Pursuant to the Government Decree No. 61/2015/NĐ-CP dated July 9, 2015 on employment support policies and the National Employment Fund;
The Minister of Labor, Invalids and Social Affairs issues this Circular guiding the implementation of certain provisions on the National Employment Fund as stipulated in the Government Decree No. 61/2015/NĐ-CP dated July 9, 2015 on employment support policies and the National Employment Fund (hereinafter referred to as Decree No. 61/2015/NĐ-CP).
Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
This Circular guides the loan application files, the preparation of loan plans, and the reporting of loan implementation results from the National Employment Fund as stipulated in the Government Decree No. 61/2015/NĐ-CP.
At the proposal of the Director of the Employment Department,
1. Workers.
Article 1. Scope of Regulation
2. Small and medium enterprises, cooperatives, production and business organizations, individual businesses (hereinafter collectively referred to as production and business establishments).
Article 2. Applicability
3. Other agencies, enterprises, organizations, and individuals related to the contents prescribed in this Circular.
Article 3. Loan Application Files for Employment Support, Job Maintenance, and Expansion for Workers
1. The loan application form prescribed in Point a Clause 2 Article 28 of Decree No. 61/2015/NĐ-CP shall be implemented according to Model No. 01a and Model No. 01b attached hereto.
2. Copies of documents proving that the worker belongs to the priority group as prescribed in Point b Clause 2 Article 12 of the Employment Law shall be guided as follows:
a) For ethnic minority people residing in areas with extremely difficult socio-economic conditions, it is a copy of the identity card or passport or citizen identification card;
b) For persons with disabilities, it is a copy of the disability confirmation certificate issued by the People's Committee of communes, wards, towns (hereinafter collectively referred to as the People's Committee at the commune level).
Article 4. Loan Application Files for Employment Support, Job Maintenance, and Expansion for Production and Business Establishments
1. The loan project prescribed in Point b Clause 2 Article 28 of Decree No. 61/2015/NĐ-CP shall be implemented according to Model No. 02 attached hereto.
2. Copies of documents proving that the production and business establishment belongs to the priority group as prescribed in Point a Clause 2 Article 12 of the Employment Law shall be guided as follows:
a) For production and business establishments employing 30% or more of the total workforce as persons with disabilities, it is a copy of the Decision recognizing the production and business establishment employing 30% or more of the total workforce as persons with disabilities issued by the Department of Labor, Invalids and Social Affairs;
b) For production and business establishments employing 30% or more of the total workforce as ethnic minorities, it includes: list of ethnic minority workers, copies of identity cards or passports or citizen identification cards, and copies of labor contracts or recruitment decisions of those workers listed;
c) For production and business establishments employing 30% or more of the total workforce as persons with disabilities and ethnic minorities, it includes: list of workers who are persons with disabilities and ethnic minorities, copies of disability confirmation certificates of workers who are persons with disabilities issued by the People's Committee at the commune level, copies of identity cards or passports or citizen identification cards of workers who are ethnic minorities, and copies of labor contracts or recruitment decisions of those workers listed.
b) For production and business establishments employing 30% or more of the total number of workers as ethnic minority people including: list of ethnic minority workers, copies of identification cards or passports or citizen identity cards and copies of labor contracts or employment decisions for those workers listed;
c) For production and business establishments employing 30% or more of the total number of workers as persons with disabilities and ethnic minority people including: list of workers who are persons with disabilities and ethnic minority people, copies of disability confirmation certificates issued by the People's Committee of communes for workers who are persons with disabilities, copies of identification cards or passports or citizen identity cards for ethnic minority workers, and copies of labor contracts or employment decisions for those workers listed;
Article 5. Loan application documents for workers going to work abroad under contracts
1. The loan request form prescribed in Point a Clause 2 Article 40 Decree No. 61/2015/ND-CP shall be implemented according to Model No. 03a and Model No. 03b issued together with this Circular.
2. A copy of the document proving that the worker falls within the category specified in Clause 2 Article 11 of Decree No. 61/2015/ND-CP shall be provided as follows:
a) For workers from households recognized as near-poor by the People's Committee of the commune in the loan request form stipulated in Clause 1 of this Article;
b) For workers who are relatives of those who have rendered meritorious service to the revolution, a copy of the certificate confirming their status as relatives of those who have rendered meritorious service to the revolution according to Model No. 04 issued together with this Circular.
Article 6. Building the loan capital plan
1. Before July 10 each year, the Department of Labor, Invalids and Social Affairs assists the People's Committee of provinces and centrally-run cities in building the loan capital plan to support job creation, maintenance, and expansion, and preferential loans for workers going to work abroad under contracts from the National Employment Fund and sends it to the Ministry of Labor, Invalids and Social Affairs.
2. Before July 10 each year, the central agencies of the Vietnam Women's Union, the Communist Youth Union, the Farmers' Association, the General Confederation of Labor, the Veterans' Association, the Federation of Trade Unions, and the Vietnam Blind Association build the loan capital plan to support job creation, maintenance, and expansion and send it to the Ministry of Labor, Invalids and Social Affairs.
3. The loan capital plan from the National Employment Fund includes the following main contents:
- Evaluation of the results of the first six months and the forecast for the whole year;
- Demand for additional capital;
- Job creation, maintenance, and expansion targets;
- Targets for sending workers to work abroad under contracts (for provinces and centrally-run cities);
- Implementation solutions.
Article 7. Reporting on the Results of Loans from the National Employment Fund
1. Quarterly, before the 20th day of the first month, the Branch of the Social Policy Bank reports to the Department of Labor, Invalids and Social Affairs on the results of loans to support job creation, maintenance, and expansion, and preferential loans for workers going to work abroad under contracts from the National Employment Fund according to Model No. 05 and Model No. 06 issued together with this Circular.
2. Quarterly, before the 20th day of the first month, the Sub-branch of the Social Policy Bank reports to the Department of Labor, Invalids and Social Affairs on the results of loans to support job creation, maintenance, and expansion, and preferential loans for workers going to work abroad under contracts from the National Employment Fund according to Model No. 07 and Model No. 08 issued together with this Circular.
3. Quarterly, before the 20th day of the first month, the Social Policy Bank reports to the Ministry of Labor, Invalids and Social Affairs on the results of loans to support job creation, maintenance, and expansion, and preferential loans for workers going to work abroad under contracts from the National Employment Fund according to Model No. 09 and Model No. 10 issued together with this Circular.
Article 8. Effectiveness and Implementation Responsibility
1. This Circular takes effect from December 31, 2015.
Provisions on loan application documents take effect from September 1, 2015.
2. Circular Jointly Issued No. 14/2008/TTLT-BLDTBXH-BTC-BKHĐT dated July 29, 2008, of the Ministry of Labor, Invalids and Social Affairs, the Ministry of Finance, and the Ministry of Planning and Investment guiding certain provisions of Decision No. 71/2005/QD-TTg dated April 5, 2005, of the Prime Minister on the management and operation mechanism of the National Employment Fund's loan capital and Decision No. 15/2008/QD-TTg dated January 23, 2008, of the Prime Minister amending and supplementing certain provisions of Decision No. 71/2005/QD-TTg cease to be effective from the date this Circular takes effect.
3. The Social Policy Bank shall implement loans to the correct target groups, ensuring job creation goals and capital preservation; for workers, loans may be made directly or through households.
4. The Department of Labor, Invalids and Social Affairs and related agencies, enterprises, organizations, and individuals are responsible for implementing this Circular.
Any difficulties encountered during implementation should be reported to the Ministry of Labor, Invalids and Social Affairs for timely guidance./.
