THE MINISTER OF TRANSPORTATION

Pursuant to Article 58 of the Vietnam Maritime Code dated June 30, 1990;

Now hereby promulgates with this Decision the "Regulations on Responsibilities and Forms of Handling for Organizations and Individuals when Violating Management and Operation of Road Traffic Load Control Stations for Motor Vehicles."

Based on the opinion of the People's Committee of Quang Tri Province at Document No. 464/UB-CV dated April 3, 2002;

Considering the proposal of the Director of the Legal Affairs Department - Transport and the Director General of the Vietnam Maritime Administration.

DECISION:

Article 1. Now, we announce the maritime area of the coastal ports within the jurisdiction of Quang Tri Province, which includes:

- The maritime area before the Cua Viet port bridge;

- The maritime area of the shipping route, pilot station, quarantine area, anchorage for typhoon avoidance of the Cua Viet port;

- The maritime area before the marine port bridge and other anchorage areas for typhoon avoidance will be announced according to the provisions of the law.

Article 2. The scope of the maritime area of the coastal ports within the jurisdiction of Quang Tri Province is defined based on the highest tidal level as follows:

1. Seaward boundary: This is the maritime area limited by straight lines connecting points CV1, CV2, CV3, CV4, CV5 with the following coordinates:

CV1: 16⁰ 54' 30"N; 107⁰ 11' 06"E

CV2: 16⁰ 55' 30"N; 107⁰ 11' 06"E

CV3: 16⁰ 55' 30"N; 107⁰ 13' 30"E

CV4: 16⁰ 53' 54"N; 107⁰ 13' 30"E

CV5: 16⁰ 53' 54"N; 107⁰ 11' 54"E

2. Riverward boundary: This is the maritime area limited from point CV1, running along the northern bank of the Hiếu River to the intersection with the transverse line at the Cau Soi bend (belonging to Mai Xa village), connected to the intersection of the aforementioned transverse line with the southern bank of the river (belonging to An Cuu village), passing through the branch of the Luong Kim River to point CV5.

Article 3. The pilot station, quarantine area, anchorage, and typhoon avoidance area for ships entering the Cua Viet port are defined as follows:

1. Pilot station and quarantine area: This is the maritime area limited by a circle with a radius of 0.5 nautical miles, with its center at the position with the following coordinates: 16⁰ 54' 54"N; 107⁰ 13' 00"E.

2. Anchorage and typhoon avoidance area: This is the maritime area on the Hiếu River at the Cau Soi bend within a range of 1 nautical mile downstream from the aforementioned transverse line as stipulated in Clause 2, Article 2 of this Decision.

Article 4.

1. The Quang Tri Port Authority shall perform its duties and powers as prescribed by the Vietnam Maritime Code and other relevant legal documents for all maritime activities within the maritime area of the coastal ports within the jurisdiction of Quang Tri Province.

2. The Quang Tri Port Authority shall base on the actual situation regarding weather, waves, tide levels, and the load capacity of vessels to direct vessels to specific positions within the maritime area specified in Article 3 of this Decision, ensuring maritime safety and environmental hygiene.

Article 5. Outside the maritime area specified in Articles 2 and 3 of this Decision, the Quang Tri Port Authority shall also be responsible for specialized state management over maritime order and safety in the sea area within the jurisdiction of Quang Tri Province as prescribed by law.

Article 6. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

Article 7. The Heads of the Ministry's Office, Directors of Departments under the Ministry, Director General of the Vietnam Maritime Administration, Director General of the Vietnam Inland Waterways Administration, Director of the Quang Tri Provincial Department of Transportation, Director of the Quang Tri Port Authority, Heads of agencies, units, and individuals related to this Decision shall be responsible for its implementation.
