Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Legislative Acts of 03 June 2008;

Pursuant to the Law on the Sea of Vietnam dated June 21, 2012;

Pursuant to the National Security Law dated December 3, 2004;

Pursuant to the Law on National Border dated June 17, 2003;

The Government promulgates this Decree amending and supplementing certain articles of Decree No. 162/2013/NĐ-CP dated November 12, 2013 of the Government on administrative penalties for violations in maritime, island, and continental shelf areas of the Socialist Republic of Vietnam.

Pursuant to the Ordinance on Protection of National Defense Works and Military Areas dated May 19, 1994;

Pursuant to Decree No. 04/CP dated January 16, 1995 of the Government on the Regulations for Protecting National Defense Works and Military Areas;

Pursuant to Decree No. 161/2003/NĐ-CP dated December 18, 2003 of the Government on the Regulations for Border Zones at Sea;

Pursuant to Decree No. 50/2008/NĐ-CP dated April 21, 2008 of the Government on management and security at sea ports;

Pursuant to Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Law on Protecting State Secrets;

Pursuant to Decree No. 21/2012/NĐ-CP dated March 21, 2012 of the Government on management of seaports and maritime channels;

Pursuant to Decree No. 104/2012/NĐ-CP dated December 5, 2012 of the Government regarding foreign vessels arriving in the Socialist Republic of Vietnam;

Pursuant to Decree No. 94/2007/NĐ-CP dated June 4, 2007 of the Government on Air Traffic Management;

At the proposal of the Minister of National Defense,

The Prime Minister decides to issue the Regulations on Ensuring Security and Safety at the Cam Ranh Military Base.

Article 1. These Regulations are promulgated together with this Decision.

Article 2. This Decision takes effect from November 6, 2015.

Article 3. The Ministers of the Ministries of National Defense; Public Security; Transport; Foreign Affairs; Natural Resources and Environment; Agriculture and Rural Development; the Chairpersons of the People's Committees of Khanh Hoa Province and Ninh Thuan Province; relevant ministries, sectors, localities, agencies, organizations, and individuals shall be responsible for implementing this Decision.

 

REGULATIONS

Ensuring Security and Safety at the Cam Ranh Military Base

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

These Regulations provide for:

1. The restricted area, protected area, and security zone of the Cam Ranh Military Base (hereinafter referred to as the Base).

2. Management of Vietnamese and foreign persons and means of transportation entering, exiting, and operating within the Base to ensure security and safety at the Cam Ranh Military Base.

Article 2. Applicability

1. These Regulations apply to agencies, organizations, individuals, and means of transportation entering, exiting, operating, or residing in the Cam Ranh Military Base area.

2. In cases where there are international treaties between the Socialist Republic of Vietnam and another country that provide different regulations for persons and means of transportation entering, exiting, and operating within the Base, the provisions of such international treaties shall apply.

3. Areas implementing joint ventures and economic service activities within the Base shall comply with separate regulations.

Article 3. Explanation of Terms

In these Regulations, the following terms are understood as follows:

1. Cam Ranh Military Base: A strictly managed military area of type 1, including restricted areas, protected areas, and security zones.

a) Restricted Area: Established to protect, manage, and strictly control the activities of persons and means of transportation to maintain order, security, and prevent intrusion, sabotage, and state secret collection. It includes land and water areas.

b) Protected Area: A water area established to manage and control persons, means of transportation, and other activities to ensure security and safety at the Base.

c) Security Zone: Established to manage and control certain activities to ensure security and safety at the Base. It includes land and water areas.

d) Water Security Zone: The flooded area within the security zone defined in Article 8 of these Regulations, up to the highest tidal level.

2. Base Airspace: The airspace above the restricted land and water areas, extending upwards from the ground and water surface.

3. Ensuring Security and Safety in Base Airspace: The overall measures taken by the airspace management agency, military air traffic control, and civil aviation authorities to strictly manage and ensure safety for air operations within the Base airspace.

4. Base Port Authority: The agency directly managing maritime affairs, order, and security within the restricted water areas.

