Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

At the proposal of the Director of the Cadre and Civil Servant Organization Department and the Director of the Postal, Telecommunications, and Information Technology Administration Region II,

Article 1The Postal, Telecommunications, and Information Technology Administration Region II is an agency under the Ministry of Posts and Telecommunications responsible for managing state affairs related to postal services, telecommunications, information technology, electronics, Internet, signal transmission, radio frequency, and national information infrastructure (hereinafter referred to collectively as postal services, telecommunications, and information technology) within the scope of 21 provinces and cities including: An Giang, Ba Ria-Vung Tau, Bac Lieu, Ben Tre, Binh Duong, Binh Phuoc, Binh Thuan, Ca Mau, Can Tho, Dong Nai, Dong Thap, Kien Giang, Lam Dong, Long An, Ninh Thuan, Soc Trang, Tay Ninh, Tien Giang, Tra Vinh, Vinh Long, and Ho Chi Minh City.

Article 2The Postal, Telecommunications, and Information Technology Administration Region II has the following tasks and powers:

1. It is the representative body of the Ministry of Posts and Telecommunications implementing state management over postal services, telecommunications, and information technology in the provinces and centrally governed cities under its jurisdiction, coordinating with provincial people's committees and relevant agencies and units to guide and organize the implementation of legal normative documents on postal services, telecommunications, and information technology in the provinces and centrally governed cities under its jurisdiction.

2. Participate in drafting, amending, supplementing, and abolishing legal normative documents on postal services, telecommunications, and information technology.

3. Participate in reviewing the postal services, telecommunications, and information technology components in the socio-economic development planning of the provinces and centrally governed cities and territories under its jurisdiction.

4. Participate in guiding and organizing the implementation of strategies, planning for development, long-term plans, five-year plans, and annual plans regarding postal services, telecommunications, and information technology in the provinces and centrally governed cities under its jurisdiction.

5. Organize inspections and checks on compliance with laws and handle administrative violations concerning postal services, telecommunications, and information technology by organizations and individuals in the provinces and centrally governed cities under its jurisdiction.

6. Receive and resolve complaints and denunciations related to postal services, telecommunications, and information technology activities of organizations and individuals in the provinces and centrally governed cities under its jurisdiction according to the provisions of the law.

7. Participate in resolving disputes between enterprises, receiving and resolving disputes between enterprises and users in the provision and use of postal services, telecommunications, and information technology services in the provinces and centrally governed cities under its jurisdiction according to the provisions of the law.

8. Coordinate with departments and units under the Ministry to organize propaganda, education, and dissemination of laws on postal services, telecommunications, and information technology in the provinces and centrally governed cities under its jurisdiction.

9. Participate in directing information services for national defense, security, diplomacy; flood and disaster prevention and response information; rescue and emergency information in the provinces and centrally governed cities under its jurisdiction.

10. Organize inspections and supervision of the implementation of network safety protection and information security in postal services, telecommunications, and information technology activities in the provinces and centrally governed cities under its jurisdiction.

11. Submit to the Minister for decision-making or decide by delegation to issue, temporarily suspend, suspend, or revoke various types of licenses, certificates, and certifications on postal services, telecommunications, and information technology according to the provisions of the law and the classification of the Minister; study proposals, organize construction, and submit to the Minister contents related to administrative reform in management and issuance of various types of licenses;

12. Collect, manage, and use fees and charges related to postal services, telecommunications, and information technology in the area under its jurisdiction according to the provisions of the law and the classification of the Minister.

13. Manage organization, cadres, civil servants, staff, assets, files, and documents of the Administration according to the provisions of the law and the classification of the Minister.

14. Performing other tasks assigned by the Minister.

Article 3The Postal, Telecommunications, and Information Technology Administration Region II is headed by the Director, assisted by Deputy Directors and a support staff.

The Director of the Postal, Telecommunications, and Information Technology Administration Region II is responsible before the Minister of Posts and Telecommunications for the results of performing the functions, tasks, and powers stipulated in Article 1 and Article 2 of this Decision.

Deputy Directors assist the Director and are responsible to the Director for the tasks delegated to them.

Article 4The organizational structure of the Postal, Telecommunications, and Information Technology Administration Region II includes:

1. Postal Services Division

2. Telecommunications Division

3. Information Technology Division

4. Organization and Administrative Division

5. Finance and Accounting Department

6. Inspectorate of the Postal, Telecommunications, and Information Technology Administration Region II (referred to as Inspectorate II)

The staffing of the Postal, Telecommunications, and Information Technology Administration Region II is established by the Director and submitted to the Minister of Posts and Telecommunications for decision.

The functions, tasks, powers, organizational structure, and working relationships among subordinate units of the Postal, Telecommunications, and Information Technology Administration Region II are defined by the Director according to the classification of the Minister.

Article 5The Postal, Telecommunications, and Information Technology Administration Region II has legal personality, its own seal and account, and its headquarters is located in Ho Chi Minh City.

Article 6This Decision takes effect from the date of signing. Previous regulations contrary to this Decision are abolished.
