CIRCULAR

ISSUING REGULATIONS ON MANAGEMENT AND MAINTENANCE STANDARDS FOR NATIONAL ROADS

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 10/2021/NĐ-CP dated February 9, 2021 of the Government on the management of construction investment costs;

Pursuant to the Government Decree No. 06/2021/NĐ-CP dated January 26, 2021 detailing certain provisions on quality management, construction works, and maintenance of construction projects;

Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 on assigning tasks, placing orders, or tendering for the provision of products and public services using state budget funds from regular expenditure;

At the proposal of the Director of the Infrastructure Structure Department and the General Director of the Vietnam Highway Administration;

THE MINISTER OF TRANSPORTATION issues this Circular on management and maintenance standards for national roads.

Article 1. Scope of Regulation

1. The management and maintenance standards for national roads, attached to this Circular, include:

a) Management and maintenance standards for national highways at Appendix I;

b) Management and maintenance standards for expressways at Appendix II;

c) Management and maintenance standards for bridges over 300 meters in length, cable-stayed bridges, and large-span suspension bridges at Appendix III;

d) Management and maintenance standards for road tunnels at Appendix IV;

e) Standards for managing and operating ferry services at Appendix V.

2. The standards issued in this Circular serve as the basis for preparing budgets and service charges for public services related to the management and regular maintenance of national highways and expressways funded by the state budget, non-budget state funds, and public-private partnership projects for national highway and expressway construction.

Article 2. Applicability

1. This Circular applies to organizations and individuals involved in determining the budget (service charges for public services) for the regular management and maintenance of national highways funded by the state budget, non-budget state funds, and public-private partnership projects for national highway and expressway construction.

2. Other road systems may apply the management and regular maintenance standards issued in this Circular as a basis for determining the budget (service charges for public services) for regular road maintenance. In cases with specific characteristics, the competent authority shall issue standards in accordance with Clause 6, Article 20 of Decree No. 10/2021/NĐ-CP dated February 9, 2021 of the Government on investment construction cost management.

Article 3. Effectiveness

1. This Circular takes effect from March 1, 2022.

2. In case the legal documents cited in this Circular are amended, supplemented, or replaced, the amended, supplemented, or replacement documents shall be applied.

The Head of the Ministry's Office, the Inspector General, the Heads of Departments, the General Director of the Vietnam Highway Administration, the Heads of agencies authorized by the Ministry of Transportation to manage national highways, and the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