5. Abbreviations are understood as follows: NC: Restricted Waters, BV: Protected, VĐ: Security Zone, HL: Training.

Article 4. Principles for Ensuring Security and Safety

1. Persons, means of transport entering, exiting, and operating within restricted areas must be permitted and subject to inspection and supervision by competent authorities.

2. Strictly comply with and organize the implementation of regulations on military deployment, state secrecy, defense combat plans, base protection plans, disaster prevention plans, accident response plans, fire prevention and firefighting plans.

3. Proactively prevent, detect, stop, and promptly and effectively handle situations and actions threatening the security and safety of the Base.

4. Close coordination and cooperation among forces according to the functions and tasks of ministries, sectors, and localities.

Article 5. Handling Violations

Organizations and individuals who violate the provisions of this Regulation shall be disciplined, administratively sanctioned, or criminally prosecuted and required to compensate according to the law, depending on the nature and severity of the violation.

Chapter II

REGULATIONS ON THE SCOPE OF SECURITY AND SAFETY GUARANTEE FOR THE BASE

 

Article 6. Scope of Restricted Areas

1. The scope of land restricted area: The boundary is defined by the protective fence system from point NC14 to point NC1.

From point NC1 along the Cam Ranh Bay shoreline southward through Hon Luong Cape, following the shoreline of Bai Vinh Bay to point NC9, then northward along the coastline through Lo Gio Cape and connecting back to point NC14.

2. The scope of water restricted area:

a) The boundary towards the peninsula: From point NC1 along the Cam Ranh Bay shoreline southward through Hon Luong Cape, following the shoreline of Bai Vinh Bay to point NC9, then northward along the coastline through Lo Gio Cape and connecting back to point NC14.

b) The boundary towards Cam Ranh Bay, Bai Vinh Bay, and the sea: Defined by straight lines connecting points in the order NC1, NC2, NC3, NC4, NC5, NC6, NC7, NC8, NC9, NC10, NC11, NC12, NC13, and connecting back to point NC14.

Article 7. Scope of Protected Areas

1. The scope of protected area 1: Extends 400 meters beyond the outer boundary of the water restricted area. The outer boundary is defined by straight lines connecting points in the order NC2, BV1, BV2, BV3, BV4, BV5, BV6, BV7, BV8, and connecting back to point NC9.

2. The scope of protected area 2: The boundary is defined by straight lines connecting points in the order NC10, BV9, BV10, BV11, BV12, NC13, NC12, NC11, and connecting back to point NC10.

Article 8. Scope of Safety Buffer Zone

The boundary is defined by straight lines connecting points in the order NC14, VĐ1, VĐ2, and VĐ3.

- From point VĐ3 following National Highway 1 southward to point VĐ4.

- From point VĐ4 defined by straight lines connecting points in the order VĐ4, VĐ5, VĐ6, VĐ7, VĐ8, VĐ9, BV9, NC10, NC9, BV8, BV7, BV6, BV5, BV4, BV3, BV2, BV1, NC2, and NC1.

- From point NC1 to point NC14 the boundary is defined by the protective fence system.

Article 9. Scope of Water Area East of the Airport Reserved Boundary

Determined for military aircraft to conduct training and combat readiness missions, the boundary is defined by straight lines connecting points in the order HL1, HL2, HL3, HL4, and connecting back to point HL1.

Article 10. Coordinates of Points

The boundaries of the restricted area, protected area, safety buffer zone, and water area east of Cam Ranh Airport are determined on a map at a scale of 1:140,000. The coordinates of the points are specified in Appendix I, attached to this Regulation.

Chapter III

ENSURING SECURITY AND SAFETY FOR WATER, AIR, AND LAND AREAS OF THE BASE

Section 1

ENSURING SECURITY AND SAFETY FOR WATER AREAS OF THE BASE

Article 11. Management Authority for Prohibited Waters

1. The Command of Naval Zone 4 (Port Office of the Base) shall be the main authority coordinating with the Border Guard Command of Khanh Hoa Province in organizing management and directing activities of persons and various types of vessels within the prohibited waters.

