RESOLUTION

REGULATING THE COMMEMORATIVE MEDAL "FOR THE CAUSE OF THE VIETNAMESE NATIONAL ASSEMBLY"

USTANDING COMMITTEE OF THE NATIONAL ASSEMBLY

On the basis of the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on the Organization of the National Assembly No. 57/2014/QH13, as amended and supplemented by Law No. 65/2020/QH14; supplemented Pursuant to the Law on Encouragement, Commendation, and Reward No. 06/2022/QH15;

This Resolution regulates the name, recipients, and criteria for awarding the Commemorative Medal of the Standing Committee of the National Assembly.

RESOLUTION:

Article 1. Scope of Regulation

Article 2. Name of the commemorative medal

The Commemorative Medal of the Standing Committee of the National Assembly shall be named "Commemorative Medal For the Cause of the Vietnamese National Assembly" (hereinafter referred to as the Commemorative Medal), awarded to individuals who have contributed to the development process of the Vietnamese National Assembly.

2. Ensure consistency between the form of commendation, the recipient, and the achievements and merits attained.

Article 3. Principles for awarding the Commemorative Medal

1. Accuracy, transparency, fairness, and timeliness.

3. Each individual may only be awarded the Commemorative Medal once.

Article 4. Recipients eligible for the Commemorative Medal

1. Leaders and former leaders of the Party and State; leaders of the Central Committee of the Vietnam Fatherland Front.

2. Leaders of central ministries, agencies, political and social organizations; leaders of provinces and centrally-administered cities.

3. Chairperson, Vice-Chairpersons, Members of the Standing Committee of the National Assembly, Secretary-General of the National Assembly - Director of the National Assembly Office, Chairperson of the Ethnic Council, Chairpersons of Committees of the National Assembly, and Heads of Departments under the Standing Committee of the National Assembly.

Former Chairpersons, former Vice-Chairpersons, former Members of the Standing Committee of the National Assembly, former Secretary-Generals of the National Assembly, former Directors of the National Assembly Office, former Chairpersons of the Ethnic Council, former Chairpersons of Committees of the National Assembly, and former Heads of Departments under the Standing Committee of the National Assembly.

4. National Assembly Deputies.

5. Leaders of the National Assembly Office, leaders of agencies under the Standing Committee of the National Assembly, and civil servants and public officials under the management authority of the Standing Committee of the National Assembly.

6. Civil servants, public officials, and workers of the National Assembly Office, Institute for Legislative Research, Office of the Delegation of the National Assembly and People's Councils of provinces and centrally-administered cities.

7. Vietnamese citizens not included in the categories specified in Clauses 1, 2, 3, 4, 5, and 6 of this Article.

8. Overseas Vietnamese and foreigners.

Article 5. Recipients not eligible for the Commemorative Medal

1. Recipients not eligible for the Commemorative Medal include:

a) Individuals during the period when the competent authority is considering disciplinary action or investigating, auditing, inspecting, or verifying violations of laws or complaints and reports, or corruption and negative issues that are being clarified;

b) Individuals currently being prosecuted criminally or serving a disciplinary punishment.

2. Recipients not eligible for the Commemorative Medal include:

a) National Assembly Deputies dismissed from office; civil servants and public officials dismissed from service; workers specified in Clause 6 of Article 4 of this Resolution who have been dismissed;

b) Individuals convicted by a court decision with legal effect.

Article 6. Criteria for awarding the Commemorative Medal

1. Individuals specified in Clauses 1, 2, and 3 of Article 4 of this Resolution comply well with the Party's policies and the State's laws and have contributed to the development process of the Vietnamese National Assembly.

2. Individuals specified in Clause 4 and Clause 5 of Article 4 of this Resolution comply well with the Party's policies and the State's laws and meet one of the following criteria:

a) Have served as a National Assembly Deputy for at least one full term;

b) Leaders of the National Assembly Office, leaders of agencies under the Standing Committee of the National Assembly, and civil servants and public officials under the management authority of the Standing Committee of the National Assembly have held their positions for at least five years, excluding time spent serving disciplinary punishments.

3. Individuals specified in Clause 6 of Article 4 of this Resolution comply well with the Party's policies and the State's laws and meet the following criteria:

a) Have been awarded a Commemorative Medal by the National Assembly Office;

b) Have performed excellently for at least five years since receiving the Commemorative Medal from the National Assembly Office.

