DECREE

Providing detailed regulations on awarding the titles

"People's Artisan", "Outstanding Artisan"

in the field of craft industries

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Encouragement and Reward dated June 15, 2022;

Pursuant to the Law on Cultural Heritage dated June 29, 2001; the Law Amending and Supplementing Certain Provisions of the Law on Cultural Heritage dated June 18, 2009;

At the proposal of the Minister of Industry and Trade;

The Government issues this Decree providing detailed regulations on awarding the titles "People's Artisan", "Outstanding Artisan" in the field of craft industries.

 PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree provides detailed regulations on the subjects, criteria, procedures, formalities, and activities for awarding the titles "People's Artisan", "Outstanding Artisan" in the field of craft industries.

Article 2. Applicability

1. Individuals are Vietnamese citizens working in the field of craft industries.

2. Organizations and individuals related to the activities of awarding and presenting the titles "People's Artisan", "Outstanding Artisan" in the field of craft industries.

3. This Decree does not apply to individuals who are currently being considered for or have been awarded the titles "People's Artisan", "Outstanding Artisan" in the field of intangible cultural heritage regarding traditional craft trades.

Article 3. Explanation of Terms

In this Decree, the following terms are understood as follows:

1. Craft industry is a trade that is passed down from generation to generation; products and works created have cultural and artistic characteristics, and the production and creation of products and works are mainly done by hand or the decisive quality and form of the product are still made by hand.

2. Special craft industry is a craft industry at risk of disappearing, with few learners, difficult teaching methods, and long teaching periods.

3. Handicraft products are products of handicrafts where the cultural and aesthetic functions become more important than their common usage functions.

Article 4. Time for awarding the titles "People's Artisan", "Outstanding Artisan"

The titles "People's Artisan", "Outstanding Artisan" in the field of craft industries shall be awarded and announced according to the provisions of Clause 4, Article 67 of the Law on Competition and Rewards.

Article 5. Rights and Obligations of "People's Artisan", "Outstanding Artisan"

Individuals awarded the titles "People's Artisan", "Outstanding Artisan" shall have the following rights and obligations:

1. Receiving the Medal, Certificate of Award from the President of the State and monetary rewards accompanying the title "People's Artisan" or "Outstanding Artisan" as prescribed by law.

2. Actively teaching and preserving the trade, continuously improving skills and techniques in the trade.

3. Actively participating in activities to protect and promote the value of cultural heritage in the field of craft industries initiated by provinces, cities, ministries, central agencies, and mass organizations.

4. Other rights and obligations as prescribed by law.

Chapter II

CRITERIA FOR AWARDING THE TITLES "PEOPLE'S ARTISAN", "OUTSTANDING ARTISAN"

Article 6. Criteria for awarding the title "People's Artisan"

The title "People's Artisan" in the field of craft industries shall be awarded to individuals specified in Clause 1, Article 2 of this Decree who have been awarded the title "Outstanding Artisan" in the field of craft industries and meet the following criteria:

1. Loyalty to the Socialist Republic of Vietnam; strictly adhering to the Party's policies, state laws, rules, and regulations of the agency, organization, or locality.

2. Having a continuous work period of 20 years or more in the craft industry.

3. Possessing good moral character, being exemplary in life; passionate and dedicated to the trade; respected and admired by colleagues and the public; representing the outstanding achievements in protecting and promoting the value of cultural heritage in the field of craft industries nationwide.

4. Having exceptional knowledge and skills, specifically:

a) After being awarded the title "Outstanding Artisan", the Artisan must directly design and create two new products or works of high economic, technical, and artistic value, meeting one of the following criteria: winning second place or higher in national-level competitions related to handicraft products organized by competent authorities; participating in international-level activities in the field of craft industries and achieving third place or higher results; recognized and rated as outstanding at the national level in the field of handicrafts by competent state authorities;

b) In cases where "Outstanding Artisans" are over 70 years old and do not meet the criteria under point a of this clause, they must meet one of the following criteria: being a member of a minority ethnic group (currently engaged in the trade and living stably in ethnic minority areas for five years or more); having two or more products or works selected as gifts for foreign dignitaries by Party and State leaders according to diplomatic protocol; chosen by a national museum for display; used in national-level restoration projects of historical and cultural sites (cultural emblematic projects).