2. Organization of the Port Office of the Base: To be decided by the Minister of National Defense.

3. Tasks and Authorities of the Port Office of the Base:

a) Organizing entry and exit of ships to and from the port and anchoring them safely at designated positions.

b) Guiding and ensuring compliance with regulations on maritime operations, maritime security, fire prevention, and environmental pollution prevention; managing all maritime activities of ships entering and exiting the port.

c) Ensuring order and safety within the port, inspecting permits for entry and exit of persons and vessels issued by competent authorities.

d) Meeting electricity and water needs and guiding procedures for receiving fuel, food, supplies, technical equipment, and other procedures as prescribed by law.

đ) Coordinating with state functional agencies and the Border Guard to handle immigration, customs, tax, and quarantine procedures for ships departing from the port to foreign countries or entering the port from foreign countries according to legal provisions.

e) Inspecting certificates of ships, professional qualifications of captains, officers, and crew members. If these documents are found to be invalid, they shall temporarily be seized, recorded in a report transferred to the competent authority for resolution.

Inspecting and supervising compliance with regulations on maritime safety, traffic order, hygiene, environmental pollution prevention, and fire prevention for vessels and facilities within the prohibited waters. Temporarily suspending operations of vessels or persons on board if deemed insufficiently safe. Handling violations and accidents within the prohibited waters according to legal provisions.

g) Applying necessary measures, including temporary detention of vessels to ensure maritime safety, traffic order, hygiene, environmental pollution prevention, and rescue operations within the prohibited waters according to legal provisions.

h) Performing other related tasks and functions as prescribed by law.

Article 12. Military Ships of Vietnam Entering and Leaving Prohibited Waters Male Military ships of Vietnam entering and leaving prohibited waters shall comply with regulations set forth by the Ministry of National Defense.

Article 13. Foreign Military Ships Entering and Leaving Prohibited Waters

Foreign military ships entering and leaving prohibited waters shall comply with the provisions of Decree No. 104/2012/ND-CP dated December 5, 2012, of the Government on regulations for foreign military ships entering the Socialist Republic of Vietnam (hereinafter referred to as Decree No. 104/2012/ND-CP) or international treaties to which Vietnam is a party.

Article 14. Issuing Permits for Civilian Ships of Vietnam to Operate in Prohibited Waters

1. The Commander of Naval Zone 4 has the authority to issue permits for civilian ships of Vietnam to operate in prohibited waters. Male 2. Application Documents

a) An application form for permission to operate in prohibited waters according to Model No. 1 attached to this Regulation.

b) A declaration form for arriving ships according to Model No. 3 attached to this Regulation.

c) A copy of the ship registration certificate.

d) A copy of the certificate on maritime safety, maritime security, and environmental pollution prevention.

3. Procedures for Issuing Permits

a) At least twenty days before the expected date of operation in prohibited waters, the applicant must submit one complete set of application documents as stipulated in Clause 2 of this Article directly or through postal services to the Command of Naval Zone 4 (Planning Department).

b) Within ten working days from the receipt of valid application documents, the Command of Naval Zone 4 (Planning Department) shall have the responsibility to review and present the application to the Commander of Naval Zone 4 for signature of a response letter according to Model No. 4 attached to this Regulation, and send it directly or through postal services to the applicant.

4. In addition to the provisions of Clauses 1, 2, and 3 of this Article, civilian ships of Vietnam operating in the prohibited waters area must also follow procedures for entering and leaving ports as stipulated in Decree No. 21/2012/ND-CP dated March 21, 2012, of the Government on port management and maritime channels (hereinafter referred to as Decree No. 21/2012/ND-CP) and other relevant legal provisions of Vietnam.

b) Within 10 (ten) working days from the date of receiving valid documents, the Command of the Fourth Naval Zone (Planning Office) shall be responsible for examining, submitting to the Commander of the Fourth Naval Zone for signature the reply document according to Model No. 4 issued together with this Regulation, and directly sending or transmitting through the postal system to the person handling the procedure.

