CIRCULAR

Regulations on code numbers, occupational standards, and
salary grading for specialized inspection staff inspectors

 

Pursuant to the Law Vspecialized staff on November 15, 2010; Law "7. A flexible power plant is a thermal power plant using reciprocating internal combustion engines (RICE) or aeroderivative gas turbines (Aero-GT) with fast start-up capabilities, designed in modular form to generate electricity for balancing capacity and maintaining power system stability."amendments and supplements to certain articles of the Civil Servants Law and the Public Officer Law on November 25, 2019;

Pursuant to the Government Decree Decision No. 115/2020/NĐ-CP dated September 25, 2020 of the Government regulations on recruitment, utilization, and management of public officers;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for civil servants, public officers, and armed forces; Decree No. 17/2013/NĐ-CP dated February 19, 2013 and Decree No. 117/2016/NĐ-CP dated July 21, 2016 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for civil servants, public officers, and armed forcesonfor civil servants, public officers, and armed forces;

Pursuant to Decree No. 56/2022/NĐ-CP dated 24 the 8 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;22 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry Ministry of Transport;

The Minister of Transport issues this Circular stipulating the standards for Railway Inspection Officers and requirements for the material and technical facilities of railway inspection organizations.

Chapter I GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates code numbers, occupational standards, and salary grading for specialized inspection staff.

Article 2. This Circular applies to specialized inspection staff at public service units and related organizations and individuals.

Non-public service units may apply the provisions of this Circular.

Article 2. Code Numbers of Occupational Standards for Specialized Inspection Staff

1. Specialized Inspector Grade I Code Number: V.12.31.01

2. Specialized Inspector Grade II Code Number: V.12.31.02

3. Specialized Inspector Grade III Code Number: V.12.31.03

4. Specialized Inspector Grade IV Code Number: V.12.31.04

Article 3. General standards for professional ethics

1. Adhere to the Party's guidelines and policies, State laws and policies.

2. Be honest, objective, and highly responsible for assigned tasks; fulfill all obligations of a civil servant in professional activities.

3. Have a sense of moral self-improvement, maintain professional integrity, honor, and reputation; do not abuse work positions or assigned tasks for personal gain; be united, innovative, and ready to enhance their qualifications by learning new knowledge; have a sense of cooperation, helping colleagues, sharing work experience; actively participate in scientific research topics, technical improvements to develop the profession and improve qualifications.

Chapter II OCCUPATIONAL STANDARDS

Article 4. Specialized Inspector Grade I - Code Number: V.12.31.01

1. Tasks

a) Lead the implementation of tasks in the field of inspection according to the functions and responsibilities of public service units as prescribed by law;

b) Lead the research, proposal, construction of policies, directions, plans for development and application of science and technology in inspection management activities;

c) Lead the research and construction of professional inspection management regulations;

d) Lead the organization of summary, evaluation, and proposals for solutions to enhance the effectiveness of inspection activities;

đ) Lead the research of topics, projects, scientific studies aimed at improving and perfecting management mechanisms, enhancing the efficiency of inspection activities;

e) Lead the compilation and construction of professional guidance materials in the field of inspection; lead the organization of specialized training sessions, vocational training, or dissemination of professional knowledge and experience in inspection;

g) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate in professional career standard training for specialized inspection staff.

3. Qualifications regarding professional expertise and skills:

a) Master the viewpoints, guidelines, and policies of the Party, laws and policies of the State; the situation and trends in the development of the inspection field;

b) Master the legal provisions both domestically and internationally regarding the inspection field; have in-depth knowledge of the inspection field; have the ability to apply and implement technology within the scope of their duties;

c) Have the ability to research, construct projects, programs, action plans; the ability to advise on strategic planning, planning, policy-making related to the professional inspection field;

d) Have the ability to organize the implementation of assigned tasks; the ability to analyze and synthesize practical issues, propose solutions to improve professional inspection policies;

đ) Have skills in drafting, presenting, constructing, and implementing projects, programs related to inspection activities;

e) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages for civil servants working in ethnic minority areas according to job requirements.

Article 4. Conditions for registering to take the examination or being considered for promotion to the position of Specialized Inspector Grade I: A person can register to take the examination or be considered for promotion to the position of Specialized Inspector Grade I when they meet the conditions stipulated in Article 32 of Decision No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of public officers, and the following conditions:

a) Having held the position of Specialized Inspector Grade II or equivalent for at least six years. In cases with equivalent time, they must have held the position of Specialized Inspector Grade II for at least one year (twelve months) up to the deadline for submitting registration forms for the examination or promotion;

b) During the period of holding the position of Specialized Inspector Grade II or equivalent, they must have participated in drafting at least two (two) legal documents or have participated in researching and drafting at least two (two) research topics, projects, or programs at the ministry level or higher related to the inspection field, which have been issued, accepted, or approved by competent authorities.