5. Making significant contributions to the protection and promotion of the value of cultural heritage in the field of craft industries nationwide; possessing and passing on skills and secrets of the trade to at least 150 individuals, except in cases of special craft industries, or to at least 20 individuals currently working in the trade for over ten years at production facilities, or to at least one individual awarded the title "Outstanding Artisan" in the field of craft industries by the state.

Article 7. Criteria for awarding the title "Outstanding Artisan"

The title "Outstanding Artisan" in the field of craft art shall be awarded to individuals specified in Clause 1, Article 2 of this Decree who meet the following criteria:

1. Loyalty to the Socialist Republic of Vietnam; strictly adhering to the Party's policies, state laws, rules, and regulations of the agency, organization, or locality.

2. Having continuously worked in the craft art field for at least 15 years or more.

3. Possessing good moral qualities, being exemplary in life; passionate and dedicated to their profession, respected and admired by colleagues and the people; representing the outstanding achievements in protecting and promoting cultural heritage values in the craft art field of the locality.

4. Having exceptional knowledge and skills, specifically:

a) Directly designing and producing at least 10 works or products with high economic, technical, and artistic value.

b) Having products or works that have achieved one of the following criteria: winning second place or higher in craft art product-related competitions organized by authorized agencies at provincial level or third place or higher nationwide; being selected by the State of Vietnam to participate in activities in the craft art field and achieving regional or international third place or higher awards; being recognized and rated as outstanding at the national level by authorized state agencies in the craft art field; being chosen as display items by national museums or provincial museums; being used as models for teaching in vocational education institutions and universities in the craft art field; being used in restoration projects of historical and cultural relics (cultural emblematic projects) at provincial or national levels.

5. Making significant contributions to the protection and promotion of cultural heritage values in the craft art field of the locality; possessing skills and secrets, and teaching the profession to at least 100 individuals, except in special craft art cases, or to at least 15 individuals currently working in the profession for over 10 years at production facilities.

Chapter III

THE COUNCIL FOR AWARDING THE TITLES "PEOPLE'S ARTISAN" AND "OUTSTANDING ARTISAN"

Article 8. Tasks, principles of operation, and composition of the Council for awarding the titles "People's Artisan" and "Outstanding Artisan" in the craft art field

1. The Council for awarding the titles "People's Artisan" and "Outstanding Artisan" shall be established at each level of the Council, for each awarding session, and the Councils shall dissolve themselves after completing their tasks.

2. Levels of the Council

a) Provincial-level Councils (hereinafter referred to as Provincial Councils);

b) Ministry-level specialized Councils;

c) National-level Council.

3. The Council for awarding the titles "People's Artisan" and "Outstanding Artisan" shall have the following tasks:

a) Organizing the awarding process in accordance with the provisions of this Decree (including awarding to deceased individuals if they have completed the required documentation and been submitted by the Provincial Council to the Ministry-level specialized Council);

b) Publicizing the list of individuals proposed for awarding and the results of selection on various media channels;

c) Completing the awarding documentation and submitting it to the competent Council;

d) Considering and resolving any petitions related to the awarding process.

4. The Council for awarding the titles "People's Artisan" and "Outstanding Artisan" shall operate according to the following principles:

a) Democracy, transparency, secret ballot;

b) Meetings of the Council for awarding the titles "People's Artisan" and "Outstanding Artisan" shall be held when at least 75% of the total number of Council members are present, including the Chairman of the Council or the Deputy Chairman of the Council authorized to attend. The Secretariat has the responsibility to collect opinions from absent members through Ballot Forms No. 07 and No. 08 attached to this Decree;

c) The National-level Council shall only consider files submitted by the Ministry-level specialized Council, and the Ministry-level specialized Council shall only consider files submitted by the Provincial Council; not considering files that do not comply with the legal regulations on commendation and reward;

d) The Provincial Council shall submit to the Ministry-level specialized Council, the Ministry-level specialized Council shall submit to the National-level Council, and the National-level Council shall submit to the Prime Minister the list of individuals receiving at least 90% of the votes of Council members agreeing on the total number of Council members;

đ) Individuals under consideration for the titles "People's Artisan" and "Outstanding Artisan" shall not participate in Councils at all levels;

e) In one awarding session, a member of the Provincial Council shall not simultaneously be a member of the Ministry-level specialized Council or the National-level Council.