4. In addition to the provisions stipulated in Clauses 1, 2, and 3 of this Article, civilian vessels of Vietnam entering to operate in the prohibited waters area must also comply with the procedures for arrival and departure from seaports as prescribed in Decree No. 21/2012/NĐ-CP dated March 21, 2012 of the Government on port management and maritime channels (hereinafter referred to as Decree No. 21/2012/NĐ-CP) and other relevant provisions of Vietnamese law.

Article 15. Permit for Foreign Civil Vessels to Operate in Prohibited Waters

Clause 1. The Chief of General Staff has the authority to issue permits for foreign civil vessels to operate in prohibited waters.

b) A declaration form for arriving ships according to Model No. 3 attached to this Regulation.

Point a) Application for permit for vessels to operate in prohibited waters according to Model No. 2 issued together with this Regulation.

d) A copy of the certificate on maritime safety, maritime security, and environmental pollution prevention.

3. Procedures for Issuing Permits

a) At least twenty days before the expected date of operation in prohibited waters, the applicant must submit one complete set of application documents as stipulated in Clause 2 of this Article directly or through postal services to the Command of Naval Zone 4 (Planning Department).

b) Within ten working days from the receipt of valid application documents, the Command of Naval Zone 4 (Planning Department) shall have the responsibility to review and present the application to the Commander of Naval Zone 4 for signature of a response letter according to Model No. 4 attached to this Regulation, and send it directly or through postal services to the applicant.

Point a) At the latest thirty (30) days before the date the vessel is expected to enter and operate in prohibited waters, the person handling the procedure shall prepare one set of documents in accordance with Clause 2 of this Article and submit it directly or through the postal service to the General Staff Department (Operations Bureau).

Point b) Within twenty (20) working days from the date of receipt of valid documents, the Operations Bureau/General Staff Department shall be responsible for reviewing and submitting to the Chief of General Staff for signature the reply document according to Model No. 4 issued together with this Regulation, and sending it directly or through the postal service to the person handling the procedure.

Clause 4. In addition to the provisions of Clauses 1, 2, and 3 of this Article, foreign civil vessels operating in the prohibited waters area must also comply with the procedures for entering and leaving ports as stipulated in Decree No. 21/2012/ND-CP, Decree No. 50/2008/ND-CP dated April 21, 2008 of the Government on management and security protection at sea port gates (hereinafter referred to as Decree No. 50/2008/ND-CP), and other relevant regulations of Vietnamese law.

Article 16. Regulations on Marine Pilots for Bases

Clause 1. Compulsory Pilotage System:

Point a) Foreign vessels are required to use marine pilot services when entering and leaving prohibited waters or navigating within prohibited waters and other related regulations of Vietnamese law.

Point b) Vietnamese civil vessels shall comply with the provisions of Article 64 of Decree No. 21/2012/ND-CP.

Clause 2. Provision of Marine Pilot Services:

Point a) The provision of marine pilot services for bases shall be assigned to marine pilot organizations under the Ministry of National Defense.

Point b) Other provisions regarding the provision of marine pilot services shall be carried out in accordance with the provisions of Article 65 of Decree No. 21/2012/ND-CP and other relevant regulations of Vietnamese law.

Clause 3. Responsibilities of Marine Pilots guiding vessels shall be implemented in accordance with the provisions of Article 66 of Decree No. 21/2012/ND-CP and other relevant regulations of Vietnamese law.

Article 17. Flag Display Regulations for Vessels in Prohibited Waters

The flag display of vessels operating in prohibited waters shall be carried out in accordance with the provisions of Article 75 of Decree No. 21/2012/ND-CP and Clause 5 of Article 4 of Decree No. 104/2012/ND-CP.

Article 18. Management of Activities of Persons and Vessels in Prohibited Waters

The management of activities of persons and vessels in prohibited waters shall be carried out in accordance with the provisions of Articles 67, 68, 69, 70, 71, and 72 of Decree No. 21/2012/ND-CP; Articles 16, 17, 18, 19, 20, and 21 of Decree No. 50/2008/ND-CP; Articles 16, 17, 19, and 20 of Decree No. 161/2003/ND-CP dated December 18, 2003 of the Government on the regime of maritime border areas (hereinafter referred to as Decree No. 161/2003/ND-CP) and other relevant regulations of Vietnamese law.