4. Individuals specified in Clause 7 of Article 4 of this Resolution comply well with the Party's policies and the State's laws and meet one of the following criteria:

a) Have made meritorious contributions to the development process of the Vietnamese National Assembly;

b) Have proposed scientific topics, research projects, and scientific and technological works recognized or accepted by competent state authorities and have practical value, making significant and effective contributions to the development process of the Vietnamese National Assembly.

5. Individuals specified in Clause 8 of Article 4 of this Resolution comply well with Vietnamese laws and meet one of the following criteria:

a) Have contributed to the development process of the Vietnamese National Assembly;

b) Have contributed to building and strengthening cooperative relations between countries and international organizations and the Vietnamese National Assembly.

6. Other cases shall be decided by the Standing Committee of the National Assembly.

Article 7. Authority to propose and submit for consideration the awarding of Commemorative Medals and the issuance of replacement Commemorative Medals

1. The Delegation Work Board proposes for consideration the awarding of Commemorative Medals to:

a) Leaders and former leaders of the Party and State; leaders of the Central Committee of the Vietnam Fatherland Front;

b) Chairpersons and Vice Chairpersons of the National Assembly, Members of the Standing Committee of the National Assembly, Secretary-General of the National Assembly - Director of the National Assembly Office, Chairperson of the Ethnic Council, Chairpersons of Committees of the National Assembly, and Heads of Departments under the Standing Committee of the National Assembly;

c) Former Chairpersons and Vice Chairpersons of the National Assembly, former Members of the Standing Committee of the National Assembly, former Secretary-Generals of the National Assembly, former Directors of the National Assembly Office, former Chairpersons of the Ethnic Council, former Chairpersons of Committees of the National Assembly, and former Heads of Departments under the Standing Committee of the National Assembly.

2. The Permanent Ethnic Council, the Permanent Committees of the National Assembly, agencies under the Standing Committee of the National Assembly, and the National Assembly Office propose for consideration the awarding of Commemorative Medals to:

a) Leaders of Ministries, sectors, and political-social organizations at the central level;

b) Full-time National Assembly deputies working at the central level, civil servants and public officials under the management authority of the Standing Committee of the National Assembly who are currently working at their respective agencies;

c) Vietnamese citizens specified in Clause 7, Article 4 of this Resolution; overseas Vietnamese, and foreigners.

3. The National Assembly Office proposes for consideration the awarding of Commemorative Medals to civil servants, officials, and employees of the National Assembly Office.

4. The Legislative Research Institute proposes for consideration the awarding of Commemorative Medals to civil servants, officials, and employees of the Legislative Research Institute.

5. The Delegation of National Assembly representatives proposes for consideration the awarding of Commemorative Medals to:

a) Leaders of provinces and centrally-administered cities;

b) National Assembly deputies belonging to the Delegation of National Assembly representatives, except in cases specified in Clauses 1 and 2 of this Article;

c) Civil servants and employees of the National Assembly Delegation Office and People's Council;

d) Vietnamese citizens specified in Clause 7, Article 4 of this Resolution.

6. The Delegation Work Board receives proposals for consideration of the awarding of Commemorative Medals from the relevant agencies and organizations specified in Clauses 2, 3, 4, and 5 of this Article through paper copies (originals) and electronic files (Word and PDF files) via the email box of the Delegation Work Board before December 1st each year; in other cases, they follow the guidance of the Delegation Work Board.

7. The Delegation Work Board compiles and reviews proposals for consideration of the awarding of Commemorative Medals to be submitted to the Standing Committee of the National Assembly for examination and decision.

8. In cases where Commemorative Medals are damaged or lost, individuals submit applications for replacement Commemorative Medals to the Delegation Work Board for review and issuance.

Article 8. Effective Date

This Resolution takes effect from February 5, 2024.

Article 9. Implementation Provisions

1. Models of Commemorative Medals, models of Certificates of Commemorative Medals, models of application documents for consideration of the awarding of Commemorative Medals, and models of applications for replacement Commemorative Medals are specified in the Appendix attached to this Resolution.

2. The Standing Committee of the National Assembly presents Commemorative Medals on the occasion of the anniversary of the General Election Day of the National Assembly of Vietnam (January 6), and presents them to newly-elected National Assembly deputies during the final session of the National Assembly term. In other cases, the presentation of Commemorative Medals is decided by the Standing Committee of the National Assembly.

3. The Ethnic Council, Committees of the National Assembly, agencies under the Standing Committee of the National Assembly, Provincial and Municipal Delegations of the National Assembly, and related agencies, organizations, units, and individuals are responsible for implementing this Resolution.
