Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

 Based on Decree No. 85/2003/NĐ-CP dated July 18, 2003, of the Government, stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Education and Training;

 Based on Directive No. 43/2001/CT-TTg dated June 11, 2001, of the Prime Minister on reforming the general education program to implement Resolution No. 40/2000/QH10 of the National Assembly;

 Based on Decision No. 43/2001/QĐ-BGDĐT dated November 9, 2001, of the Minister of Education and Training on issuing the primary school curriculum;

 In accordance with the proposal of the Director of the Primary Education Department,

Article 1. The accompanying Decision sets forth temporary regulations on the assessment and classification of first and second-grade students.

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette and shall be applied to first and second-grade students at all types of primary schools within the national education system starting from the 2003-2004 academic year. Third, fourth, and fifth-grade classes will continue to follow Circular No. 15/GD-ĐT dated August 2, 1995, issued by the Minister of Education and Training on assessing and classifying primary school students. This Decision replaces Decision No. 37/2002/QĐ-BGDĐT dated September 3, 2002, issued by the Minister of Education and Training on issuing temporary regulations on the assessment and classification of first-grade students. The Director of the Primary Education Department is responsible for guiding the implementation of this Decision.

Article 3. Chairmen of Provincial People's Committees, Chief of the Office, Directors of the Primary Education Departments, Heads of units related to the Ministry of Education and Training, and Directors of Departments of Education and Training are responsible for enforcing this Decision.

Temporary regulations on the assessment and classification of first and second-grade students

Chapter 1:

GENERAL PROVISIONS

Article 1. Scope of Regulation

This document contains provisions on principles, methods of assessment and classification of first and second-grade students; responsibilities of the state in assessing and classifying first and second-grade students.

Article 2. Principles of Assessment

The assessment and classification of first and second-grade students must ensure the following principles:

1. Contributing to the realization of educational goals, content, and activities.

2. Combining quantitative and qualitative assessments in classification.

3. Ensuring transparency, fairness, objectivity, accuracy, and comprehensiveness.

4. Emphasizing encouragement and motivation for student progress.

5. Promoting dynamism, creativity, self-study, and self-assessment abilities of students; fostering confidence and moral training according to Vietnamese traditions.

Chapter 2:

METHODS OF ASSESSMENT AND CLASSIFICATION

SECTION 1. ASSESSMENT OF MORAL CONDUCT

Article 3. Content of Observation and Assessment

Students are assessed on their conduct through observations (without classification) based on the results of fulfilling four tasks of primary school students as stipulated in the Charter of Primary Schools, specifically:

1. Obeying teachers and being polite in daily interactions; being united and supportive of friends.

2. Attending school regularly and punctually; maintaining order when entering and leaving the classroom and during lessons; taking care of books and learning materials.

3. Maintaining personal hygiene and cleanliness; having neat and clean hair and clothes; eating and drinking hygienically.

4. Participating in collective activities of the school and class; protecting public property and the environment; initially understanding traffic safety rules and social order.

Article 4. Recording observations

Students who fully perform the four tasks of elementary school students as stipulated in Article 3 of this document shall be recorded as having fully performed (D). Students who have not fully performed shall be recorded as not fully performing (CD). For these students, teachers need to record specific points where students have not performed in their observation books to develop assistance plans.

Section 2. ASSESSMENT AND GRADING OF ACADEMIC PERFORMANCE

Article 6. Assessment by numerical grades and observation

1. Subjects assessed by numerical grades: Mathematics and Vietnamese

These subjects are evaluated on a scale of 10, with no zero or decimal scores given during tests.

2. The remaining subjects (Natural Sciences and Social Sciences, Morality, Arts, Physical Education) are assessed by teacher observations at two levels:

a. Completed Level (A): meeting basic requirements for knowledge and skills of the subject. Students achieving the Completed Level but demonstrating clear learning abilities in the subject will be recorded as Successfully Completed (A+) by the teacher. Students with special talents will be recorded with specific observations in their academic records.

b. Incomplete Level (B): failing to meet the specified requirements

Article 7. Continuous assessment

1. Continuous assessment is conducted in all lessons according to the program's regulations to monitor, encourage, motivate, or remind students to improve their studies, while allowing teachers to adjust teaching and educational activities.

2. Continuous assessment is carried out through regular checks, including oral exams, observing student study or activity, practical exercises, and written exams (under 20 minutes).

3. The minimum number of regular checks for each subject is as follows:

a. Vietnamese once a month, four times.

b. Mathematics twice a month.

c. Other subjects (sub-disciplines) follow the assessment by observation rules (specifically guided in the Student Performance Monitoring Book - Assessment of Grade 1 and Grade 2 students).

Article 8. Periodic assessment

1. Periodic assessment of student academic performance is conducted after each learning phase. In addition to the purposes of continuous assessment, periodic assessment also serves administrative management purposes.

2. Periodic assessment is carried out through periodic examinations (KTĐK), including oral exams, observing student study or activity, practical exercises, and written exams (20 to 35 minutes).

a. Vietnamese and Mathematics have four periodic examination scores each school year, mid-term I (GKI), end of term I (CKI), mid-term II (GKII), and end of term II (CKII).

b. Other subjects (sub-disciplines) follow the assessment by observation rules (specifically guided in the Student Performance Monitoring Book - Assessment of Grade 1 and Grade 2 students).

3. The number of regular tests for each subject is as follows:

4. In cases where students do not have enough periodic examination scores due to valid reasons, teachers need to arrange appropriate times for students to take replacement exams to base academic performance assessments. Students with unusual results in periodic and regular examinations will be proposed by the class teacher and decided upon by the principal to conduct additional periodic examinations.

b. The remaining subjects (sub-disciplines) shall be assessed according to the evaluation regulations by comments (specifically guided in the Record of Monitoring Students' Test Results - Assessment for Grade 1 and Grade 2 students).