Article 19. Search and Rescue and Handling of Marine Accidents in Prohibited Waters

The Base Port Office shall take the lead and coordinate with the Nha Trang Port Office to handle search and rescue operations and manage marine accidents in prohibited waters in accordance with the provisions of Articles 73 and 74 of Decree No. 21/2012/NĐ-CP and other relevant legal regulations of Vietnam.

Article 20. Ensuring Maritime Security, Safety, and Sanitation in Prohibited Waters

1. Ensuring maritime security, safety, and sanitation in prohibited waters shall be carried out in accordance with the provisions of Articles 76, 77, 78, and 81 of Decree No. 21/2012/NĐ-CP and other relevant legal regulations of Vietnam.

2. In case of labor accidents on vessels, the ship captain must immediately inform the Base Port Office for coordination in handling the situation.

Article 21. Prevention of Fires and Explosions and Environmental Incidents in Prohibited Waters

1. Prevention of fires and explosions and environmental incidents in prohibited waters shall be carried out in accordance with the provisions of Articles 83, 84, 85, 86, and 87 of Decree No. 21/2012/NĐ-CP and other relevant legal regulations of Vietnam.

2. When an incident or accident related to oil pumping or handling dangerous goods occurs, or when there is a risk or act causing environmental pollution, the ship captain must immediately inform the Base Port Office for coordination in handling the situation.

Article 22. Management of Activities of People and Vessels in Protected Areas and Safety Zones

1. When operating in protected areas and safety zones, Vietnamese and foreign people and vessels must comply fully with the provisions of Decree No. 161/2003/NĐ-CP and other relevant legal regulations of Vietnam.

2. Within the protected area, all vessels must travel continuously and may not stop or anchor except in cases of force majeure, accidents, or to assist people or vessels in distress.

In case of accidents or incidents, the ship captain must apply all appropriate measures to ensure safety for themselves, their vessel, and other vessels, and must immediately inform the Nha Trang Port Office and the Base Port Office via VHF channel 16 or by other means of communication, while taking all appropriate measures to move the vessel out of the protected area as quickly as possible.

3. If it is necessary to restrict maritime activities in a specific area within the protected zone and safety zone, the Command of Naval Zone 4 must notify the Border Guard Command of Khanh Hoa and Ninh Thuan provinces, the Nha Trang Port Office, and the People's Committees of Khanh Hoa and Ninh Thuan provinces to direct relevant agencies to cooperate in implementing such restrictions.

Section 2

ENSURING SECURITY AND SAFETY IN THE BASE AIRSPACE

Article 23. Organization of Exploitation and Use of Base Airspace

1. The Base airspace is within the airspace managed and controlled by the Cam Ranh International Airport according to the "Flight Regulations in the Cam Ranh Airport Area." Based on the flight permit that has been announced, the military and civil air traffic control authorities have the responsibility to strictly manage and control flights in their respective areas; promptly detect violations of flight rules and regimes, and report them to the airspace management authority, the command posts of relevant units to handle airspace violations in accordance with Vietnamese law.

2. Flight activities in the Base airspace, including manned aircraft, unmanned aircraft, and ultra-light aircraft, must be subject to supervision and control by military or civil air traffic control authorities in the area. They must comply with the provisions of Decree No. 94/2007/NĐ-CP dated June 4, 2007, of the Government on flight activity management; Decree No. 36/2008/NĐ-CP dated March 28, 2008, of the Government on unmanned aircraft and ultra-light aircraft management; Decree No. 79/2011/NĐ-CP dated September 5, 2011, of the Government amending and supplementing certain articles of Decree No. 36/2008/NĐ-CP dated March 28, 2008, of the Government on unmanned aircraft and ultra-light aircraft management; and Decree No. 58/2010/NĐ-CP dated June 1, 2010, of the Government detailing and guiding the implementation of certain articles of the Law on Militia and Self-Defense Forces.

