 for employees working in units under the atomic energy sector of the Ministry of Science and Technology

Decree No. 07/2010/ND-CP dated January 25, 2010 of the Government detailing and guiding the implementation of certain provisions of the Atomic Energy Law;

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Atomic Energy Law dated June 3, 2008;

On the basis of The Prime Minister issues this Decision on the allowance system for occupational benefits for employees working in units under the atomic energy sector of the Ministry of Science and Technology.

At the proposal of the Minister of Science and Technology,

This Decision stipulates the allowance system for occupational benefits for those receiving state budget salaries working at the Vietnam Atomic Energy Agency, the Radiation and Nuclear Safety Center, and the Vietnam Atomic Energy Institute under the Ministry of Science and Technology.

Article 1. Scope of Regulation

Civil servants, public officials, and employees working under labor contracts who have been assigned salary grades according to Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary system for civil servants, public officials, public employees, and armed forces personnel.

Article 2. Applicability

Article 3. Levels of occupational benefit allowances

The level of occupational benefit allowances is calculated based on the current grade and step salary plus leadership position allowances and seniority allowances exceeding the ceiling (if applicable), including the following levels:

1. A 70% allowance rate applies to individuals directly and regularly exposed to radiation sources.

2. A 50% allowance rate applies to administrative and service staff directly working at facilities with radiation risk.

3. A 40% allowance rate applies to indirect workers not regularly exposed to radiation sources.

4. A 20% allowance rate applies to administrative and service staff not falling within the scope defined in Clause 2 of this Article.

Article 4. Periods during which occupational benefit allowances shall not be granted to employees working in the atomic energy sector

1. Traveling, working, or studying abroad receiving 40% of the salary as stipulated in Clause 4, Article 8 of Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary system for civil servants, public officials, public employees, and armed forces personnel.

2. Traveling or studying domestically without directly performing tasks assigned in the atomic energy sector continuously for six months or more.

3. Taking personal leave without pay continuously for three months or more, except for medical treatment purposes.

4. Receiving social insurance benefits according to the laws on social insurance (rounded to the month).

5. Being temporarily detained or imprisoned according to the decision of competent authorities or being suspended from work (rounded to the month).

6. Engaging in other work outside the atomic energy sector continuously for six months or more according to the transfer decision of competent authorities.

The funding for implementing the occupational benefit allowance system specified in this Decision shall be guaranteed from the state budget allocated in the annual regular expenditure budget of the Ministry of Science and Technology in accordance with the State Budget Law and other legitimate sources of funding.

Article 5. Source of funds for payment

1. In cases where the subjects specified in Article 2 of this Decision fall under different occupational benefit allowance systems, they shall only enjoy the highest level of occupational benefit allowance, unless otherwise provided by law.

Article 6. Principles of Application

2. In cases where the subjects specified in Article 2 of this Decision concurrently hold multiple positions, they shall only enjoy the occupational benefit allowance corresponding to their main position's function or task or as prescribed by the unit's staffing regulations.

3. The occupational benefit allowances specified in Article 3 of this Decision shall be paid together with monthly salaries and shall not be used to calculate contributions or benefits under social insurance or health insurance schemes.

1. This Decision takes effect from October 1, 2014.

Article 7. Implementation Provisions

2. The Minister of Science and Technology shall organize the implementation of this Decision.

2. The Minister of Science and Technology shall implement this Decision.

3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees directly under the Central Government are responsible for enforcing this Decision./.
