Supplementing occupational talc pneumoconiosis to the list of occupational diseases covered by insurance and guiding diagnosis and assessment

Pursuant to the Law on Navigation of Vietnam dated June 14, 2005; lLabor Code on June 18, 2012;

WHEREAS,ứ Social Insurance Law dated June 29, 2006;

Pursuant to Decree No. 45/13/N3. BASED ON DECREE NO. 63/2012/NĐ-CP dated August 31, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;1Workers who have been assessed for the degree of reduced work capacity due to the disease specified in Article 1 of this Circular shall enjoy social insurance benefits and other entitlements under the Social Insurance Law, the Labor Code, and current laws.1 August This Circular takes effect from February 15, 2014. h"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation.""4. Any difficulties encountered during implementation should be promptly reported to the Ministry of Health (Environmental Health Management Department) for resolution.

Article 1. Supplementing the List of Occupational Diseases Covered by Insurance

1. Supplementing occupational pneumoconiosis-talc disease to the list of occupational diseases eligible for social insurance benefits.

2. Issuing guidelines accompanying this Circular for diagnosing and assessing the degree of reduced work capacity due to occupational pneumoconiosis-talc disease.

Article 2. Benefits for Persons Affected by Occupational Diseases

Workers who have been assessed for the degree of reduced work capacity due to the disease specified in Article 1 of this Circular shall enjoy social insurance benefits under the Social Insurance Law, Labor Code, and other benefits as prescribed by current laws.

Article 3. Effectiveness

This Circular takes effect from February 15, 2014.

Article 4. Responsibilities for Implementation

The Director of the Ministry's Office, the Inspector General of the Ministry, the Director of the Department of Environmental Health Management, Heads of Departments, Directors of Provincial Health Services under the direct jurisdiction of the Central Government, Heads of health agencies under various Ministries and sectors, and relevant organizations and individuals are responsible for implementing this Circular. Any difficulties encountered during implementation should be promptly reported to the Ministry of Health (Department of Environmental Health Management) for resolution.
