JOINT CIRCULAR

Guidelines for Implementing Decision No. 215/2005/QĐ-TTg dated August 31, 2005 of the Prime Minister on the Subsidy System for Anti-Narcotics Forces under the Ministry of National Defense

To implement Decision No. 215/2005/QĐ-TTg dated August 31, 2005 of the Prime Minister on the Subsidy System for Anti-Narcotics Forces under the Ministry of National Defense, the Ministry of National Defense and the Ministry of Finance provide the following guidelines:

I- SUBSIDY LEVELS AND ELIGIBLE PERSONNEL.

1- Level of 200,000 VND/person/month: Applies to officers, professional soldiers, non-commissioned officers, and soldiers working at the following units:

1.1- Border Guard Force including:

- Command of the Counter-Narcotics Department under the Border Guard Command.

- Special Task Force; Dog Training and Utilization Team; Investigation Office under the Counter-Narcotics Department - Border Guard Command.

- Counter-Narcotics Office; Special Task Force for Counter-Narcotics under Provincial Border Guard Units.

- Drug Crime Prevention Teams under Border Guard Posts and Coast Guard Units.

- Drivers directly involved in drug crime prevention tasks.

1.2- Narcotics Investigation Office under the Criminal Investigation Bureau - Ministry of National Defense.

1.3- Counter-Narcotics Office; Special Task Force for Counter-Narcotics under the Maritime Police Department - Ministry of National Defense.

2- Level of 150,000 VND/person/day: Applies to officers, professional soldiers, non-commissioned officers, and soldiers working at the Counter-Narcotics Department under the Border Guard Command but not specified in Point 1.1, Clause 1, Section I of this Circular and the Director and Deputy Directors of the Legal Department under the Maritime Police Department - Ministry of National Defense.

II- CALCULATION METHOD.

1- Personnel mentioned in Clauses 1 and 2 of Section I of this Circular shall cease to enjoy the subsidy stipulated in this Circular when they no longer perform anti-drug crime duties.

2- In cases where personnel leave their units for more than three months, they will not be entitled to the subsidy during that period.

3- The subsidy expenses for personnel participating in anti-drug crime activities under any agency or unit shall be borne by that agency or unit.

4- The subsidy stipulated in this Circular shall be paid together with monthly salary and shall not be counted towards social insurance, health insurance, or other benefits.

III- IMPLEMENTATION ORGANIZATION.

1- The financial resources for implementing the subsidy system stipulated in this Circular shall be allocated from the annual state budget for social security funding provided to the Ministry of National Defense.

2- Based on the allocated funds, the Ministry of National Defense shall be responsible for managing and settling accounts for this subsidy fund according to the provisions of the State Budget Law and shall be recorded under Item 108, Sub-item 99 in the current national budget classification system.

3- This Circular shall take effect 15 days after its publication in the Official Gazette. The subsidy stipulated in this Circular shall be enjoyed starting from October 2005.

4- Any issues arising during implementation should be reported to the Ministry of National Defense and the Ministry of Finance for study and resolution./.