Article 5. Inspector of Grade II - Code: V.12.31.02

1. Duties:

a) To take the lead or participate in performing tasks within the inspection field under the functions and duties of public service units as prescribed by law;

b) To take the lead or participate in researching, proposing, and building policies, orientations, plans for developing and applying science and technology in management activities;

c) To take the lead or participate in researching and establishing regulations on specialized business management in the inspection field;

d) To take the lead or participate in organizing summaries, evaluations, and proposing solutions to enhance the effectiveness of inspection work;

đ) To take the lead or participate in researching topics, projects, scientific works aimed at reforming, perfecting management mechanisms, improving efficiency of inspection activities;

e) To take the lead or participate in organizing the compilation and establishment of professional guidance materials in the inspection field; to take the lead or participate in organizing specialized training sessions, vocational training, or disseminating knowledge and experience in the inspection field;

g) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate in professional career standard training for specialized inspection staff.

3. Qualifications regarding professional expertise and skills:

a) Master the viewpoints, guidelines, and policies of the Party, laws and policies of the State; the situation and trends in the development of the inspection field;

b) Master the legal provisions both domestically and internationally regarding the inspection field; have in-depth knowledge of the inspection field; have the ability to apply and implement technology within the scope of their duties;

c) To have research capabilities, project proposal development, program action plan development; advisory capabilities in planning and policy-making related to the specialized vocational field of inspection;

d) To have research capabilities, practical summary and solution proposal capabilities to improve quality and efficiency in assigned fields;

đ) Have basic computer skills and be able to use foreign languages or ethnic minority languages as required by the position for civil servants working in ethnic minority areas.

4. Criteria and Conditions for Registering to Take the Examination or Be Considered for Promotion to the Title of Inspector of Grade II: An inspector may register to take the examination or be considered for promotion to the title of Inspector of Grade II when meeting all criteria and conditions stipulated in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, use, and management of civil servants, and the following criteria and conditions:

a) Having held the title of Inspector of Grade III or equivalent for at least nine years (excluding probationary and trial periods). In cases with equivalent time, there must be at least one year (full twelve months) holding the title of Inspector of Grade III up to the deadline for submitting registration forms for the examination or promotion;

b) During the period of holding the title of Inspector of Grade III or equivalent, having participated in at least two ministry-level or higher scientific and technological tasks that were accepted at a satisfactory level or above, related to the inspection field, as issued, accepted, or approved by competent authorities;

Article 6. Inspector of Grade III - Code: V.12.31.03

1. Duties:

a) To participate in drafting normative legal documents or to take the lead or participate in drafting technical standards, technical regulations, and professional materials on inspection;

b) To establish or participate in establishing inspection plans for specific objects within the assigned scope and specialty;

c) To organize the implementation of inspections; to propose measures to ensure safety during assigned tasks to enhance the efficiency and quality of inspection work;

d) To promptly identify equipment and tool malfunctions serving inspection purposes, and to propose corrective measures to ensure inspection quality;

đ) To propose the establishment, amendment, supplementation, and participation in drafting normative legal documents, technical standards, technical regulations, professional materials, and training programs for inspection when assigned;

e) To participate in accident investigations, cause determinations of incidents, traffic accidents, and other accidents when assigned;

g) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate in professional career standard training for specialized inspection staff.

3. Qualifications regarding professional expertise and skills:

a) Master the viewpoints, guidelines, and policies of the Party, laws and policies of the State; the situation and trends in the development of the inspection field;

b) To have the ability to perform inspection-related tasks within the assigned scope;

c) To have the ability to grasp and apply advanced methods and technologies during assigned inspection tasks in accordance with the trained specialty;

d) To have the ability to guide vocational practices, disseminate experiences, and participate in scientific research to serve inspection work;

đ) To recognize potential hazards and establish preventive measures against incidents while performing tasks;

e) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages for civil servants working in ethnic minority areas according to job requirements.

4. Criteria and Conditions for Registering to Take the Examination or Be Considered for Promotion to the Title of Inspector of Grade III: An inspector may register to take the examination or be considered for promotion to the title of Inspector of Grade III when meeting all criteria and conditions stipulated in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, use, and management of civil servants, and having held the title of Inspector of Grade IV or equivalent for at least three years (excluding probationary and trial periods). In cases with equivalent time, there must be at least one year (full twelve months) holding the title of Inspector of Grade IV up to the deadline for submitting registration forms for the examination or promotion.