5. The composition of the Council for awarding the titles "People's Artisan" and "Outstanding Artisan" includes the Chairman of the Council, the Deputy Chairman of the Council, and Council Members who are representatives of units managing the craft art field, political-social organizations, social-professional organizations related to the craft art field, and individuals with credibility and expertise in the craft art field and artisans.

6. The Chairman of the Council for awarding the titles "People's Artisan" and "Outstanding Artisan" decides to establish the Secretariat to assist the Council.

Article 9. Provincial Council

1. The Provincial Council shall be established by the Chairman of the Provincial People's Committee upon the proposal of the Director of the Department of Industry and Trade, consisting of from 10 to 13 members, including:

a) Chairperson of the Council: A leader of the Provincial People's Committee;

b) Vice-Chairperson of the Council: A leader of the Department of Industry and Trade;

c) Other members of the Council.

2. The permanent office of the Provincial Council is the Department of Industry and Trade. The Provincial Council uses the seal of the Provincial People's Committee.

Article 10. Ministry-level Professional Council

1. The Ministry-level Professional Council shall be established by the Minister of Industry and Trade upon the proposal of the Director of the Department of Local Industry and Trade, consisting of from 10 to 13 members, including:

a) Chairperson of the Council: A leader of the Ministry of Industry and Trade;

b) Vice-Chairperson of the Council: A leader of the Department of Local Industry and Trade under the Ministry of Industry and Trade;

c) Other members of the Council.

2. The permanent office of the Ministry-level Professional Council is the Department of Local Industry and Trade under the Ministry of Industry and Trade. The Ministry-level Professional Council uses the seal of the Ministry of Industry and Trade.

Article 11. National Council

1. The National Council shall be established by the Prime Minister upon the proposal of the Minister of Industry and Trade, consisting of from 10 to 13 members, including:

a) Chairperson of the Council: The Minister of Industry and Trade;

b) Vice-Chairperson of the Council: A leader of the Ministry of Industry and Trade; A leader of the Ministry of Home Affairs;

c) Other members of the Council.

2. The permanent office of the National Council is the Ministry of Industry and Trade. The National Council uses the seal of the Ministry of Industry and Trade.

Chapter IV

DOCUMENTS, PROCEDURES AND FORMALITIES FOR PROPOSING TO AWARDS THE TITLES OF "PEOPLE'S ARTIST" AND "OUTSTANDING ARTIST"

Article 12. Documents for Proposing to Award

1. The documents for proposing to award for individuals include:

a) The application form for the title of "People's Artist" according to Form No. 01 and the application form for the title of "Outstanding Artist" according to Form No. 02 attached as an appendix to this Decree;

b) One of the following documents proving contributions to preserving, transmitting, and teaching skills: Video tape or disc or photographs describing the skills and techniques currently possessed or a certified copy in case the individual submits the application through postal service, a photocopied original (with the original for comparison) in case the individual submits directly certificates or decisions on awards such as Orders, Medals, Prizes, Certificates of Merit, or other related documents.

2. The documents of the Provincial Council submitted to the Ministry-level Professional Council include:

a) The report of the Provincial Council according to Form No. 03 attached as an appendix to this Decree;

b) The list of proposed titles of "People's Artist" and "Outstanding Artist" according to Form No. 04 attached as an appendix to this Decree, accompanied by the individual's documents as stipulated in Clause 1 of this Article;

c) The minutes of the meeting of the Provincial Council according to Form No. 05 attached as an appendix to this Decree; the ballot counting record (with stamp affixed) accompanied by the ballots of the Council members according to Forms No. 06, No. 07, and No. 08 attached as an appendix to this Decree;

d) A summary of the achievements of the individual according to the list submitted at point b of this clause according to Form No. 09 attached as an appendix to this Decree;

đ) Written opinions of relevant competent authorities regarding the documents for proposing to award national honors;

e) Decision on establishing the Provincial Council.

3. The documents of the Ministry-level Professional Council submitted to the National Council include:

a) The report of the Ministry-level Professional Council according to Form No. 03 attached as an appendix to this Decree;

b) The list of proposed titles of "People's Artist" and "Outstanding Artist" according to Form No. 04 attached as an appendix to this Decree, accompanied by the individual's documents as stipulated in Clause 1 of this Article;

c) The minutes of the meeting of the Ministry-level Professional Council according to Form No. 05 attached as an appendix to this Decree; the ballot counting record (with stamp affixed) accompanied by the ballots of the Council members according to Forms No. 06, No. 07, and No. 08 attached as an appendix to this Decree;

d) A summary of the achievements of the individual according to the list submitted at point b of this clause according to Form No. 09 attached as an appendix to this Decree;

đ) Decision on establishing the Ministry-level Professional Council.

