Guidelines for issuing exit-entry permits to foreigners residing in Vietnam without passports

Pursuant to Decree No. 21/2001/NĐ-CP dated May 28, 2001 of the Government detailing the implementation of the Ordinance on Entry into, Exit from, and Residence of Foreigners in Vietnam;
Pursuant to Resolution No. 61/NQ-CP dated December 17, 2010 of the Government regarding the simplification of administrative procedures within the scope of functions of the Ministry of Public Security;
Pursuant to Decree No. 77/2009/NĐ-CP dated September 15, 2009 stipulating the Functions, Tasks, Authorities, and Organizational Structure of the Ministry of Public Security;
The Ministry of Public Security issues guidelines for issuing exit-entry permits to foreigners residing in Vietnam as follows:
Article 1. Scope of Regulation and Applicability
This Circular guides the procedures for issuing exit-entry permits to foreigners residing in Vietnam without passports.
Article 2. Conditions for Issuing Exit-Entry Permits
Foreigners requesting issuance of an exit-entry permit must meet the following conditions:
1. Possess a Permanent Resident Card issued by the Exit-Entry Administration Authority of Vietnam.
2. Not have a passport issued by competent authorities of their home country.
3. Not be subject to temporary suspension of departure according to Vietnamese law.
Article 3. Validity Period and Usage Value of Exit-Entry Permits
1. The Exit-Entry Permit (English name: Exit and Entry Permit - Model N18 attached) shall be issued individually with a validity period shorter than the time required to renew the Permanent Resident Card by at least one month and cannot be extended.
2. The Exit-Entry Permit does not replace a passport and does not determine the nationality of the holder.
3. Holders of the Exit-Entry Permit accompanied by a Permanent Resident Card are exempt from visa requirements when exiting and entering Vietnam within the validity period of the permit.
Article 4. Procedures, Receiving Office, and Processing Time for Issuance of Exit-Entry Permits
1. The documents include:
- One application form according to Model N17A (issued together with this Circular);
- A copy (without certification) of the Permanent Resident Card issued by the Exit-Entry Administration Authority of Vietnam, along with the original for verification purposes;
- Two new photographs measuring 4 x 6 cm with a white background, looking straight ahead, bareheaded, without tinted glasses, one of which is affixed to the application form;
2. Foreigners residing in Vietnam who request issuance of an Exit-Entry Permit submit their applications to the Exit-Entry Management Department of the Provincial Police or the Exit-Entry Administration Bureau of the Ministry of Public Security where they reside.
3. Within two working days from the date of receipt of complete and valid applications, the Exit-Entry Management Department of the Provincial Police will review and forward the application for issuance of an Exit-Entry Permit to the Exit-Entry Administration Bureau of the Ministry of Public Security. Within four working days from the date of receipt of complete and valid applications, the Exit-Entry Administration Bureau of the Ministry of Public Security will issue the Exit-Entry Permit.
4. Applicants requesting reissuance of an Exit-Entry Permit due to expiration or damage must submit a new application, and if lost, must include a Lost Exit-Entry Permit Declaration Form according to Model N17B (issued together with this Circular).
Article 5. Fees for Issuance of Exit-Entry Permits
Persons receiving an Exit-Entry Permit must pay fees as prescribed by the Ministry of Finance.
Article 6. Recovery of Exit-Entry Permits
1. The Exit-Entry Permit will be recovered if the holder is temporarily suspended from departure according to Vietnamese law.
2. The Exit-Entry Administration Bureau of the Ministry of Public Security or the Exit-Entry Management Department of the Provincial Police will carry out the recovery of Exit-Entry Permits.
Article 7. Handling Violations
Any entity, organization, or individual violating this Circular will be subject to legal action according to the nature and severity of the violation under Vietnamese law.
Article 8. Implementation organization
The Exit-Entry Administration Bureau of the Ministry of Public Security is responsible for:
- Guiding relevant agencies, organizations, and foreigners in implementing this Circular.
- Coordinating with the Consular Affairs Bureau of the Ministry of Foreign Affairs to inform competent authorities of other countries and facilitate the holders of Exit-Entry Permits.
- Printing and managing blank Exit-Entry Permits and Models N17A, N17B issued together with this Circular.
- Conducting state inspections and statistics on the issuance of Exit-Entry Permits.
Article 9. Effective Date
1. This Circular takes effect from August 14, 2011 and replaces Decision No. 679/2007/QĐ-BCA-A11 dated June 20, 2007 of the Minister of Public Security on the issuance and management of "Exit-Entry Permits."
2. Directors of General Departments, Heads of units directly under the Ministry, Directors of Provincial Public Security Departments, and Directors of Provincial Fire Prevention and Control Departments are responsible for implementing this Circular.
During implementation, any arising issues should be reported to the Ministry of Public Security (through the Exit-Entry Administration Bureau) for timely guidance.