3. Flight activities in the Cam Ranh Airport area, including those in the Base airspace, must be coordinated and directed from a unified control tower to ensure safe and effective exploitation and use of airspace by relevant agencies and units for related flight activities.

Article 24. Management of Obstacle Height

When constructing projects within the Base area, units must comply with the provisions of Decree No. 20/2009/NĐ-CP dated February 23, 2009, of the Government on the management of obstacle height for aviation and the management and protection of airspace in Vietnam.

Section 3

SECURITY AND SAFETY OF PROHIBITED AREA

Article 25. Authority managing the prohibited area

The Command of Naval Zone 4 is the leading agency coordinating with the Police, relevant sectors, and local authorities in organizing command, management, and ensuring security and safety in the prohibited area.

Article 26. Activities of Vietnamese persons and means Male in the prohibited area

1. For Vietnamese military personnel and military means, they shall follow the regulations of Naval Zone 4.

2. For Vietnamese civilians and civilian means entering the prohibited area for activities

a) Application for permit

- Application form for permission for Vietnamese civilians and civilian means to enter the prohibited area for activities according to Form No. 5, 6 issued together with this Regulation;

- Photocopy of Identity Card, Vehicle Registration Certificate;

- List according to Form No. 7, 8 issued together with this Regulation.

b) Procedure and formalities for Vietnamese persons and means to enter the prohibited area for activities

- At least four days before the date when Vietnamese persons and means are expected to enter the prohibited area for activities, the person handling the procedures shall prepare one set of application documents as stipulated at Point a of this Clause and submit it directly to the Command of Naval Zone 4 (Planning Department).

- Within three working days from the date of receiving valid application documents, the Command of Naval Zone 4 (Planning Department) shall be responsible for reviewing and submitting to the Deputy Chief of Staff for signature to issue the entry and exit permit according to Form No. 9 issued together with this Regulation and deliver it directly to the person handling the procedures.

3. For members on board vessels moored in the prohibited waters when going ashore

Members on board vessels moored in the prohibited waters when going ashore shall use their Identity Card and Seaman's Book instead of the entry and exit permit.

4. Regulations for persons and means operating in the Base

Upon being permitted to enter the prohibited area, persons and means must carry the entry and exit permit, personal identification documents, vehicle registration certificates; undergo inspection procedures at the checkpoint before entering the prohibited area and present documents upon request by the Base security force; only perform approved tasks, strictly follow the guidance of the Base security force, personal items brought in must be registered and subject to security checks; movement and activities in the prohibited area must be along designated routes, within specified areas, and at prescribed speeds; comply with the provisions of this Regulation and other related laws of Vietnam.

Article 27. Activities of foreigners, overseas Vietnamese, and Vietnamese working for foreign individuals and organizations in the prohibited area

1. For foreigners and overseas Vietnamese working in the prohibited area

a) Application for permit

- Application for permission for foreigners and overseas Vietnamese (hereinafter referred to as foreigners) to work in the prohibited area according to Form No. 10 issued together with this Regulation;

- Photocopy of passport;

- List according to Form No. 11 issued together with this Regulation.

b) Procedure and formalities for foreigners to work in the prohibited area

- At least seven days before the date when foreigners are expected to start working in the prohibited area, the competent authority or unit sending them to work shall prepare one set of application documents as stipulated in Clause 1 of this Article and submit it directly to the Operations Department and the Military Security Protection Department.

- Within four working days from the date of receiving valid application documents, the Operations Department and the Military Security Protection Department shall be responsible for reviewing and responding in writing according to Form No. 12, 13 issued together with this Regulation, and delivering it directly to the competent authority or unit organizing the work.

2. For Vietnamese working for foreign individuals and organizations working in the prohibited area

a) Application for permit

- Application for permission for Vietnamese working for foreign individuals and organizations to work in the prohibited area according to Form No. 14 issued together with this Regulation;

- Photocopy of Identity Card;

- List according to Form No. 15 issued together with this Regulation.

b) Procedure and formalities for Vietnamese working for foreign individuals and organizations to work in the prohibited area

- At least seven days before the date when Vietnamese working for foreign individuals and organizations are expected to start working in the prohibited area, the competent authority or unit sending them to work shall prepare one set of application documents as stipulated at Point a of this Clause and submit it directly to the Military Security Protection Department.