4. The documents of the National Council submitted to the Prime Minister include:

a) The report of the National Council according to Form No. 03 attached as an appendix to this Decree;

b) The list of proposed titles of "People's Artist" and "Outstanding Artist" according to Form No. 04 attached as an appendix to this Decree, accompanied by the individual's documents as stipulated in Clause 1 of Article 1 of this Decree;

c) The minutes of the meeting of the National Council according to Form No. 05 attached as an appendix to this Decree; the ballot counting record (with stamp affixed) accompanied by the ballots of the Council members according to Forms No. 06, No. 07, and No. 08 attached as an appendix to this Decree;

d) A summary of the achievements of the individual according to the list submitted at point b of this clause according to Form No. 09 attached as an appendix to this Decree;

đ) Decision on establishing the National Council.

Article 13. Submission and Acceptance of Application Files for Award Consideration

1. The individual applying for award consideration shall submit one set of application files directly, through postal service, or online, in accordance with the time specified in the Plan for Awarding the Titles "People's Artist" and "Outstanding Artist" to the Department of Industry and Trade where the individual applies for consideration.

2. The agency accepting the application files shall be responsible for checking the validity and completeness of the documents and materials in the file according to regulations and provide a written response within ten days from the date of receipt of the file. In cases where the individual's application file is invalid and requires supplementation or correction, the agency accepting the application files shall guide the individual to complete the file. Within fifteen days from the date of receiving the returned file, the individual shall complete and resubmit the file to the agency accepting it.

Article 14. Procedures and Formalities for Award Consideration at the Provincial Council

1. The permanent office of the provincial council has the responsibility to assist the council in performing the following tasks:

a) Submitting to the Chairman of the People's Committee of the province for a decision to establish the provincial council for awarding the titles "People's Artist" and "Outstanding Artist";

b) Publicizing the list of individuals applying for award consideration on the province's or centrally-administered city's media channels (newspapers, electronic information portals, radio and television stations...) at least fifteen days before the meeting of the council;

c) Sending the application files and materials to the members of the provincial council and organizing a meeting of the council to select candidates.

2. The provincial council shall organize the examination of application files and proceed with selection as follows:

a) Examining the contents of the documents in the file and considering whether the individual meets the criteria for each title as stipulated in this Decree;

b) Conducting practical evaluations of individuals applying for the titles "People's Artist" and "Outstanding Artist" at production sites;

c) Receiving and processing complaints from organizations and individuals (if any) and conducting secret ballots to select individuals who meet the criteria for award consideration of the titles "People's Artist" and "Outstanding Artist" to be submitted to the ministerial-level specialized council;

d) Publicly announcing the results of the selection on the province's or centrally-administered city's media channels (newspapers, electronic information portals, radio and television stations...) for at least fifteen days;

đ) Sending a report on the results of the selection of the provincial council together with one set of application files prescribed in Clause 1 and Clause 2, Article 12 of this Decree along with an electronic file of the application (excluding documents containing state secrets) to the ministerial-level specialized council according to the time specified in the Plan for Awarding the Titles "People's Artist" and "Outstanding Artist";

e) Notifying the results of the selection in writing to the individual who submitted the application file.

3. The period for organizing the award consideration of the titles "People's Artist" and "Outstanding Artist" in the field of craft in the provincial council shall not exceed ninety days.

Article 15. Procedures and Formalities for Award Consideration at the Ministerial-Level Specialized Council

1. The permanent office of the ministerial-level specialized council has the responsibility to assist the council in performing the following tasks:

a) Submitting to the Minister of Industry and Trade for a decision to establish the ministerial-level specialized council;

b) Receiving and checking the validity and completeness of the documents and materials in the application file sent by the provincial council; in cases requiring supplementation or correction, providing written guidance for the provincial council to complete and resubmit within the latest fifteen days from the date of receipt of the guidance document;

c) Publicizing the list of individuals proposed for award consideration by the provincial council on the Ministry of Industry and Trade's electronic information portal for at least fifteen days;

d) Sending the application files and materials to the members of the ministerial-level specialized council and organizing a meeting of the council to select candidates.

