CIRCULAR

Article 24Prescribes diseases that must be regularly inspected for

Based on Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Veterinary Law dated April 29, 2004;

Pursuant to the Livestock Breed Law dated March 24, 2004;

Pursuant to Decree No. 33/2005/NĐ-CP dated March 15, 2005 of the Government detailing the implementation of certain provisions of the Animal Health Ordinance and Decree No. 119/2008/NĐ-CP dated November 28, 2008 of the Government amending and supplementing some articles of Decree No. 33/2005/NĐ-CP dated March 15, 2005 of the Government;

1. The List of veterinary drugs permitted for circulation in Vietnam (Annex I).

The Minister of Agriculture and Rural Development issues this Circular prescribing diseases that must be regularly inspected for breeding farms for livestock breeds, poultry breeds, and dairy cows.

Chapter I GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates diseases that must be regularly inspected; inspection contents and methods; handling of inspection results for diseases that must be regularly inspected.

2. This Circular applies to breeding farms for livestock breeds, poultry breeds, and dairy cows within the territory of Vietnam; relevant state agencies.

Article 2. Interpretation of Terms

In this Circular, the following terms are understood as follows:

1. Breeding farms for livestock breeds, poultry breeds, and dairy cows are state-owned breeding farms and concentrated breeding farms for producing breeding animals, semen, embryos, or eggs, or for milk production.

2. Regular inspection means conducting clinical examination, sample testing, or other inspection measures at regular intervals to detect and identify pathogens or to detect antibodies from natural infection for diseases that must be regularly inspected.

Chapter II REGULATIONS ON REGULAR INSPECTION

Article 3. Diseases that must be regularly inspected

1. Diseases in cattle: Foot-and-mouth disease, Infectious abortion, Tuberculosis, Brucellosis.

2. Diseases in pigs: Foot-and-mouth disease, Swine fever, Brucellosis.

3. Diseases in goats: Foot-and-mouth disease, Brucellosis.

4. Diseases in poultry: Highly pathogenic avian influenza.

Article 4. Inspection contents and methods

1. Inspection contents: Clinical examination and intradermal injection reaction test (for Tuberculosis) or sampling for pathogen testing or antibody detection due to natural infection.

2. Inspection methods: Clinical examination is based on clinical symptoms of each disease. Intradermal injection reaction test and sample testing are conducted according to current technical standards and regulations for each disease or following the guidance of the central veterinary management agency.

3. The number of livestock and poultry selected randomly for sample testing and intradermal injection reaction test is specified in the Appendix attached to this Circular.

4. Frequency of inspection: Inspect once every six months. Farms that have been recognized or are located in areas recognized as safe zones for diseases that must be regularly inspected and whose recognition period remains valid are exempted from regular inspections for those diseases.

5. Samples must be tested at agricultural laboratories designated by competent authorities.

Article 5. Handling of inspection results

1. In cases where no disease is detected: The farm may use the inspection and testing results to apply for registration as a disease-safe facility for the disease that was regularly inspected.

2. In cases where a disease is detected:

a) Implement preventive and control measures according to current regulations for each disease;

b) For diseases without specific preventive and control measures: Conduct surveillance, monitoring, and handling according to the guidance of the central veterinary management agency.

Chapter III IMPLEMENTATION ORGANIZATION

Article 6. Responsibilities of organizations and individuals

1. The Animal Health Department:

a) Develop plans and notify facilities and organize regular inspections for livestock and poultry breeding facilities and dairy cattle under central management or with foreign investment;

b) Supervise regular inspections for livestock and poultry breeding facilities nationwide;

c) Guide inspection procedures, sample collection, and handling of inspection results.

2. Departments of Agriculture and Rural Development: Direct provincial animal health bureaus and related units to develop plans, notify facilities, and organize regular inspections for livestock and poultry breeding facilities and dairy cattle under local management.

3. People's Committees at all levels shall be responsible for directing, urging, and inspecting the implementation of this Circular.

4. Facility owners engaged in livestock breeding, poultry breeding, and dairy cattle:

a) Cooperate with veterinary authorities to conduct regular inspections;

b) Pay inspection fees, sample collection costs, and send samples for testing in accordance with Circular No. 04/2012/TT-BTC dated January 5, 2014 issued by the Ministry of Finance;

c) Implement disease prevention and control measures as prescribed and guided by specialized veterinary management agencies.

5. Agricultural laboratories designated by authorized agencies shall be responsible for test results and provide responses according to regulations.

Article 7. Effective Date

1. This Circular takes effect from January 18, 2015.

2. During implementation, if there are any difficulties, organizations and individuals shall promptly report them to the Ministry of Agriculture and Rural Development for consideration and resolution.
