Amending and supplementing certain Articles of Circular No. 57/2018/TT-BCT dated December 26, 2018 of the Minister of Industry and Trade detailing certain provisions of Decrees related to tobacco business
Pursuant to the Law on Prevention and Control of Harmful Effects of Tobacco;
Based on Decree No. 96/2022/NĐ-CP dated November 29, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 67/2013/NĐ-CP dated June 27, 2013 of the Government detailing certain provisions and measures for implementing the Law on Prevention and Control of Harmful Effects of Tobacco regarding tobacco business;

Pursuant to Decree No. 08/2018/NĐ-CP dated January 15, 2018, issued by the Government, amending certain Decrees related to investment conditions within the scope of management by the Ministry of Industry and Trade;
Pursuant to Decree No. 17/2020/NĐ-CP dated February 5, 2020 of the Government amending and supplementing certain provisions of Decrees related to investment conditions in the field under the management of the Ministry of Industry and Trade;
Implementing Decision No. 1015/QĐ-TTg dated August 30, 2022 of the Prime Minister approving the plan for decentralization in handling administrative procedures within the scope of management of Ministries and equivalent Ministries;
At the proposal of the Director of the Industry Department and the Director of the Import-Export Department,
The Minister of Industry and Trade issues this Circular amending and supplementing certain Articles of Circular No. 57/2018/TT-BCT dated December 26, 2018 of the Minister of Industry and Trade detailing certain provisions of Decrees related to tobacco business.
Article 1. Amend Clause 1 and Clause 9 of Article 13 of Circular No. 57/2018/TT-BCT dated December 26, 2018 of the Minister of Industry and Trade detailing certain provisions of Decrees related to tobacco business.
2. Article 22 is amended as follows:
"1. Every six months, tobacco product manufacturing enterprises and tobacco importers must submit reports to the Ministry of Industry and Trade on their tobacco product manufacturing activities and tobacco imports (before January 10 each year for annual reports and before July 10 each year for mid-year reports) according to Form Appendix 7 attached to this Circular."
"9. Every six months, tobacco product suppliers must submit statistical reports on production volume and types of tobacco products they sell (by distribution system, wholesale, retail) to the Domestic Market Department of the Ministry of Industry and Trade and the Department of Industry and Trade where the enterprise's headquarters is located (before January 10 each year for annual reports and before July 10 each year for mid-year reports) according to Forms Appendix 8 and 9 attached to this Circular."
1. Amend Point a and b of Clause 1 as follows:
"a) Receiving applications, inspecting, supervising, reviewing, and submitting to the Ministry’s leadership for approval on investment proposals for tobacco product manufacturing, tobacco leaf processing permits, and tobacco product manufacturing permits.
b) Receiving applications, inspecting, supervising, reviewing, and submitting to the Ministry’s leadership for comments before responding to enterprises on administrative procedures: importing tobacco for non-commercial purposes; investing in modernizing equipment and technology, exporting tobacco production, processing tobacco for export, relocating according to planning; investing in tobacco leaf processing; importing tobacco leaves for processing tobacco leaves for export or processing tobacco leaves for export; importing tobacco leaves, cigarette paper for exporting tobacco products or processing exported tobacco products; importing specialized tobacco machinery and equipment; notifying import quotas for tobacco leaves, cigarette paper."
2. Add Point d of Clause 1 as follows:
"d) Receiving applications, inspecting, supervising, reviewing, and submitting to the Ministry’s leadership for approval on other activities related to tobacco business as prescribed."
1. Enterprises importing tobacco for non-commercial purposes shall submit registration forms according to Form Appendix 1 attached hereto to the Industry Department under the Ministry of Industry and Trade.
2. Enterprises investing in modernizing equipment and technology, production of tobacco for export, processing tobacco for export, relocation according to planning; investment in processing tobacco raw materials shall submit registration forms according to Form Appendix 2 attached hereto to the Industry Department under the Ministry of Industry and Trade.
3. Enterprises importing machinery and specialized equipment for tobacco shall submit registration forms according to Form Appendix 3 attached hereto to the Industry Department under the Ministry of Industry and Trade.
4. Enterprises importing tobacco raw materials for processing tobacco raw materials for export or processing tobacco raw materials for export shall submit registration forms according to Form Appendix 4 attached hereto to the Industry Department under the Ministry of Industry and Trade.
5. Enterprises importing tobacco raw materials and cigarette paper for producing tobacco products for export or processing export tobacco products shall submit registration forms according to Form Appendix 5 attached hereto to the Industry Department under the Ministry of Industry and Trade.
6. Enterprises importing tobacco raw materials and cigarette paper for producing tobacco products for domestic consumption shall submit registration forms according to Form Appendix 6 attached hereto to the Industry Department under the Ministry of Industry and Trade.
The forms of documents for responding to the importation of tobacco products for non-commercial purposes; investment in modernizing equipment and technology, production of tobacco for export, processing tobacco for export, relocation according to planning; investment in processing tobacco raw materials; import of machinery and specialized equipment for tobacco; import of tobacco raw materials for processing tobacco raw materials for export or processing tobacco raw materials for export; import of tobacco raw materials and cigarette paper for producing tobacco products for export or processing export tobacco products; import of tobacco raw materials and cigarette paper for producing tobacco products for domestic consumption shall be according to Form Appendices 10, 11, 12, 13, 14, and 15 attached hereto.
Article 5. Detailed list according to HS code for tobacco raw materials, cigarette paper
Attached herewith as Appendix 16 is the Detailed List according to HS Code for Tobacco Raw Materials, Cigarette Paper.
Article 6. Repeal certain Appendices attached to Circular No. 57/2018/TT-BCT dated December 26, 2018 of the Minister of Industry and Trade detailing certain provisions of Decrees related to tobacco business and Circular No. 08/2023/TT-BCT dated March 31, 2023 of the Minister of Industry and Trade amending and supplementing certain provisions on the Detailed List according to HS Code for export and import goods issued together with some Circulars of the Minister of Industry and Trade as follows:
1. Repeal Appendix IV - Detailed List according to HS Code for Tobacco Raw Materials, Cigarette Paper issued together with Circular No. 08/2023/TT-BCT dated March 31, 2023 of the Minister of Industry and Trade amending and supplementing certain provisions on the Detailed List according to HS Code for export and import goods issued together with some Circulars of the Minister of Industry and Trade.
2. Repeal Appendix 1, Appendix 2, Appendix 3, Appendix 59, Appendix 67, Appendix 68 issued together with Circular No. 57/2018/TT-BCT dated December 26, 2018 of the Minister of Industry and Trade detailing certain provisions of Decrees related to tobacco business.
Article 7. Transitional Provisions
1. In cases where applications have been accepted for administrative procedures stipulated in Article 2 of this Circular before the effective date of this Circular, they shall continue to be processed in accordance with the laws at the time of application acceptance.
2. For approval documents and consent documents for administrative procedures stipulated in Article 2 of this Circular before the effective date of this Circular, they shall remain valid until the end of their validity period.
Article 8. Effective Date
1. This Circular takes effect from February 12, 2024.
2. During implementation, individuals and organizations are requested to promptly reflect difficulties and obstacles to the Ministry of Industry and Trade so that the Ministry can resolve them and consider amending this Circular within its authority./.