2. The ministerial-level specialized council shall organize the examination of application files and proceed with selection as follows:

a) Examining the contents of the documents in the file and considering whether the individual meets the criteria for each title as stipulated in this Decree;

b) Conducting practical evaluations of individuals applying for the titles "People's Artist" and "Outstanding Artist" (if necessary) at production sites;

c) Receiving and processing complaints from organizations and individuals (if any) and conducting secret ballots to select individuals who meet the criteria for award consideration of the titles "People's Artist" and "Outstanding Artist" to be submitted to the State-level council;

d) Announcing the results of the selection on the Ministry of Industry and Trade's electronic information portal for at least fifteen days;

đ) Sending a report on the results of the selection of the ministerial-level specialized council together with one set of application files prescribed in Clause 3, Article 12 of this Decree to the State-level council according to the time specified in the Plan for Awarding the Titles "People's Artist" and "Outstanding Artist";

e) Notifying the results of the selection in writing to the provincial council that submitted the application file.

3. The period for organizing the award consideration of the titles "People's Artist" and "Outstanding Artist" in the field of craft in the ministerial-level specialized council shall not exceed one hundred twenty days.

Article 16. Procedure and formalities for awarding at the State Council

1. The permanent office of the State Council shall have the duty to assist the Council in performing the following tasks:

a) Submitting to the Prime Minister for decision on establishing the State Council;

b) Receiving, examining the validity and completeness of documents and materials in the dossier sent by the specialized council of the ministry; in cases where supplementation or modification of the dossier's documents is required, providing guidance for the specialized council of the ministry to complete and resubmit within no more than 10 days from the date of receipt of the guidance document;

c) Publicizing the list of individuals proposed for awarding by the specialized council of the ministry on the Government’s Electronic Information Portal and through mass media for public opinion collection for a minimum period of 15 days;

d) Sending the award proposal documents and dossier to members of the Council and organizing a meeting of the Council to select awardees.

2. The State Council shall organize the examination of dossiers and selection as follows:

a) Examining the contents of the documents in the file and considering whether the individual meets the criteria for each title as stipulated in this Decree;

b) Receiving and processing complaints and suggestions from organizations and individuals (if any), and conducting secret ballot voting to select individuals who meet the criteria for the title of "People's Artist" and "Outstanding Artist";

c) Announcing the results of the selection on the Government’s Electronic Information Portal and through mass media for a minimum period of 15 days;

d) Completing the dossier, submitting it to the Prime Minister for review, and presenting it to the President for decision to confer the titles of "People's Artist" and "Outstanding Artist";

đ) Submitting a report on the selection results of the State Council together with one set of the dossier specified in Clause 4, Article 12 of this Decree to the Ministry of Industry and Trade for consolidation and submission to the Prime Minister according to the time stipulated in the Plan for conferring the titles of "People's Artist" and "Outstanding Artist";

e) Notifying the results of the selection in writing to the specialized council of the ministry.

3. The time for organizing the awarding of the titles of "People's Artist" and "Outstanding Artist" in the field of traditional craft at the State Council shall not exceed 120 days.

Article 17. Announcement of the President's Decision to confer and present the titles of "People's Artist" and "Outstanding Artist"

The People's Committee of provinces and centrally-administered cities shall organize the ceremony to announce and present the titles to "People's Artists" and "Outstanding Artists" in the field of traditional craft.

Chapter V

IMPLEMENTING PROVISIONS

Article 18. Transitional Provisions

Individuals with dossiers proposing for the awarding of the titles of "People's Artist" and "Outstanding Artist" that comply with the regulations and were submitted to the Department of Industry and Trade before the effective date of this Decree, which are currently undergoing the awarding process according to Decree No. 123/2014/NĐ-CP dated December 25, 2014 of the Government on awarding the titles of "People's Artist" and "Outstanding Artist" in the field of traditional craft, shall continue to follow Decree No. 123/2014/NĐ-CP.

Article 19. Effective Date

1. This Decree takes effect from June 6, 2024.

2. Decree No. 123/2014/NĐ-CP dated December 25, 2014 of the Government on awarding the titles of "People's Artist" and "Outstanding Artist" in the field of traditional craft shall cease to be effective from the date this Decree takes effect.

Article 20. Responsibility for Implementation

1. The Ministry of Industry and Trade shall be responsible for implementing this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial and centrally-administered city People's Committees, relevant agencies, organizations, and individuals shall be responsible for enforcing this Decree.