- Within four working days from the date of receiving valid application documents, the Military Security Protection Department shall be responsible for reviewing and responding in writing according to Form No. 13 issued together with this Regulation, and delivering it directly to the competent authority or unit organizing the work.

3. For members on board vessels moored in the prohibited waters when going ashore

For members on board vessels moored in the prohibited waters when going ashore, they shall use their passports and Shore Passes issued by the Border Guard Port Office according to Vietnamese law, instead of the entry and exit permit.

4. Regulations for persons operating in the Base

Follow the provisions of Clause 4 of Article 26 of this Regulation.

Article 28. Confidentiality Protection Work

1. All agencies, units, organizations, and individuals inside and outside the country working and operating at the Base must strictly comply with the provisions of Vietnamese law on protecting state secrets and military secrets.

2. Without authorization, no one shall collect information, nor disseminate or publicize through media about the organizational structure, functions, and tasks of units; technical capabilities of various types of weapons, equipment, and technical means; the situation regarding the execution of tasks by troops; projects related to enhancing management capacity, protecting maritime and island sovereignty, and development projects ensuring the Base. In cases where reporting is necessary, it must be approved by the Ministry of National Defense.

Article 29. Organization of Protective Forces

Establish specialized units directly managing and protecting defense works and military areas within the Base, organizing personnel and equipping them appropriately according to mission requirements. The establishment of these specialized units is decided by the Minister of National Defense.

Chapter IV

RESPONSIBILITIES OF MINISTRIES AND LOCAL AUTHORITIES

Article 30. Ministry of National Defense

1. Take the lead and coordinate with ministries, sectors, People's Committees of Khanh Hoa and Ninh Thuan Provinces to organize security and safety assurance for the Base. Bear responsibility before the Government and Prime Minister for the effectiveness of security and safety assurance work at the Base.

2. Direct competent agencies to provide information and coordinate with specialized units of the Ministry of Public Security and localities to develop and implement plans to prevent and stop intelligence gathering and sabotage activities by hostile forces, thereby ensuring security and safety at the Base.

3. Direct agencies and units to take the lead and coordinate with the Public Security, local authorities to build safe units linked to safe areas in terms of political security, confidentiality protection, and propaganda mobilization to raise the vigilance and sense of responsibility of local people in protecting the Base.

4. Take the lead and coordinate with the Ministry of Transport, Ministry of Agriculture and Rural Development, People's Committee of Khanh Hoa Province to organize effective exploitation and utilization of airspace over Cam Ranh Airport and waters in Cam Ranh Bay based on economic and social development and national defense and security assurance.

5. Direct the Navy General Staff to take the lead and coordinate with the Vietnam Maritime Administration under the Ministry of Transport to establish regulations for cooperation in the management, issuance of permits, and procedures for ships entering and leaving the Base; search and rescue operations and handling maritime accidents; ensuring maritime safety, maritime security, and preventing marine environmental pollution.

6. Coordinate with the Navy General Staff and Border Guard Force to take the lead and coordinate with the Public Security Departments of Khanh Hoa and Ninh Thuan Provinces to patrol, control, and monitor the activities of persons and means operating within the Base's safety perimeter.

7. Coordinate with the People's Committees of Khanh Hoa and Ninh Thuan Provinces to consider priority investment projects for developing economic and social infrastructure in the Base's safety perimeter area.

8. Regularly annually take the lead and coordinate with relevant ministries, sectors, and localities to convene meetings to assess the implementation of the Regulations on security and safety assurance at the Base. To advise the Prime Minister on timely measures to ensure security and safety at the Base.

Article 31. Ministry of Public Security

1. Direct the business units, Public Security of Khanh Hoa Province and Ninh Thuan Province to closely cooperate with the Navy Military Region and Border Guard Force to constantly grasp the political security situation and social order in the safety zone area, promptly exchange information related to activities ensuring security and safety at the Base. At the same time, handle promptly complex situations related to security occurring in the area according to the provisions of the law.

