AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF JOINT CIRCULAR NO. 07/2016/TTLT-BYT-BTC-BLDTBXH DATED APRIL 15, 2016 ISSUED BY THE MINISTRIES OF HEALTH, FINANCE, LABOR, WAR INVALIDS AND SOCIAL AFFAIRS PROVIDING GUIDELINES FOR DECREE NO. 39/2015/NĐ-CP DATED APRIL 27, 2015 OF THE GOVERNMENT ON POLICIES TO SUPPORT ETHNIC MINORITY WOMEN IN POVERTY WHEN GIVING BIRTH IN ACCORDANCE WITH POPULATION POLICY

Pursuant to the Government's Decree No. 75/2017/NĐ-CP dated June 20, 2017 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
Pursuant to Decree No. 39/2015/NĐ-CP dated April 27, 2015 of the Government on policies to support ethnic minority women in poverty when giving birth in accordance with population policy;
Implementing Resolution No. 60/NQ-CP dated July 6, 2017 of the Government on simplifying administrative procedures related to population management within the scope of functions of the Ministry of Health;
The Minister of Health issues this Circular on initial recording and reporting system for population statistics.
The Minister of Health issues this Circular amending and supplementing certain articles of Joint Circular No. 07/2016/TTLT-BYT-BTC-BLDTBXH dated April 15, 2016 providing guidelines for Decree No. 39/2015/NĐ-CP dated April 27, 2015 of the Government on policies to support ethnic minority women in poverty when giving birth in accordance with population policy (hereinafter referred to as Joint Circular No. 07/2016/TTLT-BYT-BTC-BLDTBXH).

Article 1. Amending and supplementing certain articles of Joint Circular No. 07/2016/TTLT-BYT-BTC-BLDTBXH

1. Amending Clause 3 of Article 3 as follows:

"3. A resident in a difficult administrative unit is a person who has a permanent household registration or temporary residence certificate and currently resides in a commune-level administrative unit in a difficult area as defined in Decision No. 1010/QĐ-TTg dated August 10, 2018 of the Prime Minister on difficult commune-level administrative units."

2. Amend Clause 1 of Article 4 as follows:

“1. The application form for requesting financial support for giving birth in accordance with population policy of the beneficiaries according to Model No. 1a issued together with this Circular for those with a citizen identification number and Model No. 1b issued together with this Circular for those without a citizen identification number. Immediate relatives of the beneficiaries shall fill out the application form in cases where the beneficiaries cannot write or are too weak to fill it out themselves.”

3. Amends Clause 2 of Article 8 as follows:

“2. Annually, at the time of preparing the state budget estimate, based on the level of support and the number of beneficiaries expected to be supported reported by the People's Committee of the commune, the agency responsible for population work at the district level shall prepare the budget estimate for implementing the support policy along with the regular expenditure budget and submit it to the Center for Population and Family Planning (if under the Center for Population and Family Planning) or to the Finance Department (if under the People's Committee of the district) or to the Department of Health (if under the Department of Health) for consolidation and submission to the competent authority for decision.”

4. Amending Point c of Clause 10 of Article 10 as follows:

"c) Assist the Minister of Health in compiling annual reports to the Government on the implementation results of the support policy; periodically review and summarize the implementation of the support policy nationwide;"

5. Supplementing Clause 11 to Article 10 as follows:

"11. The Ethnic Affairs Department or the agency responsible for ethnic affairs in the locality shall be responsible for:"

a) Coordinating with the health, labor, war invalids and social affairs, and finance sectors at the local level to guide and implement the support policy;

b) Coordinating inspections and checks on the implementation of the support policy."

6. Replacing the phrase "Center for Population and Family Planning or the agency responsible for population work at the district level" with the phrase "Agency responsible for population work at the district level".

Article 2. Effective Date

1. This Circular takes effect from March 1, 2019.

2. Abolishing Clause 3 of Article 3, Clause 1 of Article 4 (including the abolition of Model No. 01 issued together with Joint Circular No. 07/2016/TTLT-BYT-BTC-BLDTBXH), Clause 2 of Article 8, Point c of Clause 10 of Article 10 of Joint Circular No. 07/2016/TTLT-BYT-BTC-BLDTBXH from the date this Circular takes effect.

Article 3. Responsibility for Implementation

The Minister, Heads of Ministries equivalent to Ministries, Heads of agencies under the Government; Chairpersons of Provincial People's Committees and Municipal People's Committees directly under the Central Government are responsible for implementing this Circular. In the process of organizing its implementation, if there are difficulties or obstacles, please report them to the Ministry of Health (General Department of Population and Family Planning) for consideration and resolution.
