Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Investment Management and Construction Regulations issued pursuant to Decree No. 42-CP dated July 16, 1996 of the Government;

Considering the proposal of the Minister of Agriculture and Rural Development at Circular No. 990-NN/HTQT/CV dated April 2, 1997 and the proposal of the Minister of Planning and Investment at Circular No. 3333-BKH/VPTĐ dated June 7, 1997,

DECISION:

Article 1.Approve the Feasibility Study for the Reforestation Project in Ha Tinh, Quang Binh, and Quang Tri Provinces funded by the Government of the Federal Republic of Germany without repayment, including the following main contents:

1. Project Name: Reforestation in Ha Tinh, Quang Binh, and Quang Tri Provinces.

2. Agency receiving aid and managing the Project: Ministry of Agriculture and Rural Development.

3. Agency implementing the Project: People's Committees of Ha Tinh, Quang Binh, and Quang Tri Provinces.

4. Project Implementation Period: 4 years and 6 months (from June 1997 to December 2001).

5. Project Implementation Area: 44 communes belonging to 10 districts of Ha Tinh, Quang Binh, and Quang Tri Provinces.

6. Project Objectives: To contribute to the implementation of the reforestation program and land protection in the three provinces of Ha Tinh, Quang Binh, and Quang Tri through assisting farmers in effective land use, ensuring ecological sustainability, while creating jobs and improving living standards for people in the project areas, with specific goals being:

- Planting new forests (including care and management, protection) covering 21,000 hectares.

- Supporting communes participating in the project in the ten districts of Ha Tinh, Quang Binh, and Quang Tri Provinces to develop land use plans down to village level within the first three years of project implementation.

7. Main investment contents:

- Agricultural and forestry extension services, supply of planting materials, technical assistance for forest planting, helping farmers use land effectively.

- Direct capital support for households participating in the project through savings deposits managed by the Vietnam Agricultural and Rural Development Bank for use in forest planting, care, and protection.

- Effective management and coordination of project activities.

8. Total Project Cost: 17,556,000 DM (German Deutsche Mark).

Where:

- The Government of the Federal Republic of Germany provides non-repayable aid of 15,000,000 DM;

- Counterpart funds from the Government of Vietnam: 2,556,000 DM (equivalent to 18,659 million Vietnamese Dong).

Article 2. Regarding organization and implementation: Entrust the Ministry of Agriculture and Rural Development as the agency receiving aid and managing the project, coordinating with the People's Committees of Ha Tinh, Quang Binh, and Quang Tri Provinces to direct basic investigations and land use planning for communes in the project area, based on which determine the areas for various types of planted forests; organize effective project management, efficient and economical management in accordance with the project's objectives and contents.

Article 3. The Ministry of Agriculture and Rural Development shall take the lead, together with the Ministry of Finance, the Ministry of Planning and Investment, and related ministries and sectors, to detail the financial agreement of the non-repayable aid project of the Government of the Federal Republic of Germany to ensure the correct and effective implementation of the project's objectives, mainly supporting reforestation, while studying and submitting to the Prime Minister for decision on policies for recovering capital through products for part of the capital invested in households for production forest planting.

Article 4.Based on the main contents of the approved feasibility study as stipulated in Article 1 of this Decision, authorize the Minister of Agriculture and Rural Development to sign the financial agreement of this project with representatives of the Government of the Federal Republic of Germany.

Article 5. Entrust the Ministry of Planning and Investment to take the lead, together with the Ministry of Finance, the Ministry of Agriculture and Rural Development, and the People's Committees of the project provinces, to consider incorporating the counterpart funds amounting to 2,050,000 DM (equivalent to 14,968 million Vietnamese Dong) based on actual investment costs into the annual state plan to implement the project.

Article 6.Ministers of the Ministries of Agriculture and Rural Development, Planning and Investment, Finance, Governor of the State Bank of Vietnam, Chairmen of the People's Committees of Ha Tinh, Quang Binh, and Quang Tri Provinces, and heads of relevant agencies are responsible for enforcing this Decision.
