the ability to compile and report, coordinate activities, work independently and in teams; have the capacity to implement tasks ensuring progress, quality, and effectiveness;

c) Possess skills in drafting documents and presenting issues assigned for research and advisory purposes;

d) Proficiently use office equipment and other tools necessary for task requirements.

Chapter III

SALARIES FOR THE POSITION OF WATERWAY PROJECT MANAGEMENT SPECIALIST CIVIL SERVANT

Article 8. Principles for grading salaries for professional positions in project management for inland waterways for specialized civil servants

1. The appointment and salary grading for professional positions in project management for inland waterways for specialized civil servants must be based on the job position, responsibilities, expertise, and vocational qualifications currently held, and must fully meet the standards as prescribed in this Circular.

2. When transferring to a corresponding professional position in project management for inland waterways, it shall not combine with increasing salary grade or upgrading the professional position for specialized civil servants.

Article 9. Grading salaries for professional positions in project management for inland waterways

1. From the date this Circular takes effect, in cases where specialized civil servants do not yet meet the criteria and conditions for appointment to professional positions in project management for inland waterways as stipulated in Articles 4, 5, 6, and 7 of this Circular, the following measures shall be implemented:

a) If the specialized civil servant still has less than five years (60 months) of service until retirement, they shall continue to hold their current rank or professional position level and be graded according to the current salary scale.

b) If the specialized civil servant still has five years (60 months) or more of service remaining, within three years (36 months), the employing agency shall be responsible for arranging training to ensure that the specialized civil servant meets the criteria for the professional position level in project management for inland waterways as prescribed in this Circular. After the time specified in this point, if the specialized civil servant does not meet the prescribed criteria, the head of the public institution shall consider assigning other suitable work or implementing policies as prescribed.

2. The professional positions for specialized civil servants in project management for inland waterways as prescribed in this Circular shall apply the Professional and Vocational Salary Scale for cadres and civil servants in state-run institutions (Table 3) issued together with Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, and armed forces personnel, as follows:

a) The professional position Project Manager for Inland Waterways Level I shall apply the salary coefficient for civil servants type A3, group 1 (A3.1) from coefficient 6.20 to coefficient 8.00;

b) The professional position Project Manager for Inland Waterways Level II shall apply the salary coefficient for civil servants type A2, group 1 (A2.1) from coefficient 4.40 to coefficient 6.78;

c) The professional position Project Manager for Inland Waterways Level III shall apply the salary coefficient for civil servants type A1 from coefficient 2.34 to coefficient 4.98;

d) The professional position Project Manager for Inland Waterways Level IV shall apply the salary coefficient for civil servants type A0 from coefficient 2.10 to coefficient 4.89.

3. The transfer of salary grading for specialized civil servants currently holding civil servant ranks who are to be transferred to professional positions in project management for inland waterways as prescribed in this Circular shall be carried out in accordance with the guidance provided in Clause 2, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs on salary grading when promoting ranks, transferring ranks, or changing types of civil servants, specifically as follows:

a) Grade the professional position Project Manager for Inland Waterways Level I, code V.12.51.01 for civil servants currently holding type A3, group 1 (A3.1);

b) Grade the professional position Project Manager for Inland Waterways Level II, code V.12.51.02 for civil servants currently holding type A2, group 1 (A2.1);

c) Grade the professional position Project Manager for Inland Waterways Level III, code V.12.51.03 for civil servants currently holding type A1;

d) Grade the professional position Project Manager for Inland Waterways Level IV, code V.12.51.04 for civil servants currently holding type A0.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Effective Date

1. This Circular takes effect from March 1, 2023.

2. In cases where the legal normative documents referred to in this Circular are amended, supplemented, or replaced, implementation shall be in accordance with the provisions of the amended, supplemented, or replacing documents.

Article 11. Implementation Organization

The Head of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Inland Waterway Administration, the Heads of agencies, units, organizations, and individuals concerned are responsible for implementing this Circular./.