Article 7. Inspector of Grade IV - Code: V.12.31.04

1. Duties:

a) Receive work requests for inspection; issue inspection files in accordance with the provisions of the law; record files and management registers to serve inspection work; statistics and reporting; receive, manage, and store files and seals to serve inspection work;

b) Develop or participate in developing plans to implement inspections according to assigned tasks; directly perform inspections within the scope of assigned tasks. Evaluate the process of performing assigned tasks, propose measures to ensure safety to prevent accidents that may occur during the performance of assigned tasks;

c) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a college degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate in professional career standard training for specialized inspection staff.

3. Qualifications regarding professional expertise and skills:

a) Understand the principles, regulations, procedures, and content of business guidance, management objectives in the field of inspection;

b) Be proficient in the sequence, procedures, and processes of implementing tasks within the assigned scope;

c) Have the ability to perform inspection-related business tasks within the assigned scope;

d) Proficiently use office equipment and other tools necessary for task requirements.

4. Criteria and conditions for registering to take the examination or be considered for promotion to the position of Inspector of Grade IV: An inspector can register to take the examination or be considered for promotion to the position of Inspector of Grade IV when meeting all criteria and conditions stipulated in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, use, and management of civil servants and having held the position of Inspector of Grade V and equivalent positions for at least three years (excluding probation and trial periods). In cases with equivalent time, they must have held the position of Inspector of Grade V for at least one year (12 months) up to the deadline for submitting registration applications for the examination or promotion.

Chapter III SALARY GRADING FOR PROFESSIONAL CIVIL SERVANTS IN THE FIELD OF INSPECTION

Article 8. Principles for salary grading for professional civil servants in the field of inspection

1. The appointment and salary grading for professional civil servants in the field of inspection must be based on the job position, responsibilities, and professional qualifications currently held and fully meet the standards prescribed in this Circular.

2. When transferring to a corresponding professional civil servant position in the field of inspection, it shall not be combined with an increase in salary grade or promotion in the professional civil servant position.

Article 9. Salary Grading for Professional Civil Servants in the Field of Inspection

1. From the date this Circular takes effect, in cases where civil servants do not yet meet the conditions and standards to be appointed to the position of professional civil servant in the field of inspection as prescribed in Articles 4, 5, 6, and 7 of this Circular, the following shall apply:

a) If the civil servant has less than five years (60 months) of service until retirement, they will continue to hold their current rank or position and be graded according to the current salary scale;

b) If the civil servant has five years (60 months) or more of service remaining, within three years (36 months), the employing agency is responsible for arranging training to ensure that the civil servant meets the standards of the professional civil servant position in the field of inspection as prescribed in this Circular. After the period specified herein, if the civil servant does not meet the standards prescribed in this Circular, the head of the public institution will consider assigning alternative suitable work or implementing policies as prescribed.

2. The professional civil servant positions in the field of inspection prescribed in this Circular shall apply the Specialized Professional Pay Scale for State-Owned Public Institution Staff (Table 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, staff, and armed forces personnel, as follows:

a) The position of Inspector of Grade I shall apply the salary coefficient of type A3, group 1 (A3.1) from coefficient 6.20 to coefficient 8.00;

b) The position of Inspector of Grade II shall apply the salary coefficient of type A2, group 1 (A2.1) from coefficient 4.40 to coefficient 6.78;

c) The position of Inspector of Grade III shall apply the salary coefficient of type A1 from coefficient 2.34 to coefficient 4.98;

d) The position of Inspector of Grade IV shall apply the salary coefficient of type A0 from coefficient 2.10 to coefficient 4.89.

3. The transfer of salary grading for civil servants in the field of inspection currently holding salaries in various civil servant ranks to the professional civil servant positions in the field of inspection prescribed in this Circular shall be implemented according to the guidelines set out in Clause 2, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs on salary grading when upgrading, changing ranks, or types of civil servants, specifically as follows:

a) Salary grading for the position of Inspector of Grade I, code V.12.31.01 for civil servants currently holding type A3, group 1 (A3.1);

b) Salary grading for the position of Inspector of Grade II, code V.12.31.02 for civil servants currently holding type A2, group 1 (A2.1);

c) Salary grading for the position of Inspector of Grade III, code V.12.31.03 for civil servants currently holding type A1;

d) Salary grading for the position of Inspector of Grade IV, code V.12.23.04 for civil servants currently holding type A0.

Chapter IV IMPLEMENTATION PROVISIONS

Article 10. Effective Date

1. This Circular takes effect from March 1, 2023.

2. In cases where the legal normative documents cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the provisions of the amended, supplemented, or replacing documents.

Article 11. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Vehicle Inspection Agency, the Heads of agencies, units, organizations, and individuals related to this Circular are responsible for its implementation./.