4. In cases where students do not meet the required points for periodic tests due to valid reasons, teachers need to arrange an appropriate time for students to take a replacement test to have a basis for assessing their academic performance in the subject. Students with irregular results in periodic and regular tests will be proposed by the class teacher and decided upon by the principal to conduct additional periodic tests.

Article 9. Evaluation and Classification of Academic Performance by Subject

Students are classified into subject proficiency levels for the first semester (SPL1), second semester (SPL2), and full year (SPLY) in all subjects.

1. For subjects evaluated by numerical scores:

a. Determining the subject academic performance score:

- The HLM.KI score is the average of the KTĐK.GKI and KTĐK.CKI scores.

- The HLM.KII score is the average of the KTĐK.GKII and KTĐK.CKII scores.

- The HLM.N score is the average of the HLM.KI and HLM.KII scores (the HLM.N score is a whole number rounded up from 0.5 to 1).

b. Classifying subject academic performance:

- Excellent grade, subject academic performance score from 9 to 10.

- Good grade, subject academic performance score from 7 to 8.5.

- Average grade, subject academic performance score from 5 to 6.5.

- Weak grade, subject academic performance score below 5.

2. For subjects evaluated by comments

- SPL1 is based on the assessment results from comments obtained during the first semester.

- SPL2 is based on the assessment results from comments obtained throughout the year.

- HLM.N is equivalent to HLM.KII.

Article 10. Other Provisions

1. Each periodic examination for the Vietnamese Language subject consists of two tests: Reading and Writing. The scores of these two tests are converted to a single score which is the average of the two test scores (rounded up from 0.5 to 1).

2. Music, Fine Arts, and Handicrafts sub-disciplines are evaluated as independent subjects.

Chapter 3:

USE OF ASSESSMENT RESULTS AND CLASSIFICATION

Article 11. Promotion to the Next Grade

1. Students with all subject academic performance scores (HLM.N) evaluated by numerical scores reaching 5 or above and subject (sub-discipline) academic performance scores evaluated by comments reaching type A or above are promoted directly.

2. Students with some subject academic performance scores (HLM.N) below 5 according to numerical evaluation must retake the exams; if they achieve 5 or above in the retaken exam or the average score of the retaken exams reaches 5 or above (rounded up from 0.5 to 1) without any subject below 4 points, they will be promoted. Depending on specific cases, the principal organizes teachers to guide students in reviewing and retaking exams multiple times (at the end of the school year or after summer) before deciding to hold back.

Students classified with a B grade in academic performance throughout the year based on comments need to be continuously supported by teachers during the last period of the school year to reach an A grade in academic performance throughout the year.

Article 12. Award Consideration

Students promoted directly are considered for awards at the following levels:

1. Awarding the title of Outstanding Student to those students who are assessed to fulfill all four student duties and have excellent grades in both Mathematics and Vietnamese Language subject academic performance scores for the year, and at least 2/3 of the remaining subjects (sub-disciplines) achieving a Completed Very Well (A+) grade in subject academic performance for the year.

2. Awarding the title of Advanced Student to those students who are assessed to fulfill all four student duties and have subject academic performance scores for the year meeting one of the following conditions:

a. Mathematics and Vietnamese Language both achieving an excellent grade, at least 1/3 of the remaining subjects (sub-disciplines) achieving a Completed Very Well (A+) grade.

b. One of Mathematics or Vietnamese Language achieving a good grade, the other achieving an excellent grade, at least half of the remaining subjects (sub-disciplines) achieving a Completed Very Well (A+) grade.

c. Both Mathematics and Vietnamese Language achieving a good grade, all remaining subjects (sub-disciplines) achieving a Completed Very Well (A+) grade.

3. Awarding achievements in various aspects to students who do not meet the aforementioned titles but fulfill their student duties well, show progress in studies, have achievements in activities, have special talents, excel in individual subjects (Mathematics and Vietnamese Language), achieve a Completed Very Well (A+) grade in the remaining subjects, have neat handwriting, and exhibit good behavior or actions regarding ethics.

Chapter 4:

RESPONSIBILITIES OF TEACHERS, PRINCIPALS, AND STUDENTS IN EVALUATION AND CLASSIFICATION

Article 13. Responsibilities of the Class Teacher

1. Bear primary responsibility for evaluating and classifying students according to regulations.

2. Have the responsibility to announce the evaluation results, comments, conduct grades, and academic classifications to students, parents, or guardians, and record them fully in student management files as prescribed.

3. Complete the evaluation classification file for students, and have the responsibility to hand over the learning and discipline outcomes of each student to the next class teacher for classes 2 and 3.

Article 14. Responsibilities of the Principal

1. Organize, urge, and inspect the implementation of regulations on evaluating and classifying students by the class teachers.

2. Approve the final term and year-end evaluation results, comments, and classifications of all classes, and direct the review process for promotion or retesting of students. Sign to confirm the results in the student record immediately upon the end of the school year.

3. Receive and resolve students' opinions and parents' or guardians' complaints about evaluations, comments, and classifications within his/her scope of authority and powers. The latest response time for complaints is 10 days from the date of receiving the complaint letter.

4. Organize and manage files related to evaluations, comments, and classifications of students.

5. Together with the teaching staff, decide on the number of outstanding students (excellent) selected from the number of excellent students in the school.

Article 15. Responsibilities and Right to Appeal of Students

1. Students are responsible for performing well the tasks stipulated in the elementary school charter; absorb the education provided by the school to always progress.

2. Students have the right to express their opinions to the class teacher and the principal when they feel that they have not been evaluated, commented on, or classified accurately and fairly.