2. Direct to strengthen advisory work and guide agencies, organizations, enterprises to intensify propaganda work, raise public awareness of responsibility in fulfilling the duty of protecting security and order; actively participate in building the whole people movement for national security, contributing to ensuring security and safety at the Base.

3. The Ministry of Public Security shall cooperate with the Ministry of National Defense to develop and implement plans to prevent and stop intelligence gathering and sabotage activities of hostile forces, ensuring security and safety at the Base.

4. The Ministry of Public Security shall cooperate with the Ministry of National Defense to review and verify suspicious signs of Vietnamese and foreign individuals and organizations residing, working inside and outside the Base, having relations and transactions related to security and safety at the Base, to take timely measures.

Article 32. Ministry of Transport

1. Take the lead and coordinate with the Ministry of National Defense to issue permits for civil aviation flights in the airspace of the Base area; be responsible for managing and directing civil aviation activities in the airspace under the responsibility of Cam Ranh Airport; implement flight notifications according to regulations.

2. Direct the Vietnam Maritime Administration to cooperate with the Navy Military Region to establish coordination regulations in the management, issuance of permits, and procedures for ships entering and leaving the Base; search and rescue and handling maritime accidents; ensure maritime safety, maritime security, and prevention of marine environmental pollution.

3. Direct subordinate agencies and departments to closely coordinate and cooperate with agencies and units of the Ministry of National Defense and local authorities in ensuring security and safety at the Base; organize propaganda and dissemination to organizations, individuals, enterprises, and vessel owners to strictly comply with the regulations of the Coordination Regulations.

Article 33. Ministry of Foreign Affairs

Coordinate with the Ministry of National Defense and relevant ministries and sectors to resolve external issues when foreign forces and equipment arrive at the Base. Organize propaganda and dissemination for vessel owners to strictly comply with regulations on security and safety at the Base.

Article 34. Ministry of Agriculture and Rural Development

Take the lead and coordinate with the Ministry of National Defense, People's Committee of Khanh Hoa Province and People's Committee of Ninh Thuan Province to study, review, and adjust fishery planning in conjunction with overall defense layout planning combined with economic and social development; strictly manage fishing vessels authorized by the Ministry of Agriculture and Rural Development to operate in the protected waters and safety zone of the Base.

Article 35. Ministry of Natural Resources and Environment

Direct and guide the activities of specialized state management agencies under its jurisdiction to effectively coordinate in the management of natural resources and environment in the Base area; strictly manage fishing vessels authorized by the Ministry of Natural Resources and Environment to operate in the protected waters and safety zone of the Base.

Article 36. Relevant Ministries and Sectors

Coordinate with the Ministry of National Defense in strictly managing persons and means entering and exiting the Base related to their respective areas of management.

Article 37. People's Committees of Khanh Hoa and Ninh Thuan Provinces

1. Coordinate with the Vietnam Navy Military Region in ensuring the security and safety of the Base.

2. Direct provincial functional agencies to strictly manage foreigners, persons from other places, and overseas Vietnamese residents entering and exiting the protected area and security perimeter; prevent people from illegally residing in these areas.

3. Direct grassroots-level authorities to coordinate with units stationed in the locality to build safe localities, clusters, and interconnected safe localities.

4. Ensure economic activities within the protected area and security perimeter do not affect political security, management, and protection of defense works and military zones. Investment projects in Khanh Hoa and Ninh Thuan provinces related to the Base area must have the opinion of the Ministry of National Defense before submitting to the Government or the Prime Minister for approval. In particular, the Hoite Cape, Binh Ba Island, and Hon Chu areas shall not develop tourism activities.

5. Organize propaganda and education for the public on national defense and security tasks and strict compliance with the provisions of this Regulation.

Chapter V

IMPLEMENTING PROVISIONS

Article 38. Organization of implementation

The Minister of National Defense shall base this Regulation to develop guiding documents and organize its implementation.

Article 39. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of the People's Committees of Khanh Hoa and Ninh Thuan Provinces, and relevant organizations, entities, and individuals are responsible for implementing this Regulation./.
